For Actions Exceeding the Simplified Acquisition Threshold (SAT)

FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

For Actions Exceeding the Simplified Acquisition Threshold (SAT)

1. Contracting Activity: Mission and Installation Contracting Command (MICC), Fort Eustis, 705 Washington Avenue, Fort Eustis, Virginia 23604

2. Description of Action: US Army Training and Doctrine Command (TRADOC) requests a firm-fixed price extension to task order contract W911S019F0296 with Janus Research Group, LLC, located at 6504 Reservoir Road, Appling, GA 30802 for a period of five (5) months, ending 23 November 2020. The Government projects award for June 2020 and Fiscal Year (FY) 2020.

The Government will fund this extension with FY 2020. Operations and Maintenance – Army (OMA) funds.

3. Description of Supplies/Services: This requirement is for an extension for the current G-3 task order W911S019F0296, awarded under the ARCIC Mission Support Services multiple-award task order contract, W911S0-15-D-0003. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision and other items and non-personal services necessary to perform review and rewrite of Army Regulations, design and integration of TRADOC mobilization plans for training base expansion as defined in the Performance Work Statement (PWS). Required services include review and rewrite Army Regulations, Policy, and Plans; coordinate, process and synchronize capability development actions, information and data; apply knowledge of mobilization requirements to facilitate exercise design, planning and testing as well as to facilitate training design and implementation of training requirements for mobilization; possess strategic/operational staff experience, research and coordination in order to support the mobilization mission within TRADOC; and all other requirements in the PWS.

Due to changes in the Army Modernization Enterprise reorganization impacting TRADOC, Command Senior Leaders require a strategic pause in order to plan a revised way ahead for the best approach to revising regulations and policies; and those necessary for designing and integrating mobilization plans for Inactive Ready Reserve (IRR) and the training base expansion.

Due to the lack of civilian and military available to complete tasks linked to the new organization TRADOC Force Integration Directorate (TFID) achieving fully operational capability as well as support to the greater Army and TRADOC missions, this extension is critical. With the two Culminating Training Events (CTEs), TFID has been successfully researched, reviewed, and supported the revisions of multiple applicable Army Regulations and Army Policy Statements in conjunction with the reorganization of the Army Modernization Enterprise (AME) and any other reorganizations impacting TRADOC such as the upcoming reassignment of Army Capability Managers.

Additionally, the CTEs assisted to successfully coordinate, process and synchronize capability and force integration functions across the AME in support of Army Senior Leaders (ASLs) through the Army Requirements Oversight Council (AROC) process. The extension is critical due to: 1) the delays that have occurred as a result of the Coronavirus Disease 2019 (COVID 19) challenges and safety requirements and 2) lack of civilian and military available to complete tasks linked to the new organization TFID. The lack of having the additional personnel as a resource to support the tabletop exercises (TTXs) places the TFID efforts at greater risk of mission failure.

The TRADOC mobilization mission needs to be extended to November to support the publishing of a Mobilization plan in December 2020. COVID-19 resulted in limited travel and maximum capacity at the Army Training Centers. Support is required to complete Mobilization estimates at each of the TRADOC Installations and to review and update mobilization Program of Instructions to ensure the data is available in Tour of Duty, Mobilization Common Operating Picture (MOBCOP) and Army Training Requirements and Resources System (ATTRS) computer system in order to synchronize TRADOC’s mobilization and operational requirements.

Additionally, support is required for developing and executing Operational – Active Duty Operational Support (OP-ADOS) and Contingency Operations – Active Duty Operational Support (CO-ADOS) packets in support of TRADOC mobilization efforts to expand the training base.

