B. Section L-M
| Question ID | Document | Section | Page # | Question | CMS Answer/Action | Amendment 1? | Amendment # |
| B.1 | DRAFT RFP | M.9.c Potential Exclusion of Sources: Applicable Thresholds | 135 | The draft JA DME MAC RFP in Section M.9 (c) states: |
Applicable Thresholds Following receipt of proposals, CMS will consider executing a D&F to exclude a specific source (or sources) only if CMS determines that awarding the DME MAC Jurisdiction A contract to the specific source (or sources) would exceed the following Applicable Threshold:
• The award will result in a single contractor (single corporate entity) obtaining more than 2 DME MAC prime contracts.
In comparing the “single corporate entity” definition to how that language was used in the A/B MAC procurements we note the recent A/B MAC RFP, Jurisdiction N in Section M.9 (c) states:
Applicable Thresholds Following receipt of proposals, CMS will consider executing a D&F to exclude a specific source (or sources) only if CMS determines that awarding the A/B MAC Jurisdiction N contract to the specific source (or sources) would exceed one or both of the following Applicable Thresholds:
The award will result in a single contractor (single corporate entity) obtaining more than 26% of the national A/B Medicare workload in A/B MAC prime contracts; or, The award will result in any one set of affiliates obtaining more than 40% of the national A/B Medicare workload in A/B MAC prime contracts.
This reading of the 26% limit as a “single corporate entity” intentionally doesn’t include affiliates because there is a second rule concerning the 40% that addresses affiliated entities.
We understand that it is CMS’s intent to prohibit the award of all four DME MAC contracts to affiliates, as defined in section 2.101 of the Federal Acquisition Regulations, because the affiliated organizations would be under the common control of a third party. This would create unacceptable risks to the Medicare program should a significant issue arise with the parent organization that would require the termination of the affiliates’ MAC DME contracts. However, the proposed clause in Section M.9(c) of the draft JA MAC RFP is ambiguous and can be read to permit the award of all DME MAC contracts to affiliated entities that are under the common control of a third-party. We believe that this ambiguity creates an undue risk of protest. More importantly, the proposed language could result in DME MAC contract awards to affiliated entities that would create unacceptable risks for CMS.
| To avoid ambiguity, we suggest changing the above language which reads: “The award will result in a single contractor (single corporate entity) obtaining more than 2 DME MAC prime contracts” to read: “The award will result in a single contractor (including affiliates as defined in FAR 2.101) obtaining more than 2 DME MAC prime contracts”. | CMS confirms the thresholds for A/B and DME MAC contracts are not the same. For DME MAC contracts, CMS will not award a DME MAC contract that will result in a single contractor (single corporate entity) obtaining more than two DME MAC prime contracts. | |||||
| B.2 | DRAFT RFP | B.4 | 4 | Please confirm that based on Section B.4, the total CPAF includes Base Fee + Award Fee + Fixed Fee. | CMS confirms the information provided in RFP section B.4, at award the Total Estimated Cost Plus Award Fee will be the total Estimated Cost + Base Fee + Award Fee + Fixed Fee (only, if applicable). |
| B.3 | Draft RFP | B.6 | 5 | Section B.6 delineates that with the exception of the Implementation CLIN all CLINs should be CPAF. The cost proposal templates appear to allow the contractor to bid fixed fee in addition to the base fee and award fee amounts for those CLINs. Please confirm that is CMS' intent. | CMS confirms that excluding Implementation CLIN 0001 and Workload Closeout Activities CLIN 0009, the CLINs provided for the JA solicitation are all award fee. Cost templates are set up to provide for various scenarios, e.g. CLINs that may include base or other types of fees. | |
| B.4 | Draft RFP | |||||
| JA Synopsis | L.11.a | 93 | Section L.11.a states that proposals are due on February 15, 2024. The JA Synopsis states that proposals are due on February 20, 2024. Please clarify the due date for proposals to be submitted to CMS. | Proposals for JA are due March 8, 2024. See updated RFP. | ||
| B.5 | Draft RFP | L.11.a | 93 | With three federal holidays in the period between the draft solicitation release and the proposal due date, would CMS consider extending proposal due dates to accommodate the reduced number of available working days? | Proposals for JA are due March 8, 2024. See updated RFP. | |
| B.6 | Draft RFP | L.14.3.1.d | 111 | When identifying proposed operational sites in the staffing plan, may the offeror include "Remote" to indicate those staff members who are working in CONUS locations other than a primary office location? | Yes. | |
| B.7 | Draft RFP | |||||
| L.15.2 | 123 | Is there a limit to the number of supplementary activities and cost templates that may be submitted? | CMS confirms there is no limit to submission of cost templates as a result of the direction in section L.15.2. Offerors are reminded that the additional cost template submission is specific to the Offerors documented supplemental activities. |
B.8 Draft RFP
J.35 CLIN 0002
J.36 CLIN 0003 L.15.2 122 Attachments J.35 and J.36 include a reference to SLIN 000XAE for IVIG Demo which is expected to end on 12/31/23. Will the IVIG Demo continue in the next contract? CMS confirms the cost templates are updated to remove IVIG Demonstration.
