FAR 8.405-6 Limited Sources Justification Under the General Services Administration

Federal Supply Schedule Program

1. Contracting Activity: Army Contracting Command Aberdeen Proving Ground (ACC- APG), ATTN: CCAP-SCD, 6515 Integrity Court Bldg. 4310, Aberdeen Proving Ground, MD 21005

2. Description of Action: The United States Army Security Assistance Command (USASAC) requests a Firm Fixed Price task order under the General Services Administration (GSA) Federal Supply Schedule (FSS) Program with Creative Solutions Consulting, Inc. (CSCI) 8415 E. 56th St, Ste #101, Indianapolis, IN 46216-2200. The Government will execute this action against FSS contract GS-35F-0077V. Projected award is August 30, 2020 and fiscal year 2020, Foreign Military Sales Administrative (FMS Admin) funds will be used.

X An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

This action is a logical follow-on contract/order to W91CRB-16-F-0041. That contract/order was competed on GSA’S eBuy.

3. Description of Supplies/Services: The contractor shall provide non-personal on-site support services related to training and FMS business process for use with the General Funds Enterprise Business System (GFEBS). These efforts include: guidance for coordinating current business rules and processes with the changes required by utilizing GFEBS; mentoring financial management staff; organizing and coordinating new initiatives and projects associated with deployment of a new system. These services are critical for managing and forecasting Government funds. This procurement is in support of the U.S. Army Security Assistance Command (USASAC).

4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by the following:

FAR 8.405-6(a)(1)(i)(A). An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

FAR 8.405-6(a)(1)(i)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with applicable Federal Supply Schedule ordering procedures. The original order or BPA was not previously issued under a sole-source or limited-sources procedures.

FAR 8.405-6(b)(1). Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

5. Reason for Authority Cited:

The work to be performed under task order (TO) W91CRB-20-F-0438 is a logical follow-on to the tasks currently being performed under TO W91CRB-16-F-0041’s Performance Work Statement (PWS). Both of these TOs require the same labor mix and duties. As detailed under #4 above, FAR 8.405-6(a)(1)(i)(C) states that you may issue a logical follow-on order if the previous TO was solicited competitively. As previously stated, W91CRB-16-F-0041 was competed via GSA’s eBUY. The services that will be performed are a continuation of the efforts the vendor will complete in support of USASAC under TO W91CRB-16-F-0041 whose Period of Performance (PoP) will end on 31 Aug 20.

The specific requirement similarities between the original order (TO W91CRB-16-F- 0041) and this additional work include: GFEBS helpdesk support, providing special instructions for FMS processes within the General Funds Enterprise Business System (GFEBS), training of command financial management personnel and hands-on onsite resource support. Utilizing the same vendor will allow for the continuation of the aforementioned services specifically training that is in process such as: training of USASAC personnel on how to extract reports in GFEBS, extrapolation of the reports, deducing where the funds are located within the various customer accounts and what types of transactions would need to occur. CSCI will also be able to continue to support USASAC by assisting with the following support resources such as acting a Subject Matter Expert, a skillset that is currently lacking within USASAC personnel. In addition to the aforementioned, at the conclusion of TO W91CRB-20-F-0438’s PoP this position will transition to a Department of the Army Civilian (DAC) position. Continuing with CSCI will allow for continuity of services until this position is transitioned to a DAC.

If this action were competed, it would take approximately four (4) to six (6) months to complete the solicitation, evaluation, negotiation and award process. Post award an additional 30-days would be required to phase-in a new vendor and provide them access to the various systems needed to fulfill the duties associated with the PWS requirements.

This timeline would result in a lapse in mission support as it relates to the training requirements and other duties which are currently in process.

If this logical follow-on order is not awarded to CSCI the delay caused while soliciting and awarding a new contract plus phasing-in a new contractor will have a serious impact to the processes and services support related to the FMS cases.

This type of lapse would potentially cause harm to national security.

Serious harm may come in the form of military failure to those allies if the financial expertise is not available to move their Security Assistance request forward in a timely fashion. CSCI provides the experience, knowledge, and history that would be lost by transitioning to a new vendor.

6. Actions to Increase Competition: Fair Opportunity was given prior to the award of task order (TO) W91CRB-16-F-0041 but no further competition is anticipated for this action due to time constraints and efforts to avoid a lapse in service. At the conclusion of the forthcoming task order USASAC will be transitioning the required services to an in-house Government GFEBS Subject Matter Expert.

7. Market Research: Market research was not conducted for this follow-on effort because the original TO W91CRB-16-F-0041 was competed amongst the schedule holders under their basic contracts on GSA’s eBuy. Adequate competition was expected and received in response to the Fair Opportunity.

In accordance with FAR 8.405-6(a)(2)(i), notice of this proposed action and the redacted LSJ will be posted on GSA’s eBUY. These documents will be posted 14 days after the TO has been awarded.
