Modification # 1 for RFB 660 2300000339 Vendor Questions and Answers December 21, 2022
QUESTION 1
Could you please advise us if we are, as a Canadian company, able to participate in this bid process? Or if there are any forms to fill up for it, could you please forward them to us?
ANSWER 1
All vendors must be registered with the KY Secretary of State to transact business in the Commonwealth of Kentucky, regardless of whether they are a foreign or domestic company.
Information on how to register with the KY Secretary of State can be found under the “DEVELOPMENT OF THE BID” section of the RFB.
QUESTION 2
The bid document requested a max decking spacing of 3/16". Our Timberstrong fasteners deliver a 1/4" spacing. Will this be acceptable?
ANSWER 2
Yes
QUESTION 3
Please confirm you are looking for a 16-18" freeboard under dead load.
ANSWER 3
Yes
QUESTION 4
Our aluminum dock frames are manufactured in slightly different sizes than what was specified in the RFB document. Would it be acceptable for us to provide (2) 6ft x 20ft docks and (1) 6ft x 25ft dock?
ANSWER 4
No. The 25’ width is too tight to comfortably accommodate two boats using slip at the same time. We wish to have pricing for the designed dimensions in the advertised plan.

BID EVALUATION
Document Description Page 19 https://secure.kentucky.gov/sos/ftbr/welcome.aspx
The KDFWR shall conduct a comprehensive, fair, and impartial evaluation of all bids. The KDFWR may reject any bid that is incomplete or in which there are significant inconsistencies or inaccuracies. The KDFWR reserves the right to reject all bids.
Each bidder is responsible for submitting all relevant, factual and correct information with their bid.
Past bidder performance may be considered in the award of this Contract. Bidders with a record of poor performance may be found non-responsible and ineligible for award.
RESPONSIBILITY OF THE BIDDER
The KDFWR may, at any time, make a supplemental investigation of the responsibility of any bidder. This may include investigation of the bidder’s financial responsibility, capacity to produce or source of supply, performance record in the business or industry, compliance with state health rules and regulations, and any other matter related to the bidder’s probable ability to deliver in the quantity and at the time required by a contract.
If the KDFWR concludes on the basis of all available evidence that a particular bidder does not appear sufficiently responsible to assure adequate performance, the bidder’s response may be rejected.
Past Vendor Performance may be considered in the award of this Contract. Vendors with a record of poor performance in the last 12 months may be found not responsible and ineligible for award.
******AWARD OF CONTRACT*****
METHOD OF AWARD
The KDFWR intends to award the contract to the lowest responsive, responsible bidder.
However, the KDFWR reserves the right to reject any or all bids in whole or in part and to waive informalities and minor irregularities in bids received based on the best interest of the KDFWR.
After determining that a bid includes all required information and data, the KDFWR will score the bid in the following manner:
Bid Scoring Criteria Points Possible
Total Cost for Courtesy Dock $_______________
Guaranteed Delivery Date, no later than _________________
Total Points Possible
*Note: Bidder must be able to guarantee a Delivery Date of August 1, 2023.
On the evaluation line for the Bid Form, the offer with the lowest total cost receives the maximum score. The offer with the next lowest total cost receives points by dividing the lowest total cost by the next lowest total cost and multiplying that percentage by the available points.