| B.9 | Draft RFP | L.15.3 | 125 | Is the 2% indirect cost rate ceiling a straight 2% or a 2% factor applied to the total indirect rate? (10% + 2% = 12% or 10% * 2% + 10% = 10.2%) | If an indirect costs rate ceiling is applied, the 10% + 2% = 12% would be correct. | |
| B.10 | Draft RFP | |||||
| J.31 Postage and Printing Cost Tables | L.15.3 | 125 | In J.31, what is the distinction between Proposed Postage Rates (row d) and Proposed Postage Costs (row e)? | CMS confirms that Proposed Postage Rates (row d) is the placeholder for an Offeror to insert their postage rate from the postal service being used in their proposal. Proposed Postage Costs (row e) is the sum of the Offeror's proposed postage rate applied to workload. |
| B.11 | Draft RFP | |||
| J.31 Postage and Printing Cost Tables | L.15.3 | 125 | In J.31, how is row d, "Offeror’s Proposed Postage Rates for Paper MSN Workload" utilized in the equation for calculating the "Offeror’s Total Proposed Postage and Printing Costs for Paper MSN Workload" in row f? d x f = | CMS confirms the Offeror's proposed MSN workload is multiplied by the Offeror's proposed postage rate to determine the postage cost portion for the Offeror's total paper MSN workload. |

| Question ID | Document | Section | Page # | Question | CMS Answer/Action | Lead Analyst | Amendment 1? | Amendment # | |
| C.1 | J.01 SOW | Content.5.6.1 | 5 | Does CMS expect any RAC adjustment to be submitted outside of the VDCs? If so, what is the volume? | CMS confirms the process for the Recovery Audit Contractor (RAC) to send overpayments or underpayments to the MAC. The MAC sends the demand letter to the supplier. The MAC recoups the overpayment from the supplier and ensures the supplier pays appropriately. The MAC updates the demand letters in the RAC Datawarehouse (RACDW). The MAC also receives and processes appeals. | ||||
| C.2 | J.01 SOW | A.5.1.1 | 21 | "Financial management and internal controls (e.g., the Federal Managers’ Financial Integrity Act of 1982 (FMFIA), the Chief Financial Officers’ Act of 1990, etc.);" | |||||
| This is an agency applicable requirement. What, if any, controls are intended to be the responsibility of the contractor? | CMS confirms both regulations and other items listed in this section are provided as key examples of federal requirements and regulations that can and do flow down and effect Agency contractors. MACs are responsible for having internal controls in place based on these two acts which CMS has outlined for the MACs in Publication 100-06, Chapter 7 on Internal Controls. | ||||||||
| C.3 | J.01 SOW | A.5.1.1 | 21 | "Government Performance and Results Act (GPRA);" |
| This is an agency applicable requirement. What, if any, controls are intended to be the responsibility of the contractor? | CMS confirms the Government Performance Results Act (GPRA) is noted in this section of the SOW as a key example of federal requirements and regulations that flow down and effect Agency contractors. MACs are responsible for GPRA derived performance measures. Offerors are directed to the HHS.gov and the Agency Financial Report (AFR) for specific Government Performance Results Act (GPRA) related info published in late 2023. | ||||
| C.4 | J.01 SOW | A.5.1.1 | 21 | "Privacy and information technology requirements (e.g., the Privacy Act of 1974, the Information Technology Management Reform Act of 1996, etc.); and" |
Specific to the ITMRA - This is an agency applicable requirement. What, if any, controls are intended to be the responsibility of the contractor? CMS confirms the Information Technology Management Reform Act of 1996 (ITMRA) is focused on budgeting for system investments and spending, system development risks, and the naming of agency IT management. Regarding system security controls, the MACs need to be compliant with FISMA requirements which are implemented via the Acceptable Risk Safeguards. Both regulations and other items listed in this section are provided as key examples of federal requirements and regulations that can flow down and effect Agency contractors.
