JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
NATIONAL NUCLEAR SECURITY ADMINISTRATION
OFFICE OF INFORMATION MANAGEMENT AND CHIEF INFORMATION OFFICER TASK
ORDER GS-06F-0640Z/DE-DT0001391
December 2016
I. AGENCY AND CONTRACTING ACTIVITY
The Office of Information Management and Chief Information Officer (NA-IM) of the U.S.
Department of Energy (DOE), National Nuclear Security Administration (NNSA) plans to contract for additional Office of Chief Information Officer (OCIO) Information & Technology Cyber Security Support Services by using an exception to fair opportunity. The contracting activity is the NNSA Non-M&O Contracting Operations Division, Services Acquisition Branch, Headquarters Program Section (NA-APM-124.1).
II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED
This acquisition action is to modify Metrica Team Venture’s Task Order GS-06F-0640Z/DE- DT0001391 to extend the period of performance for up to six months, from December 31, 2016 to June 30, 2017, inclusive of a one-month base period, three one-month option periods, and one two-month option period. Task Order DE-DT0001391 was awarded to Metrica Team Venture (MTV), 100 N E Loop 410, Suite 520, San Antonio, TX 78216, for NA-IM, on April 30, 2010, pursuant to a fair opportunity competition under the General Services Administration’s (GSA) Alliant Small Business (ASB) Government-Wide Acquisition Contract (GWAC), which was open to all awardees under the ASB GWAC. Task Order DE-DT0001391 was awarded for a five year period of performance from April 30, 2010 – April 29, 2015 inclusive of one two-year base period, one one-year option period, and one two-year option period. The Firm Fixed Price task order has a current ceiling price of $130,037,000.29.
On April 23, 2015, the Task Order was extended for three months to July 31, 2015. On June 26, 2015, the Task Order was extended for an additional three months to October 31, 2015.
The two three-month extensions were required in order for the agency to resolve a protest that an unsuccessful vendor filed in response to the award of the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA). The protest pushed back the timeline for the award of the follow-on Task Orders under the BPA. On November 2, 2015, DE-DT0001391 Modification 0099 extended the period of performance for an additional six months, to April 30, 2016.
NNSA awarded the follow-on Task Order for information technology support services on January 14, 2016. Subsequently, NNSA received a U.S. Government Accountability Office (GAO) protest related to the award of the follow-on task order; therefore, on April 29, 2016, Modification 0107 extended the Task Order for an additional two months, to June 30, 2016 to allow time to receive GAO’s decision.
On May 2, 2016, the GAO sustained a protest to the award of DE-BP0004824. The NNSA has implemented corrective action and complied with the GAO recommendation by determining that the Original RFQ does not reflect the Government’s current, actual requirements. All three small business vendors under the IICS BPA are being provided a fair opportunity to compete for the three Orders in accordance with the new RFQs and PWS requirements. A modification to DE-DT0001391 was necessary to serve as a bridge contract while the new requirements were finalized and for a competition to take place. The bridge contract was awarded on June 30, 2016 and will run until December 31, 2016.
This action will extend the task order period of performance from December 31, 2016 to January 31, 2017, with options to extend performance until June 30, 2017. The evaluation and selection process is not anticipated to last for an additional six months, but extra time is being built in as option periods to account for unanticipated delays that may arise. Services for the new six-month bridge contract will be added as separate firm fixed price Contract Line Item Numbers (CLINs) as follows: CLIN 00036 Services Option Period 25 (one-month base period for January 2017), CLIN 00037 Services Option Period 26 (one-month option period for February 2017), CLIN 00038 Services Option Period 27 (two-month option period for March 1, 2017 – April 30, 2017), CLIN 00039 Services Option Period 28 (one-month option period for May 2017) and CLIN 00040 Services Option Period 29 (one-month option period for June 2017). All additional Travel, Other Direct Costs (ODCs), and Project Support for the extension periods will utilize existing CLINs: 000011 Travel, 00012 ODCs, and 00013 Project Support. The total price of the extension (inclusive of the base period and option periods) is $7,992,406.56 and the ceiling will increase from $130,037,000.29 to $138,029,406.85 as a result of the modification.
