About this file

This Request for Proposal (RFP) is issued by the Commonwealth of Kentucky Finance and Administration Cabinet on behalf of Kentucky Educational Television (KET) for transmission tower inventory services. KET operates 15 television broadcast transmission towers across Kentucky and Indiana and requires a contractor to conduct comprehensive inventory surveys of these towers, with a minimum of three towers inspected per year until all 15 locations are completed. The inventory work includes proper identification of all antennas and transmission lines, including those currently marked as unknown, with detailed documentation of manufacturer, model, height, position, and condition. The RFP was released on September 29, 2022, with a closing date of October 26, 2022, at 3:30 PM ET. Vendors were required to contact the Commonwealth Buyer by October 7, 2022, at 10 AM ET to schedule site visits for requested locations. The initial contract term is one year from the effective date of award, with options to renew for five additional one-year periods upon mutual agreement of the parties. The first three towers identified for inspection are WKMA in Nortonville, Kentucky (950 feet), WKPD in Paducah, Kentucky (500 feet), and WKMU in Mayfield, Kentucky (599 feet), with the schedule for remaining towers to be negotiated between KET and the selected vendor.

Bidders must submit proposals in three separate parts: technical proposal, cost proposal, and proprietary information. The technical proposal evaluation is worth a maximum of 1,200 points, covering executive summary, company background, employee qualifications, timeline with milestones, and project management plan including sample reports. The cost proposal is worth a maximum of 800 points, with vendors submitting individual costs for each of the 15 tower inspections using the provided Cost Proposal Form. The Commonwealth is tax-exempt and vendors should not include Federal Excise Tax or Kentucky Sales or Use Tax in proposed costs. Proposals are evaluated based on a total of 2,200 possible points, which may include oral presentations or demonstrations worth up to 200 additional points at the Commonwealth's discretion. The contractor must maintain Commercial Liability Insurance with a $2,000,000 General Aggregate limit, automobile liability insurance with $1,000,000 per occurrence combined single limit, and Workers Compensation with Kentucky statutory limits plus $1,000,000 employer's liability per accident. The contractor is responsible for all OSHA compliance, RF safety monitoring, and must ensure all tower climbers hold current safety certifications, first aid/CPR training, and RF radiation hazard safety training. Work must be completed within 14 working days per tower, coordinated 24-48 hours in advance with KET personnel, and performed during daylight hours only.

The Contractor also recognizes that any books, documents, papers, records, or other evidence, received during a financial audit or program review shall be subject to the Kentucky Open Records Act, KRS 61.870 to 61.884. Records and other prequalification information confidentially disclosed as part of the bid process shall not be deemed as directly pertinent to the agreement and shall be exempt from disclosure as provided in KRS 61.878(1)(c).

40.27 Prohibitions of Certain Conflicts of Interest

In accordance with KRS 45A.340, the contractor represents and warrants, and the Commonwealth relies upon such representation and warranty, that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of its services. The contractor

Document Description Page 18 further represents and warrants that in the performance of the contract, no person, including any subcontractor, having any such interest shall be employed.

In accordance with KRS 45A.340 and KRS 11A.040 (4), the contractor agrees that it shall not knowingly allow any official or employee of the Commonwealth who exercises any function or responsibility in the review or approval of the undertaking or carrying out of this contract to voluntarily acquire any ownership interest, direct or indirect, in the contract prior to the completion of the contract.

40.28 No Contingent Fees

No person or selling agency shall be employed or retained or given anything of monetary value to solicit or secure this contract, excepting bona fide employees of the offeror or bona fide established commercial or selling agencies maintained by the offeror for the purpose of securing business. For breach or violation of this provision, the Commonwealth shall have the right to reject the proposal or cancel the contract without liability.