| C.5 | J.01 SOW | A.5.1.6 | 22 | This does not appear to be a currently recognized standard. Please explain applicability. Further, www.hitsp.org is an invalid address. Please provide the correct website. | CMS confirms the reference to HITSP has been removed from SOW section A.5.1.6. This section is updated to include the 21st Century Cures Act. As with other regulations and governing direction noted in this section of the SOW, all refereces are provided as examples of federal reguations and requirements that can flow down and effect the Agency's contractors. | |
| C.6 | J.01 SOW | |||||
| J.24 Attestations | B.12 | 30 | The SOW states in Section B.12 that the Medical Review Manager is not required to be fully dedicated. The Key Personnel Attestation in J.24 Attestations states that the Medical Review Manager is not required to be fully dedicated to the DME MAC. Please clarify the dedication requirement for the Medical Review Manager. | CMS confirms the SOW, the Medical Review Manager is not required to be fully dedicated. The Key Personnel Attestation, Attachments J.24 is updated to match the language from the SOW. |
C.7 J.01 SOW C.3.1 41 Will the model language be provided by the CO in the solicitation or contract for the IT Procurements, as required in the tool? CMS is directing Offerors to SOW section C.3, RFP Attachment J.01.H and the CMS Business Partner System Security Manual (BPSSM) for IT guidance and for the model language and classification addressed in SOW references (NIST) Special Publication (SP) 800-60, Volume II: Appendices to Guide for Mapping Types of Information and Information Systems to Security Categories along with FIPS 199. Both provide a model for risk ranking data that will be used within this contract.
C.8 J.01 SOW C.3.1.e.iii 44 "Protected in accordance with NIST SP 800-53, Security and Privacy Controls for Information Systems and Organizations applicable baseline if handled by a Contractor system operated on behalf of the agency, or NIST SP 800-171, Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations if handled by internal Contractor system; and"
Will subcontractor systems utilized then be required to meet NIST SP 800-171 rather than the MAC ARS? CMS confirms all MACs will have to comply with Controlled Unclassified Information (CUI) requirements at some point in the future. The Department of Health and Human Services (HHS) is in the process of finalizing policy that will then need to be tailored by CMS’s Office of Strategic Operations and Regulatory Affairs (OSORA). Until then, MACs are not required to take any steps to implement CUI and shall not include costs to implement CUI in proposals. CMS will issue a change request (CR) to formalize the requirements for the MACs in the future, after award of this contract.
C.9 J.01 SOW C.3.1.l 45 "Contractor Non-Disclosure Agreement (NDA). Each Contractor (and/or any subcontractor) employee having access to non-public government information under this contract must complete the CMS non-disclosure agreement. Contractors (and/or subcontractors) must submit a copy of each signed and witnessed NDA to the Contracting Officer (CO) and/or CO Representative (COR) prior to performing any work under this acquisition."