III. DESCRIPTION OF SERVICES
Under Task Order DE-DT0001391, MTV provides IT technical and advisory and assistance services to the NNSA CIO in Headquarters in Washington, DC and Germantown, MD.
MTV currently travels to sites to conduct Site Assessment Visits. They review network security plans, network configuration, risk analysis, and security practices. ODCs item purchases under the contract include license renewals, training, projects, and computer equipment.
There are currently six active Work Assignments (WA) under the Project Support CLIN:
WA 004: Marketing/Communications Services WA 012: NA-IM-40 Operations Support WA 013: Committee on National Security Systems Support WA 014: Data Consolidation and Analysis WA 015: OCIO Business Process Analysis WA 017: Portal Migration
MTV will continue its prior work in supporting the above services and work assignments, as well as all associated travel and ODCs.
The total price of the extension (inclusive of the base period and option periods) is $7,992,406.56 and the ceiling will increase from $130,037,000.29 to $138,029,406.85 as a result of the modification.
IV. EXCEPTION TO FAIR OPPORTUNITY
The statutory authority permitting other than full and open competition is Federal Acquisition Regulation (FAR) Subpart FAR 16.505(b)(2)(i)(C), which states: “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”
V. JUSTIFICATION FOR USING THE EXCEPTION
MTV currently provides IT technical and advisory and assistance services under Task Order DE-DT0001391 and is the only contractor that can continue to provide the required services within the timeframe required. MTV’s contract expires on December 31, 2016, and the OCIO requires continued support for up to an additional six months to allow time for completion of the follow-on order awards under the NNSA Information Technology (IT) Infrastructure and Cyber Security (IICS) Support Services Blanket Purchase Agreement (BPA). Extending MTV’s Task Order DE-DT0001391 is the most economic and efficient method to obtain the required information technology support services because MTV has been performing the work scope since April 2010. Transferring the required support to another contractor for six months would result in duplicative costs incurred by the NNSA for contract transition, and could potentially result in a gap in service. Extending the task order ensures continuity of the critical information technology support services. This modification is a logical follow-on in that it is a continuation of the current information technology work scope MTV currently performs. Under this action, MTV will continue to perform the current information technology support tasks within the Task Order’s Performance Work Statement (PWS). Additionally, the original task order was competed under the GSA’s ASB GWAC in 2010, and all awardees were given a fair opportunity to be considered for the original order.
VI. DETERMINATION OF REASONABLENESS OF COST OR PRICE
The Contracting Officer has determined that the price is fair and reasonable based on proposal analysis techniques utilized under FAR 15.404-1. In accordance with FAR 15.404-1(b)(2)(ii) and FAR 15.404-1(b)(2)(iv), the Government compared MTV’s proposed price to historical prices paid and to competitive published price lists. Based on this analysis, the Contracting Officer determined that MTV’s proposed price of $7,992,406.56 for the additional Option Periods is fair and reasonable.
VII. OTHER FACTS
There are no other facts relevant to this Justification for an Exception to Fair Opportunity.
VIII. STEPS TO FOSTER COMPETITION
Task Order DE-DT0001391’s scope contains both Information Technology support and Policy and Governance Support requirements. On September 6, 2016 Request for Quotation (RFQ) DE-SOL-0010157 for Information Technology (IT) Support was issued under the IICS BPA to implement corrective action and comply with the GAO recommendation. RFQ DE-SOL-0010157 closed on September 21, 2016 and the evaluation process is ongoing. On October 26, 2016 RFQ DE-SOL-0010320 for Policy and Governance (P&G) Support was issued under the IICS BPA to implement corrective action and comply with the GAO recommendation. RFQ DE-SOL- 0010320 closed on November 9, 2016 and the evaluation process is ongoing.
