About this file

This is a Request for Bids (RFB) document issued by the Kentucky Department of Fish and Wildlife Resources (KDFWR) for the procurement of embroidered patches for conservation education programs and camp operations. The solicitation seeks bids for 25 line items encompassing various patch designs, including educational patches (Archery, Gun Safety, Naturalist, Outdoor Survival, Boating, Casting, and Swimming), specialized patches (Outdoorswoman, Outdoorsman), camper achievement patches (2nd Year, 3rd Year), a Venture patch, camp-specific chevron patches (Camp Earl Wallace, Camp John Currie, Camp Robert Webb), and KDFWR branded patches in three sizes. Quantities range from 100 to 5,000 patches per line item, with most patches measuring 3 inches in diameter and featuring two to six thread colors in embroidered designs. The RFB was released on December 21, 2022, with written questions due by December 29, 2022, and bids due by 12:00 p.m. Eastern Time on January 19, 2023. The anticipated contract award date is January 26, 2023, with contract execution expected by February 16, 2023. The initial contract term is one year, with the option to renew for four additional one-year periods, subject to written approval from both the contractor and KDFWR, with potential renegotiation of terms for extended periods.

Bidders must submit pricing as a price per patch for each line item, with all costs including artwork, setup fees, packaging, handling, and shipping included in the unit price. The KDFWR intends to award the contract to the lowest responsive, responsible bidder, with scoring based 90 percent on total cost and 10 percent on guaranteed delivery date (no later than 60 days from a delivery order). Previous award pricing ranged from $0.18 to $1.08 per patch depending on design complexity and order quantity. All patches must meet strict quality specifications including twill background fabric (minimum 50 percent polyester), machine embroidery with rayon yarn, overlock borders, and plastic film backing bonded with heat and pressure. Patches will be shipped to three designated camp locations or directly to KDFWR as specified on individual orders. Electronic bid submission is mandatory, with paper bids deemed non-responsive. Bidders must be registered in the Commonwealth eProcurement System and must bid all 25 line items; failure to do so will render the bid non-responsive. The KDFWR reserves the right to reject any or all bids and to waive minor irregularities based on its best interest.

*****RFB EVALUATION******

BID/PROPOSAL EVALUATION

Document Description Page 26 http://www.lrc.ky.gov/KRS/014A09/030.PDF https://secure.kentucky.gov/sos/ftbr/welcome.aspx

The KDFWR shall conduct a comprehensive, fair, and impartial evaluation of all bids. The KDFWR may reject any bid that is incomplete or in which there are significant inconsistencies or inaccuracies. The KDFWR reserves the right to reject all bids.

Each bidder is responsible for submitting all relevant, factual and correct information with their bid.

Past bidder performance may be considered in the award of this Contract. Bidders with a record of poor performance may be found non-responsible and ineligible for award.

RESPONSIBILITY OF THE BIDDER

The KDFWR may, at any time, make a supplemental investigation of the responsibility of any bidder. This may include investigation of the bidder’s financial responsibility, capacity to produce or source of supply, performance record in the business or industry, compliance with state health rules and regulations, and any other matter related to the bidder’s probable ability to deliver in the quantity and at the time required by a contract.

If the KDFWR concludes on the basis of all available evidence that a particular bidder does not appear sufficiently responsible to assure adequate performance, the bidder’s response may be rejected.

Past Vendor Performance may be considered in the award of this Contract. Bidders with a record of poor performance in the last 12 months may be found not responsible and ineligible for award.

******AWARD OF CONTRACT*****

METHOD OF AWARD

The KDFWR intends to award the contract to the lowest responsive, responsible bidder.

However, the KDFWR reserves the right to reject any or all bids in whole or in part and to waive informalities and minor irregularities in bids received based on the best interest of the KDFWR.

The KDFWR intends to award the contract to the highest scoring responsive and responsible offeror. However, the KDFWR reserves the right to reject any or all proposals in whole or in part and to waive informalities and minor irregularities in proposals received based on the best interest of the KDFWR.

After determining that a bid includes all required information and data, the KDFWR will score the bid in the following manner:

Bid Scoring Criteria Points Possible

Total Cost for Patches

Guaranteed Delivery Date, no later than ________________

Total Points Possible

Document Description Page 27

On the evaluation line for the Bid Form, the offer with the lowest price per line item receives the maximum score 3.6 points adding up to 90 points. The offer with the next lowest price per line item receives points by dividing the lowest total cost by the next lowest total cost and multiplying that percentage by the available points. For example, 90 points is allocated to the lowest price criteria for this procurement, bidder “A” bids $3.00 as the lowest bidder and receives the maximum 90 points ($3.00 / $3.00 = 1.00 x 90 = 90). Assume bidder “B” is the next lowest bidder at $4.00, then “B” receives 67.5 points ($3.00 / $4.00) = .75 x 90 = 67.5).

The bidder shall clearly state the delivery time for this procurement.

COLLUSIVE BIDS

If it is determined in writing by the KDFWR that there are reasonable grounds to believe that bidders have agreed to restrain competitive bidding by establishing a fixed price on commodities or equipment sought to be purchased by the KDFWR, or by any other means, the bids of all such bidders shall be rejected, and the bidders barred from further bidding for a period of time considered appropriate.

a. If collusion is suspected among any bidders, a written notice of the facts giving rise to such suspicion shall be transmitted to the Attorney General.

b. All documents involved in any procurement in which collusion is suspected shall be retained by the KDFWR until the Attorney General gives notice that they may be released and shall be made available to the Attorney General or designee upon request.

REJECTION OF ALL BID RESPONSES

If it is in the KDFWR’s best interest, as determined in writing by the Commissioner of the Kentucky Department of Fish and Wildlife Resources, an RFB may be cancelled and an RFB reissued containing the same or revised specifications, terms and conditions. If time does not permit or if an emergency exists, the KDFWR may purchase the items or nonprofessional services on a negotiated basis. The rejection of all bids and selection of the negotiated method of purchase shall be fully documented in the bid file.

AGREEMENT BETWEEN PARTIES

By submitting a bid, the bidder acknowledges and agrees to be bound by the terms and conditions of the RFB.

The KDFWR shall not be required to enter into or sign further agreements, company orders or other documents to complete the Agreement.