40.29 Vendor Response and Proprietary Information

The RFP specifies the format, required information, and general content of proposals submitted in response to the RFP. The Finance and Administration Cabinet will not disclose any portions of the proposals prior to Contract Award to anyone outside the Finance and Administration Cabinet, representatives of the agency for whose benefit the contract is proposed, representatives of the Federal Government, if required, and the members of the evaluation committees. After a contract is awarded in whole or in part, the Commonwealth shall have the right to duplicate, use, or disclose all proposal data submitted by vendors in response to this RFP as a matter of public record. Although the Commonwealth recognizes the vendor's possible interest in preserving selected data which may be part of a proposal, the Commonwealth must treat such information as provided by the Kentucky Open Records Act, KRS 61.870 et sequitur.

Informational areas which normally might be considered proprietary shall be limited to individual personnel data, customer references, selected financial data, formulae, and financial audits which, if disclosed, would permit an unfair advantage to competitors. If a proposal contains information in these areas that a vendor declares proprietary in nature and not available for public disclosure, the vendor shall declare in the Transmittal Letter [see Section 60.6 (A)] the inclusion of proprietary information and shall noticeably label as proprietary each file containing such information. Proprietary information shall be submitted separately and identified as “Proprietary Data”. Proposals containing information declared by the vendor to be proprietary, either in whole or in part, outside the areas listed above may be deemed non-responsive to the RFP and may be rejected.

KRS 45A.245.

40.32 Discrimination

Discrimination (because of race, religion, color, national origin, sex, sexual orientation, gender identity, age, or disability) is prohibited. This section applies only to contracts utilizing federal funds, in whole or in part. During the performance of this contract, the contractor agrees as follows:

1. The contractor will not discriminate against any employee or applicant for employment because of race, religion, color, national origin, sex, sexual orientation, gender identity, or age. The contractor further agrees to comply with the provisions of the Americans with Disabilities Act (ADA), Public Law 101-336, and applicable federal regulations relating thereto prohibiting discrimination against otherwise qualified disabled individuals under any program or activity. The contractor agrees to provide, upon request, needed reasonable accommodations. The contractor will take affirmative action to ensure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, national origin, sex, sexual orientation, gender identity, age or disability. Such action shall include, but not be limited to the following; employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensations; and selection for training, including apprenticeship. The contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this non-discrimination clause.

2. The contractor will, in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that all qualified applicants will receive consideration for employment without regard to race, religion, color, national origin, sex, sexual orientation, gender identity, age or disability.

3. The contractor will send to each labor union or representative of workers with which he has a collective bargaining agreement or other contract or understanding, a notice advising the said labor union or workers' representative of the contractor's commitments under this section, and shall post copies of the notice in conspicuous places available to employees and applicants for employment. The contractor will take such action with respect to any subcontract or

Document Description Page 20 purchase order as the administering agency may direct as a means of enforcing such provisions, including sanctions for noncompliance.

4. The contractor will comply with all provisions of Executive Order No. 11246 of September 24, 1965 as amended, and of the rules, regulations and relevant orders of the Secretary of Labor.

5. The contractor will furnish all information and reports required by Executive Order No. 11246 of September 24, 1965, as amended, and by the rules, regulations and orders of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records and accounts by the administering agency and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations and orders.

6. In the event of the contractor's noncompliance with the nondiscrimination clauses of this contract or with any of the said rules, regulations or orders, this contract may be cancelled, terminated or suspended in whole or in part and the contractor may be declared ineligible for further government contracts or federally-assisted construction contracts in accordance with procedures authorized in Executive Order No. 11246 of September 24, 1965, as amended, and such other sanctions may be imposed and remedies invoked as provided in or as otherwise provided by law.

7. The contractor will include the provisions of paragraphs (1) through

(7) of section 202 of Executive Order 11246 in every subcontract or purchase order unless exempted by rules, regulations or orders of the Secretary of Labor, issued pursuant to section 204 of Executive Order No. 11246 of September 24, 1965, as amended, so that such provisions will be binding upon each subcontractor or vendor. The contractor will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions including sanctions for noncompliance;

provided, however, that in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the agency, the contractor may request the United States to enter into such litigation to protect the interests of the United States.

40.33 Vendor Notification – Ineligible for Award

The Commonwealth will not consider or evaluate any proposal submitted by a vendor when the vendor, the vendor’s employees or agents, had any involvement, contribution or participation in the development, preparation or review of this RFP prior to its issuance. The vendors proposal will be deemed ineligible for award.

