About this file

This is a Request for Proposal (RFP) issued by the Commonwealth of Kentucky's Justice and Public Safety Cabinet on behalf of the Kentucky Law Enforcement Council (KLEC) and administered by the Department of Criminal Justice Training (DOCJT). The solicitation seeks a qualified laboratory to provide drug screening services for police officer, court security officer, and public safety dispatcher applicants whose employment offers are contingent upon passing a drug test. The contractor will receive split-screen urine specimens collected by KLEC staff at various locations throughout Kentucky and must conduct testing using gas chromatography/mass spectrometry (GC/MS) according to specified drug panel cutoff levels and federal workplace drug testing guidelines. The estimated annual volume is 1,500 to 1,700 specimens, with approximately 36 to 60 positive results annually. The RFP was released on February 28, 2024, with written questions due by March 6, 2024, and proposals due by March 26, 2024, at 2:00 PM EST. The initial contract term runs from July 1, 2024, through June 30, 2026, with the Commonwealth retaining the right to renew for up to two additional two-year periods pending Finance and Administration Cabinet approval and Legislative Research Commission filing.

The contractor must provide prepaid shipping materials and labels and assume responsibility for legal challenges related to testing results while maintaining chain of custody documentation for each specimen. Key mandatory requirements include SAMHSA certification, ISO/IEC 17025 accreditation and/or American Board of Forensic Toxicology (ABFT) accreditation, and employment of a full-time, board-certified toxicologist. The contractor must provide HIPAA-compliant web-based access to results within 48 hours for negative tests and seven calendar days for positive tests and may offer optional Medical Review Officer (MRO) services for positive result confirmation at an additional fee. The proposal evaluation is based on technical criteria (600 points), cost proposal (300 points), and oral presentations if required (200 points), for a maximum of 1,100 points. No minimum volume is guaranteed, and services are provided on an as-needed basis. The RFP prohibits collection services, rapid testing, and outsourcing of testing to third parties without written authorization. Vendors must be registered with the Kentucky Secretary of State and comply with all applicable federal and state laws, including those governing conflict of interest, campaign finance, and nondiscrimination.

Question

Vendor Written Questions:

Commonwealth Response to Vendor Questions:

As indicated under VOLUME on page 6, are all 1500-1700 split specimens being sent into the lab for testing? Or are only the “presumptive positives” being sent in, estimating about 36-60 annually? If only positives are being sent in, is KLEC looking for “instant/ rapid” split specimens cups then to detect negatives then and there, and only ship off positives?

Each applicant provides a sample that requires lab testing, resulting in an annual volume of 1,500

- 1,700 labs needing tested. KLEC does not use rapid testing.

Our firm offers MRO (Medical Review Officer) review services, where positive specimens from the lab are sent to this medically certified doctor to review the results, and reach out to the donor to confirm if the lab findings are from a valid prescription. Is this acceptable to include with our quote?

On the attached Cost Proposal Form, a line item exists for Bidders to provide a fee, if any for the purpose of confirming positive test results.

Please see "Fee Per Positive Result Confirmation Processing".

On page 7, under SUPPLIES, since the RFP is requesting shipping materials & labels, I presume that KLEC trained staff are performing these urine collections, correct?

KLEC currently performs the collection services, and will continue to do so. No collection services are being requested within this RFP.

Please confirm if collections services are included in this

RFP.

Document Description Page 4

2400000189 Laboratory Drug Screening, KLEC

If collection services are requested, can line items be added to the Cost Proposal Form to include fees for collections services?

Are Medical Review Officer (MRO) services needed under this solicitation?

On the attached Cost Proposal Form, a line item exists for Bidders to provide a fee, if any for the purpose of confirming positive test results.

Please see "Fee Per Positive Result Confirmation Processing".

Are random drug testing services needed under this solicitation?

No.

Please confirm the document captioned “Personal Service Contract Standard Terms and Conditions” is applicable to the services under this solicitation.

Confirmed, yes.

Scope of Work (2.00), section 7(b) states: “Contractor shall have and maintain ISO:IEC 17025 accreditation and/or American Board of Forensic Toxicology (ABFT) accreditation.”

ABFT accreditation refers to an individual, rather than a laboratory, so can you confirm that this applies to the toxicologist referenced in part 7(c)?

Correct.
