About this file
This Request for Quote (RFQ) document is issued by the Commonwealth of Kentucky Department of Military Affairs to solicit bids for a mobile file storage system. The solicitation (RFQ 095 1900000096) was released on March 27, 2019, with a closing date of April 30, 2019, at 1:00 PM EST. The Department seeks a single mechanical high-density mobile filing system to accommodate approximately 25 file cabinets' worth of files, with allowance for future expansion. The system must fit within maximum dimensions of 7 feet in length, 7 feet in height, and approximately 31 inches deep, feature filing on both sides with a maximum shelf depth of 16 inches per side, and include ergonomically designed handles, safety locks, and optional controlled access capability. The system will be installed in the EOC Building at Boone National Guard Center, 100 Minuteman Parkway, Frankfort, Kentucky. Bidders are required to conduct site visits during business hours (Monday-Friday, 8:00 AM to 4:00 PM) to verify measurements and assess site conditions; failure to inspect does not constitute grounds for claims after award. The anticipated contract award and installation completion is scheduled for within six months, with completion targeted by December 2019. Site visit questions will be addressed as modifications to the solicitation, and all questions must be submitted by April 12, 2019, with answers anticipated by April 18, 2019.
The evaluation will be based on best value scoring with price weighted at 75 points (lowest price receives maximum points) and availability/installation time weighted at 25 points (quickest delivery and installation receives maximum points), for a total of 100 points. All pricing must be submitted on the bid sheet as unit price and total price and must remain valid for a minimum of 60 calendar days after the bid due date. Quotations should be F.O.B. Destination Freight Prepaid and Allowed, with the vendor bearing all shipping and freight charges. The contract will be exclusive to the Department of Military Affairs, though the department reserves the right to offer the contract to other state agencies with vendor consent. Resident bidders may receive reciprocal preference in accordance with Kentucky statutes, and qualified bidders including Kentucky Correctional Industries and nonprofits serving individuals with disabilities may receive preference equal to 15 or 20 percent of maximum points. All equipment must be new and current model in first class condition, and the vendor must provide instruction and operating manuals. Bids must be submitted in sealed, hardcopy form only to Leslie Stamper, Administrative Branch Manager, at the Department of Military Affairs; electronic and faxed responses are not acceptable. The contract establishes no price increases during the first 12 months, and price adjustments thereafter require written justification. The Commonwealth may cancel the contract with 30 days' written notice.

Section 1 Scope of Contract
The Department of Military Affairs issues this Solicitation to establish an Award Contract for the following:
Document Description Page 4
1900000096 MOBILE FILE STORAGE SYSTEM of 19 mailto:LESLIE.C.STAMPER.NFG@MAIL.MIL
Department of Military Affairs, Administrative Services Division as detailed below:
The Contractor shall be responsible for visiting the site and ascertaining pertinent local conditions such as location, accessibility, and general character of the site to ensure the system they are proposing will meet our needs and will work in our location.
The Vendor shall supply the necessary personnel, equipment, tools, material and other items necessary to perform the services required as specified below for the Mobile Filing System and Installation in the EOC Building at Boone National Guard Center.
We are looking for a mobile file system to accommodate files that, at the moment, fit in approximately 25 file cabinets. The system should allow for growth expansion as well.
The allowable measurements within the space we will have for the install is a maximum of 7 feet in length, 7 feet in height and approximately 31 inches deep. It should allow filing on both sides of each unit with a maximum shelf depth of 16” on each side to accommodate both standard and legal file folders.
Color and materials must be of such that will withstand daily use.
Cabinets will sit on an anti-tip tracking system mounted onto the current floor structure.
System Controls Handles will be ergonomically designed, soft-touch rotating handles.
The system should include safety locks to enhance user safety and unwanted movement.
As an option, we are interested in a controlled access ability and should be quoted as an option.
Site Visit-
Bidders are required to inspect the site where the file system will be installed to acquire accurate measurements to install the system that will meet our current needs.
In no event shall a failure to inspect the site constitute grounds for a claim after award of the contract.
Pricing information shall not be made known in any form to agency representatives during the site visit. Failure to comply with this requirement shall render the bid non- responsive. It is the bidder’s responsibility to verify any measurements of the location. Vendors may ask questions during the site visit(s). All questions will be addressed as a modification to the solicitation.
Potential bidders should clearly understand that any verbal representatives made or assumed to be made during any oral discussions held between representatives of potential bidders and any state employee or official are not binding on the Commonwealth of Kentucky.
For violation of this provision, the Commonwealth shall reserve the right to disqualify the bid/proposal.
Site visits may be scheduled Monday through Friday 8:00 AM to 4:00 PM.

Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. In the event of any conflicts between the specifications, terms and conditions indicated by the Commonwealth and those indicated by the Contractor, those of the Commonwealth take precedence. The Contract supercedes all bids or other prior agreements, oral or written, and all other communications between the parties relating to this subject.
Section 18 Post Contract Agreements The resulting Contract shall constitute the entire agreement between the State and awarded Contractor. Unless contractually provided, State agencies utilizing this Contract will not be required to enter into nor sign further agreements, leases, company orders or other documents to complete or initiate the terms of a Contract resulting from this Solicitation or offer. Section 22 Manuals Instruction and operating manuals shall be furnished for all equipment installed.

Section 24 Vendor’s Report The vendor(s) may be asked to furnish the buyer, Department of Military Affairs, a report showing volume which has been sold to the Commonwealth and its using agencies each six (6) months of the contract period. The report will include political subdivisions and university purchases. This report may be the vendor’s computer printout sheet or form. This shall apply to all items, which are to become a part of this contract. This report must reference usage by brief description, product number or other format designated by the Department of Military Affairs.
Section 25 FOB Basis of Shipment – Vendor Responsible Quotations of unit prices on this Solicitation shall be F.O.B. Destination Freight Prepaid and Allowed. The Vendor shall be fully responsible for all shipments and freight charges involved to the ordering agency.

In the event such action is taken, the contract shall be null and void upon receipt of a Modification from the Department of Military Affairs canceling the contract.
Section 27 Exception to Required Use of Contract The establishment of this Contract is not intended to preclude the use of similar products when requested by the agency. The Commonwealth of Kentucky reserves the right to contract for large requirements by using a separate solicitation.
Section 28 Service Performance All services performed under contract shall be in accordance with the terms and provisions of the contract. It will be the agency’s responsibility to ensure that such services rendered are performed and are acceptable.
The relationship between the State and the Contractor is that of client and independent Contractor. No agent, employee, or servant of the Contractor or any of
Document Description Page 12 its subcontractors shall be or shall be deemed to be an employee, agent, or servant of the State for any reason. The Contractor will be solely and entirely responsible for its acts and the acts of its agents, employees, servants and subcontractors during the performance of this Contract.
Major deviations of services performed will not be made without the written approval of the Department of Military Affairs. Problems that arise under any aspect of performance should first be resolved between the Vendor and the agency. Either party should refer in writing any such problems and/or disagreements that cannot be resolved to the Office of Procurement Services for settlement.
Section 29 Addition or Deletion of Items or Services The Department of Military Affairs reserves the right to add new and similar items, with the consent of the Vendor, to any contract awarded from this Solicitation. The Department of Military Affairs to effect this change will issue a Contract Modification.
Until such time as the Vendor receives a Modification, the Vendor shall not accept Delivery Orders from any agency referencing such items or services.
Section 30 Agreement between Parties By submitting a bid, the bidder acknowledges and agrees to be bound by the terms and conditions of the Solicitation.
The bidder agrees that a resulting contract is the complete and exclusive statement of the agreement between the parties, which supersedes all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this Solicitation. It is further agreed between the parties, that any valid modification of contractual agreement must be formalized by issuance of a Contract Modification from the Office of Procurement Services.
Purchase or Sales Agreements, supplied by the bidder making an offer, in reply to the Solicitation, will not be accepted. The only terms and conditions acceptable to the Commonwealth of Kentucky are as outlined in the Solicitation. Bids not conforming will be considered as non-responsive.
Section 31 Funding-Out Provision The Vendor agrees that if funds are not appropriated to the agency or are not otherwise available for the purpose of making payments, the agency shall be authorized, upon sixty (60) days written notice to the Vendor, to terminate this contract. The termination shall be without any other obligation or liability of any cancellation or termination charges, which may be fixed by the contract.
Section 32 Governmental Restrictions In the event any Governmental restrictions may be imposed which would necessitate alteration of the material, quality, workmanship, or performance of the items offered on this proposal prior to delivery, it shall be the responsibility of the successful bidder to notify the Department of Military Affairs in writing, indicating the specific regulation which requires such alterations. The Commonwealth reserves the right to accept any such alterations, including any subsequent price adjustments, or to cancel the contract.
Section 33

Section 34 Inspection All supplies, equipment and services shall be subject to inspection or tests by the Commonwealth prior to acceptance. In the event supplies, equipment or services are defective in material or workmanship or otherwise not in conformity with specified requirements, the Commonwealth shall have the right to reject the items or services or require acceptable correction at the Vendor’s expense.