40.34 Past Vendor Performance

Document Description Page 21

Past vendor performance may be considered in the award of this Contract. Vendors with a record of poor performance in the last twelve (12) months may be found non-responsible and ineligible for award.

40.35 Exception to Required Use of Contract

The establishment of this Master Agreement is not intended to preclude the use of similar products when requested by the agency. The Commonwealth of Kentucky reserves the right to contract for large requirements by using a separate solicitation.

SECTION 50 – SCOPE OF WORK

50.1 Agencies to Be Served

This contract shall be for use by Kentucky Educational Television (KET.) No shipments shall be made except upon receipt by vendor of an official delivery order from the using agency.

Extending the Contract Use to Other Agencies The Office of Procurement Services reserves the right, with the consent of the vendor, to offer the Master Agreement resulting from this solicitation to other state agencies requiring the product(s) or service(s).

50.2 Term of Contract and Renewal Options

The initial term of the contract shall be for a period of 1 year from the effective date of the Award of Contract.

This contract may be renewed at the completion of the initial contract period for 5 additional one year periods upon the mutual agreement of the Parties. Such mutual agreement shall take the form of a contract modification as described in Section 40.8 of this RFP.

At the end of the contract, the vendor shall provide all agency data in a form that can be converted to any subsequent system of the agency’s choice. The vendor shall cooperate to this end with the vendor of the agency’s choice, in a timely and efficient manner.

The Commonwealth reserves the right not to exercise any or all renewal options.

The Commonwealth reserves the right to extend the contract for a period less than the length of the above-referenced renewal period if such an extension is determined by the Commonwealth Buyer to be in the best interest of the Commonwealth.

Document Description Page 22

The Commonwealth reserves the right to renegotiate any terms and/or conditions as may be necessary to meet requirements for the extended period. In the event proposed revisions cannot be agreed upon, either party shall have the right to withdraw without prejudice from either exercising the option or continuing the contract in an extended period.

50.3 Basis of Price Revisions

PRICE ADJUSTMENTS: Unless otherwise specified, the prices established by the contract resulting from this solicitation shall remain firm for the contract period.

50.4 Notices

After the award of contract, all programmatic communications with regard to day-to-day performance under the contract are to be made to the agency technical contact(s) identified during the negotiation phase of this procurement. After the award of contract, all communications of a contractual or legal nature are to be made to the Commonwealth Buyer.

50.5 Subcontractors

The contractor is permitted to make subcontract(s) with any other party for furnishing any of the work or services herein. The contractor shall be solely responsible for performance of the entire contract whether or not subcontractors are used. The Commonwealth shall not be involved in the relationship between the prime contractor and the subcontractor. Any issues that arise as a result of this relationship shall be resolved by the prime contractor. All references to the contractor shall be construed to encompass both the contractor and any subcontractors of the contractor.

50.6 Scope of Work/Technical Requirements

Bidders are encouraged to inspect the towers to familiarize themselves thoroughly regarding the condition of the tower and the site before submitting a bid. Failure to evaluate the existing conditions of the sites or the towers will not be considered a legitimate reason to modify the contract.

All work shall be performed during daylight hours. Work hours must be coordinated at least 24 hours in advance with the KET Tower Coordinator.

A project schedule shall be submitted prior to commencing work on the project to the KET Tower Coordinator.

Work to be performed at the site must allow for personnel scheduling and coordination with tower tenants. A representative of KET must be on the work site while tower inspection is being performed. All work must begin on time as scheduled. The KET site representative must be notified immediately of any delays to the work schedule.

Document Description Page 23

A lockable fence surrounds the transmitter site and is secure. The contractor may, at his own risk, store equipment on site but not in the transmitter building.

Once inspections begin the tower work must be completed within 14 working days.

KET does realize that weather delays can occur, and the completion date will be adjusted accordingly.

Some site locations are difficult to access, and four-wheel drive vehicles are recommended.

