About this file
This is a Solicitation Modification document (Version 3) issued by the Commonwealth of Kentucky Department of Fish and Wildlife Resources (KDFWR) for Professional Forestry Consultant Services on the Dewey Lake Wildlife Management Area in northeastern Kentucky. The request seeks qualified forestry consultants to manage forest habitat through mid-story forest stand improvement practices, including hack and spray treatments using imazapyr and basal bark treatments using triclopyr. The project encompasses the implementation of medium to large-scale forest management on state and federally managed Wildlife Management Areas across 21 counties in the northeast region. Written questions were due by November 29, 2021, with proposals closing on December 17, 2021, at 1:00 PM Eastern Time. No on-site bidders' conference was held; however, vendors requesting site visits may coordinate with the technical point of contact using AVENZA maps to locate project areas. The initial contract term runs from January 1, 2022, through June 30, 2022, with the Commonwealth reserving the right to renew for one additional one-year period, subject to Secretary of Finance and Administration Cabinet approval and Legislative Research Commission Government Contract Review Committee review.
The cost proposal is limited to a maximum of $65,996 for treating mid-story tree species, with vendors bidding the number of acres they commit to treating within this budget. Vendors have two years from implementation to complete the contracted acreage. Evaluation will be based on qualifications and experience (300 points), cost proposal (200 points), and potential oral presentations/demonstrations (25 points). Mandatory requirements include current Kentucky Herbicide/Pesticide applicators license, equipment inventory documentation, ability to traverse steep terrain with equipment lists, and minimum three references from projects of at least 100 acres. Vendors must demonstrate previous professional projects with scoring based on acreage: projects of 1-100 acres receive 50 points, 100-500 acres receive 75 points, and projects exceeding 500 acres receive 100 points. No set-aside provisions or incumbent preferences are identified. Contract funding of $65,996 is authorized from KDFWR budget allocation, with all work subject to compliance with Kentucky procurement statutes and personal service contract standard terms and conditions. This procurement is not subject to federal funding requirements under this modification.

Item Qualifications of vendor to perform requested service.
The bidder with highest number acres receives the maximum score.
Addendum Two (2) December 6, 2021
Addendum to respond to vendor questions per Section 7.00, Questions Regarding this RFP. Addendum to update Section 17.00, Protest, to the latest version of the Personal Service Contract Standard Terms and Conditions Revised November 2021.
Vendor Question 1 Is it possible to set up a site showing with the technical point of contact for this project?
Treatment costs can vary immensely due to site conditions and I would like to request an opportunity to view the potential project areas. If a technical point of contact can be on site to facilitate locating the project areas and answering questions that may arise during the site visit I would greatly appreciate it.
Commonwealth Response:
KDFWR uses AVENZA maps, a PDF copy is provided as supporting documentation of this RFP. Once onsite the contractor can use the map to see the where the stands are located, and a real time point or dot will navigate them to the correct areas. They are outlined so the contractor will know they are inside the boundary units.
Vendor Question 2 Is the chemical mixture stated in Section 2 for hack and squirt treatments correct?
The mixture specified in the RFP does not appear to conform with label recommendations for Imazapyr with an active ingredient of 28%. The label states that either more hacks will be needed or a stronger mix will be needed. Additionally, I would recommend using the Imazapyr product with an active ingredient of 52.6%, rather than the 28% referenced in the RFP. This product will perform more reliably and ensure KDFWR gets the desired effects for the treatment.
Commonwealth Response:
We do want 52.6% active ingredient for the herbicide imazapyr. With the final solution by volume to be 22% when mixed with water.
Vendor Question 3 The RFP references two treatment types, is there an expectation about how much of each will be expected? Each of these treatment types involve different equipment with different techniques, resulting in different costs to perform the treatment. It will be necessary to have some idea of how much of each treatment KDFWR expects the contractor to perform. For reference, we typically treat stems as small as 1” DBH with hack and squirt methods and can avoid using basal bark treatments entirely. If that is acceptable by KDFWR it will result in a lower cost per acre, allowing more acres to be completed under this RFP.
Commonwealth Response:
Due to the time constraint on the project, we want contractors to have 2 options for treatment. With our experience hack and spray is not effective when trees are without leaves due to sap flow pushing out the herbicide. Parameters were chosen so that contractors would use basal bark when no leaves were present then hack and spray when leaves were present. If a contractor was willing to wait until leaf out on trees to start and complete the project that would be great, but it would leave them with about 2 months to complete.
Addendum One (1) November 12, 2021
Addendum to respond to changing Section 4.0 Schedule of RFP, Written Questions due by from 11/26/2021 to 11/29/2021.
Addendum to respond to changing Section 10.30, the term of the contract from 01/01/2021 through 06/30/2022 to 01/01/2022 through 06/30/2022.
Addendum to respond to remove the following language from KDFWR Cost Proposal form; “Consultants will have 2 years from implementation of this project to complete the acreage below”.

