About this file

This document is a Justification and Approval (J&A) for a non-competitive procurement by the Army Contracting Command - Redstone Arsenal (ACC-RSA) for a Wire Rope Assembly for the UH-60 helicopter. The solicitation (W58RGZ-25-R-0054) is a single-award, Firm-Fixed Price (FFP), five-year Indefinite Delivery Indefinite Quantity (IDIQ) Spares contract to Stantek Manufacturing, LLC, the only approved source with the necessary technical data and data rights.

The procurement is justified under 10 U.S. Code Section 3204(a)(1) due to the unavailability of technical data from other sources. A Sources Sought announcement was published, but only two sources expressed interest, and neither was approved by the Systems Readiness Directorate. The Wire Rope Assembly is critical for UH-60 Black Hawk helicopter operations, involving high-stress applications like hoisting and load handling. The total estimated contract value spans five years, with quantities and pricing redacted. Previous Wire Rope Assembly contracts were also limited source acquisitions, with Stantek Manufacturing, Redstone Defense Systems, and L-3 Communications being prior suppliers.

4. Authority Cited: Title10 United States Code Section 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2), “When supplies or services required by the agency are available from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”

5. Reason for Authority Cited: The proposed acquisition requires the use of the cited statutory authority due to the unavailability of technical data and data rights required for the Wire Rope Assembly. The Government does not have the necessary access to the technical data needed to compete the requirement. Stantek Manufacturing, LLC is the only approved source and active contractor in SAM.GOV, having the technical data necessary to provide the Wire Rope Assembly. Currently, is the one other approved source, but their SAMs registration is inactive.

The Wire Rope Assembly on a UH-60 Black Hawk helicopter is a critical component used in various systems, such as hoisting operations and load handling, to ensure safe and reliable lifting and load management during operations. If the wire rope assembly is procured from an unauthorized contractor, there could be significant risks to both safety and performance. Unauthorized suppliers may provide substandard or non-compliant materials that do not meet the stringent military specifications required for such high-stress applications, leading to potential failure of the rope under load, causing damage to the helicopter, failure of mission-critical operations, and jeopardizing crew safety. This could also result in a loss of mission capability and increased maintenance costs.

6. Efforts to Obtain Competition: In accordance with DFARS 205.205- 71, DFARS 206.302-1(d), and DFARS Procedures, Guidance, and Information (PGI) 206.302-1 (d), a Sources Sought announcement was publicized on SAM.gov on 07 November 2024 and ended on 14 November 2024. As of 25 November 2024, only two source expressed interest in this acquisition. On 06 November 2024, informed the Government that it will not bid on this solicitation. In response to the sources sought notice, two other sources express interest in this acquisition: (CAGE Code

) and (CAGE Code ). However, neither of the interested sources are approved sources by the Systems Readiness Directorate (SRD).

A notification was sent to both companies with guidance on obtaining data rights from the two approved sources to be added to the Army restricted source list.

As per FAR 19.702, a Subcontracting Plan is not required for this procurement.

7. Actions to Increase Competition: As per FAR 5.201, this requirement will be summarized on SAM.gov. As mentioned earlier in paragraph five, full and open competition cannot be supported due to unavailability of technical data and data rights.

Consequently, the Government is unable to take any measures to increase competition at present and does not expect to be able to do so in the future.

8. Market research Report/Commerciality Determination Report (MRR/CD): In accordance with FAR 10.002(b) meaningful market research for AX4F2400AX was conducted by the Logistics Management Specialist, AMCOM Logistics Center, in the last 12 months. Research methods included the following: (a) Personal knowledge in procuring supplies/services of this type: (b) Contacting knowledgeable persons in government during September 2024 (to include an Inventory Management Specialist);

(c) Discussed the results of recent market research review of similar or identical items in November 2024.

Based upon this market research, it has been determined that the Government's needs cannot be satisfied with commercial items, commercial items with customary or reasonable modification, or non- developmental items. Based upon the above, the basic clauses and provisions prescribed in FAR Part 12 are not sufficient for use in this acquisition and will not be utilized. As determined by the market research the only capable source that can meet this requirement is Stantek Manufacturing, LLC.

As of 25 November 2024, only two source expressed interest in this acquisition. On 06 November 2024, informed the Government that it will not bid on this solicitation. In response to the sources sought notice, two other sources express interest in this acquisition: (CAGE Code ) and (CAGE Code ). However, neither of the interested sources are approved sources by the Systems Readiness Directorate (SRD). A notification was sent to both companies with guidance on obtaining data rights from the two approved sources to be added to the Army restricted source list.

9. Interested Sources: The results of the Sources Sought announcement are addressed in paragraph six (6) of this document. There is a reasonable basis to conclude at this time, that the agency’s minimum needs can only be satisfied by Stantek Manufacturing, LLC. All notices required by FAR 5.201(b)(1)(i) will be published, and any proposal received shall be considered.
