About this file

This is a Request for Bid (RFB) Modification issued by the Kentucky Transportation Cabinet (KYTC) Division of Purchases for hydraulic fluid and motor oil products to support the Division of Equipment's fleet maintenance operations. The solicitation seeks bids for thirteen line items encompassing various grades and sizes of motor oils, hydraulic fluids, grease, and specialty lubricants, including bulk tanks (15W-40 motor oil and synthetic diesel oil for the C-1 Garage), 55-gallon barrels and 5-gallon pails of recycled hydraulic fluid, ALS Advantage Green HD motor oil in 55-gallon containers, Mystik JT-6 grease in carton quantities, Dexos 1 approved 5W-30 motor oil in quart and gallon cases, and recycled 15W-40 motor oil in quart and gallon cases. The original solicitation was modified on November 7, 2022, to delete line items 10 and 11 and extend the bid closing date. Bids are due electronically by November 15, 2022, at 1:30 p.m. Eastern Time through the Kentucky eProcurement system. The tentative award date is November 18, 2022. The resulting contract will be a Master Agreement beginning upon award and expiring October 31, 2023, with an option for four additional one-year renewal periods at the discretion of both parties. The contract will serve the KYTC Division of Equipment and Districts 1-12 throughout Kentucky, with products to be shipped to various locations identified in attached district maps.

Pricing shall be submitted on a unit basis (per gallon, per case, or per carton depending on the line item) with F.O.B. Destination Freight Prepaid terms. Contract prices are firm for the initial twelve-month period with no price increases permitted during that time; thereafter, only one price increase is allowed during the remainder of the initial contract term, subject to written justification and thirty days' notice. Price decreases reflecting industry-wide reductions must be passed to the Commonwealth promptly. Award will be based on best value using a ranking approach with 95 points allocated to price (lowest bidder receives maximum points with subsequent bidders scored proportionally) and 5 points for delivery time, for a total of 100 points. Kentucky resident bidders receive reciprocal preference, and qualified bidders including Kentucky Correctional Industries receive additional scoring preferences. Vendors must register in the Commonwealth's Vendor Self Service System before submitting bids, with registrations taking 24-48 hours to process. The awarded vendor must provide automatic email notifications of shipments or delays, capability to expedite emergency shipments within 24 hours, and delivery performance subject to a one percent per day deduction from invoices for each day of late delivery beyond the contracted delivery date.

The contractor agrees to provide, upon request, needed reasonable accommodations. The contractor will take affirmative action to ensure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, national origin, sex, sexual orientation, gender identity, age or disability. Such action shall include, but not be limited to the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensations; and selection for training, including apprenticeship. The contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this non-discrimination clause.

2. The contractor will, in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that all qualified applicants will receive consideration for employment without regard to race, religion, color, national origin, sex, sexual orientation, gender identity, age or disability.

3. The contractor will send to each labor union or representative of workers with which he has a collective bargaining agreement or other contract or understanding, a notice advising the said labor union or workers' representative of the contractor's commitments under this section, and shall post copies of the notice in conspicuous places available to employees and applicants for employment. The contractor will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions, including sanctions for noncompliance.

6. In the event of the contractor's noncompliance with the nondiscrimination clauses of this contract or with any of the said rules, regulations or orders, this contract may be cancelled, terminated or suspended in whole or in part and the contractor may be declared ineligible for further government contracts or federally-assisted construction contracts in accordance with procedures authorized in Executive Order No. 11246 of September 24, 1965, as amended, and such other sanctions may be imposed and remedies invoked as provided in or as otherwise provided by law.

The contractor will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions including sanctions for noncompliance;

provided, however, that in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the agency, the contractor may request the United States to enter into such litigation to protect the interests of the United States.