PERSONAL SERVICE CONTRACT
Tourism, Arts and Heritage Cabinet / Department of Fish and Wildlife Resources Professional Forestry Consultant Services
RFP 660 2200000124
This document constitutes a Request for Proposals for a Personal Service Contract from qualified individuals and organizations to furnish those services as described herein for the Commonwealth of Kentucky, Tourism, Arts and Heritage Cabinet / Department of Fish and Wildlife Resources.
Offerors are advised that any personal service contract resulting from this RFP must comply with all applicable provisions of KRS 45A and KRS 12.210 prior to becoming effective.
A contract, based on this RFP, may or may not be awarded. Any contract award from this RFP is invalid until properly approved and executed by the Finance and Administration Cabinet and filed with the Legislative Research Commission, Government Contract Review Committee.
1.00 Purpose and Background
The northeast region consists of 21 counties; within those counties Kentucky Department of Fish and Wildlife (KDFWR) staff manage over 64,898 acres of state owned and federal owned land. These Wildlife Management Areas, referred to as WMA’s, are scattered across the region and usually associated with flood control lakes that were built in the 1960’s and 1970’s. The department has long term lease agreements on managed federal property that allows for habitat management including forest management.
WMA’s in the northeast are mostly forested, in some cases 75-80% of the entire area is forested. These forests have been managed in many ways over time. These areas have been degraded over time with timber operations taking the best timber and leaving subordinate and stunted trees behind. This has created many problems with managing the forest including a lack of management since the land was procured in the 1960’s. This has led to a decrease in early successional forested habitat. Many wildlife species documented in decline need a myriad of habitat from early successional through maturity, and without those varying stages across the landscape populations and habitat can become stagnant.
With large acreage and limited staff, the most efficient process for managing these forests is to utilize consultants to conduct large scale habitat projects. Consultants allow staff to complete a scale of work not achievable with current staff levels. State agencies are bound more now than ever with obligations to paying merit employee retirement, the costs of which are rising hindering agency capacity to plan, implement and complete large-scale projects. Partners and consultants can focus efforts for large scale projects without interruption and are able to employ methods and staff not available currently.
2.00 Scope of Work
Kentucky Department of Fish and Wildlife Resources (KDFWR) is soliciting proposals to manage forest habitat on the Dewey Lake Wildlife Management Area in northeastern Kentucky. The bidder needs to have the capability to implement medium to large scale forest stand improvement practices through their organization and/or completion through a professional consulting company, these practices could include forest stand improvement practices.
Services include:
The vendor will be required to consult with KDFWR foresters and biologists during all phases of completing contracted work to ensure compliance with the terms of a long-term Wildlife Management Area agreement between KDFWR and the landowner – the U. S. Army Corps of Engineers (USACOE).
For this proposal, a professional consulting company will perform mid-story forest management under the following guidelines, Document Description Page 7
1. As directed by KDFWR, consultants will hack and spray trees using isopropylamine salt of imazapyr (ARSENAL) with an active ingredient of 28%. This product will be mixed with water as a 22% solution (1-gallon mixture will be 100 ounces of water, 28 ounces of product).
a. Trees will be hacked under the following guidelines, 1 hack per 3” DBH per tree.
b. When the situation of clusters or pockets of trees of the same species that spread through “sucker” roots, such as beech, only 30% of that cluster needs to be treated.
2. As directed by KDFWR, consultants will use a basal bark treatment with a 20% herbicide by volume mixture with the active ingredient of triclopyr, Garlon 4. This will be mixed with a commercial basal bark oil
a. Trees 6” in diameter or less will be completely ringed for this method.
b. The completed ring will be start at the bottom trunk of the tree and extend upward for 12”-15” of the stem or trunk of the tree.
3. For this contract mid-story will be defined as trees that are not part of the canopy, trees that are between 2”-10” DBH or trees considered cull or non-merchantable and are not species of oak or hickory. Soft mast trees such as serviceberry, viburnum, dogwood, wild plum, or hawthorn will not be hacked or harmed during this contract.
4. Obtain and keep a current Kentucky Herbicide/Pesticide license for working on land managed by a state agency. Classes 2N and 1A will cover forest land and open land areas, there are very few areas that could be labeled as open land but KDFWR nor USACOE are the enforcing agency for herbicide usage and storage, therefore, we cannot verify the definition for open land for forest land.
5. Restricted use herbicides cannot be used. Only the herbicides listed in item 1.
6. Provide updates monthly as to progress for approved project areas and practices. Attend a yearly meeting between KDFWR foresters, biologists and upper-level administration until the entirety of the contract is completed.
KDFWR reserves the right to conduct discussions/meetings with any offeror to determine their qualifications for further consideration. Discussions shall not disclose any information derived from bid proposal submitted by other offerors.
3.00 Evaluation Criteria
The Kentucky Department of Fish and Wildlife Resources will evaluate the proposals based on the following evaluation factors:
