About this file
This is a Request for Bid (RFB) issued by the Commonwealth of Kentucky Transportation Cabinet Division of Purchases for the procurement of hard hats in three specifications: 100 units of hi-visibility lime green flat front hard hats, 50 units of white flat front hard hats, and 300 units of hi-visibility lime green full brim hard hats. All hard hats must be custom imprinted with the Kentucky Transportation Cabinet logo on the front center, meet OSHA and ANSI Z89.1-2009 TYPE 1, CLASS E and G requirements, feature lightweight polyethylene shells, 4-point ratchet suspension systems with pillowed brow pads, and include silver reflective striping. Product samples are required for approval prior to award. The RFB was released August 24, 2020, with written questions due August 27, 2020, and the original closing date of September 8, 2020, extended to September 11, 2020 at 4:00 PM Eastern Time via Addendum #1. The contract will be awarded as a master agreement for the initial period of one calendar year from the date of award, with optional renewal for four additional one-year periods at the discretion of both parties. No public bid opening is scheduled due to COVID-19 precautions, with bid tabulation results to be provided by email upon request. Bids must be submitted electronically only through the eMARS procurement system; no physical submissions via UPS, FedEx, postal service, email, or hand delivery will be accepted.
The Commonwealth will award the contract using a best value approach with scoring of 95 points for price and 5 points for delivery time, with the lowest bidder receiving maximum points. Vendors must provide unit bid prices for all three line items and guaranteed delivery days in calendar format. All prices are quoted on an F.O.B. Destination Freight Prepaid basis, with vendors responsible for all shipping and freight charges. The contract is subject to Federal Highway Administration (FHWA) 1273 requirements and Buy America provisions but excludes prevailing wage (Davis-Bacon) rates as this is a commodity contract. The Commonwealth reserves the right to extend the contract to other state agencies and political subdivisions with vendor consent. Kentucky resident bidders may receive reciprocal preference against nonresident bidders registered in states that offer similar preferences, and qualified bidders including Kentucky Correctional Industries and organizations serving individuals with severe disabilities may receive preference points. All bids must be valid for a minimum of 90 calendar days after closing, and vendors must comply with all required affidavits, including annual compliance affidavits and, if applicable, resident bidder status affidavits. Delivery delays will result in a 1 percent per day deduction from invoices for each day delivery is missed, except for delays caused by circumstances beyond the vendor's control.

In the event of any conflicts between the specifications, terms and conditions indicated by the Commonwealth and those indicated by the contractor, those of the Commonwealth take precedence. The contract supersedes all bids or other prior agreements, oral or written, and all other communications between the parties relating to this subject.
3.09 – Specifications
This solicitation specifies requested items. It is not the intention of this solicitation to eliminate vendors or manufacturers of similar or equal equipment of the types specified. 3.10 – Exceptions to Specifications
Vendors are cautioned that changes made to the solicitation other than in the designated fields for response shall render the response invalid and result in a non-responsive bid. Otherwise, it will be considered that items offered are in strict compliance with these specifications, and the successful bidder shall be held responsible for delivering materials that meet these specifications. Any exceptions shall be marked as such within the body of the bid and explained on a separate page. The Commonwealth is not bound to accept any exceptions.
3.11 – Alternate Brands/Specifications
Unless otherwise specified, brands and specifications referenced in this solicitation are meant to establish a minimum standard of quality only. Bids offering “equal” products/specifications will be considered for award if such products are clearly identified in the bid and are determined by the State to meet or exceed fully the minimum essential specifications and salient characteristics referenced in the Solicitation. Bids that contain products/specifications that fail to meet the minimum essential requirements shall be deemed non-responsive.
Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. Failure to enclose sufficient literature may result in a non-responsive bid. If the brands are not changed, the contract will be written accordingly and the successful bidder shall be required to deliver the brands/specifications stated in the solicitation.
3.12 - Equipment
Unless otherwise indicated in the bid, it is understood and agreed that any item offered or shipped on this bid shall be new and the latest or current model year and be in first class condition.