PROTECTION

All work shall comply with applicable rules of KET and OSHA. All phases of the work, whether specifically mentioned or not, shall be executed in strict compliance with all local, state, or national regulations and codes. All OSHA codes (including but not limited too) that are applicable shall apply and are located below:

OSHA Regulations for tower climbing:

Construction Industry (29 CFR 1926) 1926 Subpart M - Fall protection [related topic page]

1926.501 - Duty to have fall protection

1926.502 - Fall protection systems criteria and practices

1926.503 - Training requirements 1926 Subpart E - Personal Protective and Life Saving Equipment [related topic page]

No items or materials will be thrown from the tower to any height or to ground level.

Any climber, while ascending or descending any KET tower, must be attached to the safety climb cable by an OSHA certified safety device. The contractor will provide this device. Each tower climber shall provide proof of a current tower climbing safety certification, first aid/CPR training verifications and RF radiation hazard safety training certificates.

KET utilizes UHF transmitting antennas and areas identified as having signal levels in excess of ANSI radiation standards. Tower climbers must wear a RF monitoring device while climbing on the tower. All climbers must read and agree in writing (sign and date) to adhere to KET’s tower site RF safety procedures prior to ascending

Document Description Page 24 the tower. The contractor is responsible to provide the proper RF monitoring device for all approved parties.

The contractor is fully liable for any resulting damage to the tower, devices installed on the tower or Commonwealth property while performing the requested services or on site.

KET STANDARDS

A designee from the Transmission Systems Division of KET will provide on-site coordination for the crew climb for the tower inspection. At least a twenty-four (24)-hour notice is required to allow for the scheduling of KET personnel.

KET will provide contact information. No tower work shall occur on official state holidays, during periods when KET fund raising is occurring or during periods of fund raising by a KET client. The successful bidder shall supply KET with a single point of contact person for coordination of the work and any issues that arise.

EXPERIENCE STANDARDS

The tower crew shall have a minimum of 5 years of experience in the business of working on transmission towers or projects of a similar nature. Tower climbers will be required to have climbing safety certifications from an approved climbing school. Certifications must also be provided to include high angle rescue, first aid/CPR and RF safety training. A safety-climb certified rescue climber must be on site at all times during tower occupancy of the climbers performing the transmission line work. All documentation must be presented to KET in advance of the start of the project. Failure to produce documentation shall be grounds for termination by default of the contract.

All work shall be performed during daylight hours. Work hours must be coordinated at least 48 hours in advance with the KET Project Manager. Work to be performed at the site must allow for personnel scheduling and coordination with tower tenants. A KET field engineer must be on the work site while tower work is being performed. All work must begin on time as scheduled. The KET contact coordinator must be notified immediately of any delays to the work schedule. Last minute changes to the work schedule may not be approved by KET. KET has final authority over tower work schedules.

The on-site KET field engineer, after consultation with KET management, shall have the right to stop all work should a concern be raised regarding the safety of the crew, tower, building, equipment, or client equipment. The work cannot proceed until a resolution to the issue is complete.

QUALIFICATIONS

Each bidder should have a minimum of 5 years’ experience in the business of working on transmission towers or projects of a similar nature and should furnish five (5) project references, including contact information (name and telephone number). Tower climbers will be required to have climbing safety certifications from an approved climbing school. Certifications must also be provided to include high angle rescue, first aid/CPR and RF safety training. A safety-climb certified rescue climber must be always on-site during tower occupancy of the climbers performing the inventory work.

SCOPE OF INVENTORY WORK

The successful bidder will be given copies of past tower inventory records. Many of the listings within these records will be marked “unknown”. One purpose of this inventory is to investigate and identify these unknown listings. This will require an identification of each antenna and trace the attached transmission back to the point of origin. KET field personnel will assist in identifying origination points inside of the building (but will not assist with identifying anything on the tower). Every antenna and or transmission line must be identified. Listing as “unknown” is unacceptable, but a rare exception may be approved by KET’s Chief Technology Officer or his designee.

The method to be used to determine height above ground will be submitted before work begins and must be approved by KET.

Every antenna shall be listed as to…