| May contractor (or subcontractor) personnel complete a substantially similar version of NDA? Generally, personnel NDAs are kept on file for CMS to audit and not delivered to CO/COR - delivery of these would seem to be overly burdensome to both contractors and COs/CORs. | CMS confirms the requirements noted in SOW section C.3.1.1. CMS contractors shall use the CMS Non Disclosure Agreement (NDA). Offerors may consult with Contracting Officers after award with specific additional questions relative to the NDA document and filing signed NDAs. | ||||
| C.10 | J.01 SOW | C.3.1.L.f | 55 | "Rights to Data. All contracts that require data to be produced, furnished, acquired, or used in meeting contract performance requirements, must contain terms that delineate the respective rights and obligations of the Government and the contractor regarding the use, reproduction, and disclosure of that data. Data rights clauses do not specify the type, quantity or quality of data that is to be delivered, but only the respective rights of the Government and the contractor regarding the use, disclosure, or reproduction of the data. Accordingly, the contract must specify the data to be delivered." |
| Will the solicitation specify the data to be produced and the government's intended rights? | CMS confirms the data to be produced and the government’s intended rights are specific to the Government Owned Contractor Operated (GOCO) or Contractor Owned Contractor Operated (COCO) systems. Offerors also are directed to RFP section G.17. The contract will state the government's intended rights to the data and specify what is considered contractor proprietary information versus government property. | |||||
| C.11 | J.01 SOW | C.3.1.L.g.vii | 56 | "vii. | Require external providers to express security and privacy requirements (including the controls for systems processing, storing, or transmitting federal information) in contracts or other formal agreements;" |
| Confirm that IT Procurements Language Tool will provide the appropriate model language that will need to be applied to a external providers? | CMS confirms that language in the SOW, IT Procurement Language Tool and the Business Partner System Security Manual (BPSSM). Offerors are directed to these tools for detailed information, direction and shall develop proposals based on these guidance documents. | ||||
| C.12 | J.01 SOW | C.5.2 | 77 | "In March 2010, CMS informed the Medicare claims processing contractors through TDL-10162 (March 1, 2010) and TDL-10193 (March 24, 2010) that CMS divided the Medicare claims processing contractors into two banking workloads: Workload A consists of CIGNA Government Services, Highmark Medicare Services, National Government Services, National Heritage Insurance Company, and Noridian Administrative Services. Workload B consists of Cahaba Government Benefit Administrators, Pinnacle Business Solutions, First Coast Service Options, Palmetto GBA, TrailBlazer Health Enterprises, and Wisconsin Physician Services." |
| Please confirm that it is CMS' intention that the contractor will work with the current banking contractors. | CMS confirms the intent to utilize the banking contracts as noted in item #13 in the Government Provided Proposal Assumptions (GPPA) document, Attachment J.23. The new DME JA MAC workload will be assigned to US Bank for their MAC Medicare Bank Account. | |||||
| C.13 | J.01 SOW | C.7.2 | 92 | SOW Section C.7.2 includes a reference to Medicare IVIG Access Demonstration which is expected to end on 12/31/23. Will the IVIG Demo continue in the next contract? | CMS confirms the IVIG Demonstration ended on Dececember 31, 2023 and the demonstration will not be on this JA contract. The SOW is updated to remove the reference. Medicare will continue to cover intravenous immune globulin supplies and nursing services in the home for beneficiaries with a diagnosed primary immune deficiency disease under a permanent Medicare benefit effective January 1, 2024. |
C.14 J.01 SOW D.1.1.1 93 Can CMS provide the volume of CEDI support questions that will be directed to the DME MAC versus DME Enrollment contractor? Is this volume already included in the J23B? CMS confirms call volumes in J.23.B include all calls, including any that may be referred by the CEDI contractor. The JA DME MAC and CEDI contractors will sign a Joint Operating Agreement (JOA).
C.15 J.01 SOW D.1.1.2 93 Can CMS please provide the volume breakdown of paper vs. Electronic claims, as well as the average page count per claim? CMS is providing the estimated volume breakdown of paper and electronic claims for each period of perofrmance (POP) in the Government Provided Proposal Assumptions document, Attachment J.23. CMS is not providing an average page count as the page count for each claim varies by type and complexity of the DME item or service, the documentation required to support the medical necessity and coverage criteria, and the format of the claim submission. Offerors are encouraged to document the assumptions used in their proposal to estimate claims page counts for evaluators to consider during proposal review.
C.16 J.01 SOW D.1.2.6.1 97 Can CMS please provide the average volume of claims that require development by the Contractor? CMS confirms that the Investigated claims workload volumes provided in the Basis of Estimate, Attachment J.22, are claims that require development by the MAC.
