LIMITED SOURCES JUSTIFICATION
NATIONAL NUCLEAR SECURITY ADMINISTRATION
TECHNICAL AND ANALYTICAL SUPPORT SERVICES
OFFICE OF DEFENSE NUCLEAR SECURITY (NA-70)
DE-NA0001356/DE-BP0003336
November 28, 2016
I. AGENCY IDENTITY AND CONTRACTING OFFICE
The Office of Defense Nuclear Security (NA-70) of the U.S. Department of Energy (DOE), National Nuclear Security Administration (NNSA) plans to contract for additional technical and analytical support services by using an authority for limited sources. The contracting activity is the NNSA Non-M&O Contracting Operations Division, Services Acquisition Branch, Headquarters Program Section.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
This acquisition action is to modify Mele Associates, Inc. (Mele) Task Order DE- NA0001356/DE-BP0003336 to extend the period of performance for an additional three months.
The extension would allow adequate time to define the follow-on requirements and issue a new Task Order. The current task order was competed amongst the current DOE/NNSA Technical, Engineering and Programmatic Services (TEPS) Blanket Purchase Agreement (BPA) holders and was awarded to Mele on December 2, 2013. The current Labor Hour Task Order expires December 1, 2016 and has a current ceiling price of $10,830,416.20.
This action will result in a modification to Mele’s Task Order DE-BP0003336 to; 1) extend the performance period for the Performance Work Statement (PWS) to March 1, 2017; 2) increase the Ceiling Price for CLIN 00007 Labor by $803,870.03; and 3) increase the Ceiling Price for CLIN 00008 Travel by $51,094.03. No additional ceiling will be required for Other Direct Costs (ODCs). The total value of this action is $854,964.06 which will increase the ceiling price of the Task Order from $10,830,416.20 to $11,685,380.26.
III. DESCRIPTION OF SERVICES
The Office of Defense Nuclear Security is responsible for the overall policy direction and assessment of security programs at NNSA facilities. To support NA-70 with its mission, Mele will continue to provide technical and analytical support services to NA-70 in the following technical areas:
• Technical and Program Management Support;
• Strategic Communication Management Support;
• Ad Hoc Program Support;
• Headquarters Security Operations Support;
• Headquarters Security Incident Support;
• Headquarters Classified Matter Protection and Control Support;
• North Atlantic Treaty Organization Program Support;
• Foreign Interests Program Support;
• Continuity of Operations Program;
• Security Education, Awareness and Outreach;
• Classification and Controlled Information Program Technical Support;
• Classification and Declassification Reviews;
• Sensitive Unclassified Reviews;
• Operations Support;
• Subject Matter Expertise;
• Safeguards and Security Information Management Systems;
• DNS Program Support;
• DNS Metrics;
• Implementation and Guidance Development;
• HSPD-12 Program Management;
• International Treaties and Arms Control Agreements Program Support; and
IV. AUTHORITY
The authority permitting limited sources as implemented by the Federal Acquisition Regulation (FAR) is Subpart 8.405-6 (a)(1)(i)(C) - In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
V. JUSTIFICATION FOR USING THE LIMITED SOURCES AUTHORITY
Mele currently provides technical and analytical support services to NA-70 under Task Order DE-BP0003336. The original task order was placed in accordance with the applicable Federal Supply Schedule ordering procedures and was competed amongst all TEPS BPA Holders.
Mele’s Task Order BP0003336 expires on December 1, 2016, and NA-70 requires continued support until the follow-on task order can be issued. Extending DE-BP0003336 is the most economic and efficient method to obtain the required technical support services because Mele is familiar with and is currently supporting (i) drafting and incorporating comments to the Argus Management Plan; (ii) maintaining and upgrading the NA-70 SharePoint Site; (iii) working on Incident of Security Concern (IOSC); and (iv) NATO access briefings and rewriting NATO procedures for Subregistry and providing comments from observations from the CUSR inspection.
Issuing a new task order to another contractor for three months would require additional time and costs. Awarding two separate follow-on Tasks would cause duplicative costs. This modification is a logical follow-on in that it is a continuation of the work scope Mele currently performs under Task Order DE-BP0003336.
VI. CONTRACTING OFFICER DETERMINATION OF BEST VALUE
The contracting officer has determined after considering the level of effort and the mix of skills available for the tasks needed, that the proposed action represents a reasonable total price and will be the best value for the Department consistent with FAR 8.404(d). The Contracting Officer compared Mele’s proposed price of the extension to the Independent Government Cost Estimate and the competitive prices on the original award.
VII. MARKET RESEARCH
Additional market research was not conducted for this action because the Government intends to compete a follow-on requirement for additional technical support services for NA-70 under the DOE/NNSA Technical, Engineering, and Programmatic Support Services (TEPS) Blanket Purchase Agreement (BPA) and expects to make award by February 2017.
VIII. OTHER FACTS
The follow-on requirement is being considered to be combined with task order DE-BP0003261, which covers the same scope of work.
IX. STEPS TO FOSTER COMPETITION
NNSA will recompete the future requirement for additional technical support services for NA-70 under its TEPS BPA.
