services, pending the Small Business Administration (SBA) size protest decision in accordance with (IAW) FAR 19.302.

The Contracting Officer submitted a copy of the protest and a referral letter to the SBA on 4 June 2021.

6. Efforts to Obtain Competition: Efforts to solicit offers is not practicable and the exception at FAR 5.202(a)(2) applies under the conditions described at FAR 6.302-2.

Due to the urgency of this requirement, it would not be practical or in the best interest of the Government to allow 30 days for receipt of proposals as in accordance with FAR 5.203(b).

7. Actions to Increase Competition: This is an emergency acquisition.

8. Market Research: No market research was completed; however, to determine a fair and reasonable price the market research and competition from W91151-21-D-0006 was utilized in support of this urgent and compelling requirement. That market research stated that there were two or more small business entities interested in the requirement, including the awardee and the protestor. The awardee for this unusual and a compelling urgency is the incumbent contract under W91151-16-D-0102, and awardee of W91151- 21-D-0006 and was selected for the purpose of continuity of services.

9. Interested Sources: There are no interested sources this is an emergency acquisition.

10. Other Facts:

a. Nature and Extent of Harm to Government. Without contractual coverage, there will be no waste management on Fort Hood. Of utmost importance, refuse collection and disposal will not take place, and operation of the Fort Hood Landfill will cease.

- The lack of trash pickup would be unsightly, and would create health hazards to all facilities on the installation, including dining halls and child development centers.

- Violation of state and federal health and environmental regulations could result in the suspension of Fort Hood’s landfill permit, resulting in the need to find alternative locations to dispose of refuse, at potentially higher costs.

Suspension of service until a new contract is in place is unacceptable. The Government would be severely injured if this extension were not permitted since it is the only means of keeping the services in place in the time available. Aside for the unsightliness of trash building up, the health and environmental hazards would be numerous, resulting in violations with both fiscal and penal implications.