Period of Performance: 24 June 2020 to 23 November 2020 Total Value: $464,082.04

4. Authority Cited: This action is authorized under provisions of 10 U.S.C. 2304c (b)(3) as implemented by FAR Part 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

5. Reason for Authority Cited: The requested extension of task order contract W911S019F0296 is a logical follow-on to the existing task order and must be issued on a sole source basis to Janus in the interest of economy and efficiency. The incumbent contractor, Janus Research Group, LLC, is the only responsible source at this time for satisfying the Army’s mission for these services. Janus has the necessary personnel and equipment in place to ensure continued operations of all functional areas related to the services for this extended period of time. All multiple-award task order contract (MATOC) holders (W911S0-15-D-0001, 0002 and 0003) were provided a fair opportunity to submit a proposal for task order W911S019F0296 pursuant to Request for Task Order Proposal (RTOP) G-3 Review and Mobilization Support Services. However, no other MATOC holders proposed on this requirement and they have no knowledge of the ongoing actions pertaining to it. The extension is a logical follow-on to the original task order because work being performed will be the same in terms of scope of work. Continuity of mission related training is critical for all required services currently being provided and without an extension, unacceptable delays would cause significant mission impact. The extension will ensure continued service in support of TRADOC’s mission. It is more efficient and economical to extend the current task order than to award the extension using fair opportunity procedures or full and open competition, as discussed below.

(a) Alternatives

1. Suspended Operations. Suspending operations of the current services is not a viable alternative. This would result in a significant disruption of the reviews and rewrites of Army Regulations, Policy and Plans in conjunction with the established Army Futures Command (AFC) and the development to design and integrate TRADOC mobilization plans in support of the Army’s mobilization plan.

2. Use of Government In-House and Expertise. Currently there are no available Government personnel able to supplement this work with the experience required to execute the tasks in the PWS.

3. Conducting a limited competition would be costly, inefficient, and create operational risk if the task order was awarded to a company other than the incumbent. The five (5) month extension is anticipated to cost $464,082.04Awarding the extension on a competitive basis under compressed timelines may require a phase-in period, which would be inefficient and disrupt operations, and represent additional cost to the Government.

(b) A critical need exists to continue the TRADOC G5, G3 and TFID services beyond 23 June 2020. Due to time constraints and the possibility of impact to mission, there is not enough time to solicit for adequate competition for these services. A competitive action is neither feasible nor a reasonable strategy for this short term effort. For these reasons, upon review of this request and the authority cited above, the contract extension of 152 days is needed. In accordance with FAR 52.216-22, the MATOC’s ordering period ends on 16 Dec 2020. This clause is included in the MATOC, W911S0-15-D-0003, but was not included in the task order, as it was not expected to go beyond one year of performance. The incumbent is fulfilling the requirement satisfactorily.

6. Actions to Increase Competition:

The task order was solicited under multiple-award task order contracts W911S0-15-D-0001, 0002 and 0003, which were awarded using full and open competition. All MATOC holders were provided a fair opportunity to be considered for this task order, but only JANUS submitted a proposal. As these services were expected to be completed in one year, no efforts were made to seek competition on continued services. At this time, the Government does not anticipate a need for these services beyond the extension.

7. Market Research:

Due to the urgency of this requirement market research was performed by reviewing research results of a similar contract (W911S0-20-C-0002) utilizing the same NAICS code (541690) and similar tasks. MICC – Fort Eustis issued the Request for Task Order Proposals (RTOP) to MATOC holders on a competitive basis, using the fair opportunity procedures of FAR 16.505(b) on 2 May 2019. All three MATOC holders were given a chance to respond to the RTOP;

however, only one, Janus, proposed.

8. Other Facts:

Procurement History: There is no procurement history to provide for this requirement other than for the existing task order contract. Fair opportunity procedures of FAR 16.505(b) were provided with the award of the TO. The existing task order contract was competed amongst the three (3) IDIQ holders under an umbrella MATOC on 2 May 2019. Incumbent contractor was the only response received to the RTOP.

11. Fair and Reasonable Price Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable. The estimated price is consistent with the ceiling labor rate prices established in the base multiple-award contract, for which prices were determined to be fair and reasonable based on adequate price competition.

The price reflected with this J&A has also been determined to be fair and reasonable when compared to the past amount awarded for the existing task order contract and in comparison to the ceiling rates of the MATOC. As a part of this basis, certified cost or pricing data will not be required and the following exception applies, FAR 15.403-2(a).