C.17 J.01 SOW D.2.1.2 108 "Contractors shall process and mail all redeterminations within 60 calendar days of the date the Contractor receives a timely filed request for redetermination. When a party submits additional evidence after filing the request for redetermination, the Contractor’s 60 day decision-making time frame is extended by 14 calendar days for each submission. The decision making timeframe is also extended if the Contractor grants an appellant’s request for an extension of the 120 day filing deadline in accordance with 42 CFR 405.942(b). The 60 day decision making timeframe begins on the date the contractor receives the late-filed request for redetermination, or when the request for an extension is granted, whichever is later"
How many appeals are sent electronically, via fax, and/or on paper? CMS confirms that Offerors are instructed to use their business judgment to determine the proposal breakdown values for paper vs. electronic appeals receipts and further the receipt methods, e.g. fax, etc. Offerors shall describe their methodology for the breakout for appeals receipts within their proposal and document their forcasting method for evaluators to consider during proposal review.
| C.18 | J.01 SOW | D.5.2.1 | 116 | SOW Section D.5.2.1 states "The contractor's PCC shall include the Reopening telephone inquires." Does the DME PCC include Electronic Data Interchange (EDI) telephone inquires as well as reopening and general inquires? | CMS confirms the DME MAC PCC does not include the EDI inquiries. EDI inquiries are handled by the CEDI contractor. |
| C.19 | J.01 SOW | E.4.7.9 | 138 | What is the volume of "Advance Determination of Medicare Coverage" mentioned in SOW Section E.4.7.9? | CMS confirms that on average Offerors can plan for an annual workload of approximately 4200 Advance Determination of Medicare Coverage (ADMC) requests. |
C.20 J.01 SOW E.4.8 142-143 Section E.4.8 of the SOW states, "at a minimum, one DME MAC Medical Director (DMD) shall be present at each of these meetings." Does CMS expect one DMD from any of the DME MACs to be present, or does CMS require one DMD from each MAC to be present? CMS confirms that the SOW does not require one DMD from each of the DME MACs to attend DME Coordination Meetings (DCMs). However, common practice is that all DMDs do participate/attend in support of SOW section B.11.
C.21 J.01 SOW F.2.11 157 What is the anticipated volume per option year? CMS confirms the DMEPOS Competitive Bidding Implementation Contractor (CBIC) activity is in a temporary gap period, the CBIC will not refer any cases or requests to any of the DME MACs at this time and for the foreseeable future. For proposal puroses, Offerors shall assume no workload associated with this SOW requirement. Future CBIC-related direction and activity will be provided to MACs via Change Requests (CRs).

| E.1 | J.22 Basis of Estimate | Spreadsheet line 109, BOE line-item number 100 |
E.4.7.5 - Prepay Provider-Specific MR Number of Claims Reviewed workload NA - line number 109 (not page number) The J.22 Basis of Estimate document provides a 6,312-review workload associated with WBS E.4.7.5. However, MACs are precluded from performing the reviews for E.4.7.5 per CR 10249 Targeted Probe and Educate which explicitly states MACs shall replace this review with TPE (E.4.7.7). Based on our understanding of the workload and the SOW definitions, we believe the 6,312-workload should be allocated to E.4.7.7 Prepay Provider Specific Probe Medical Record Review instead of E.4.7.5.
Would CMS please confirm the workload should be allocated to the E.4.7.7 WBS instead of the E.4.7.5 WBS? CMS confirms that the Basis of Estimate (BOE), Attachment J.22 is updated. The SOW WBS for Prepay Provider Specific Provide Medical Record Review is updated to E.4.7.7.
E.2 J.22 Basis of Estimate Spreadsheet line number 92, BOE line-item number 83
Number of Overpayment recoupment actions received from the UPIC NA - line number 92 The J.22 Basis of Estimate document provides a 100-unit workload for Number of Overpayment Recoupment Actions Received from the UPIC under the E.2 WBS falling under the SOW Program Integrity UPIC Support Services definition. However, the staff supporting this effort allocate similar efforts to Overpayment Recoupment Actions under the C.5.4.1 WBS.
Would CMS please confirm which WBS the Number of Overpayment recoupment actions received from the UPIC workload should be allocated? CMS confirms that the BOE, Attachment J.22, is updated, the correct SOW WBS for reporting the Number of Overpayment Recoupment Actions Received from the UPIC is C.5.4.1.
| E.3 | J.22 Basis of Estimate | "Number of Medical Reviews for Claims Bypassing PA" is included in the J.22 but not the SOW.
