The solicitation seeks bids for 28 Automated Flagger Assistance Devices (AFADs), which are towable, trailer-mounted traffic control systems designed to replace or supplement human flaggers in temporary, single-lane, two-way work zones. The AFAD units must meet specifications including compliance with the Manual for Uniform Traffic Control Devices (MUTCD) 2023 and FCC Part 15 Class requirements, with features such as mechanical gate arms, mast-mounted dual red and yellow signal lights, wireless and wired controllers, and integrated cameras with video recording capability. The solicitation was initially issued on 11/10/2025, with Addendum #1 addressing vendor questions regarding specification development. The bid closing date is 11/18/2025 at 13:30 Eastern Time, with a tentative award date of 11/30/2025. Only electronic bids submitted through the Kentucky Vendor Self Service eProcurement system will be accepted. The resulting Master Agreement will commence upon award and expire on 11/30/2026, with an option for four additional one-year renewal periods. Delivery is required to the KYTC Division of Equipment - Receiving Shop in Frankfort, Kentucky.
Pricing will be evaluated on a "best value" basis, with the lowest bid receiving the maximum 90 points allocated to price and delivery time receiving 10 points, for a total of 100 points. The Commonwealth intends to award multiple contracts to vendors offering the most advantageous proposals. Vendors must submit all required documentation including certification of authority, non-collusion certification, Buy America/Build America Buy America Act (BABA) compliance certification, and equipment specification literature. Federal Highway Administration funds will be used for payment, and all steel, iron, and construction materials must comply with BABA requirements, with manufacturing and final assembly occurring in the United States. The vendor must guarantee delivery within a specified number of calendar days after receipt of delivery order, with one percent daily deductions from invoices for late delivery. BABA permits FHWA participation in the Contract only if all “construction materials” as defined in the Act are made in the United States. The Buy America preference applies to the following construction materials incorporated into infrastructure projects: non-ferrous metals; plastic and polymer-based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables); glass (including optic glass); Fiber optic cable; optical fiber; lumber; engineered wood; and drywall. Contractor will be required to use construction materials produced in the United States on this Project. The Contractor shall submit a certification stating that all construction materials are certified to be BABA compliant.

# October 1, 2025: The final assembly requirement will become effective for Federal-aid projects obligated on or after October 1, 2025. This means that, for manufactured product to be Buy America compliant, for Federal-aid projects obligated on or after October 1, 2025, final assembly of the manufactured product must occur in the United States.
# October 1, 2026: The 55 percent requirement will become effective for Federal-aid projects obligated on or after October 1, 2026. This means that, for manufactured product to be Buy America-compliant, for Federal-aid projects obligated on or after October 1, 2026, all manufactured products permanently
Document Phase Document Description Page 10 incorporated into the project must both be manufactured in the United States (satisfy the final assembly requirement) and have the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States be greater than 55 percent of the total cost of all components of the manufactured product (satisfy the 55 percent requirement).
