2) All work must be guaranteed against defects, in workmanship and materials, for a period of one

(1) year from completion.

3) Bidder agrees to accept responsibility for loss or damage to any person or entity, and to protect, defend, indemnify, hold harmless and release LINCOLN PARK PUBLIC SCHOOLS, and its officers and employees from and against any and all losses, expenses, actions, claims, damages, disabilities or the cost of litigation that are asserted by any person or entity to the extent arising out of the negligent acts or omissions or willful misconduct in the performance by the bidder hereunder, whether or not there is concurrent negligence on the part of LINCOLN PARK PUBLIC SCHOOLS, but excluding liability due to the active negligence or willful misconduct of LINCOLN PARK PUBLIC SCHOOLS. If an insurance coverage furnished by the bidder is on a “claims made” basis, the bidder shall continue the coverage required under this contract for a minimum period of three years after the expiration or termination of this contract.

6) Although LINCOLN PARK PUBLIC SCHOOLS is tax exempt, materials furnished to contractors are taxable to them.

7) Any deviation from the specifications set forth must be clearly detailed on the bid proposal form; otherwise, it will be considered that items offered are in strict compliance with these specifications and the scope of work presented at the pre-bid meeting, and successful bidder will be held responsible therein.

8) The Board of Education reserves the right to accept or reject any or all bids, to split awards by item, or to select one or more firms to perform the project.

9) This bid is made without any previous understanding or agreement with any other person, firm or corporation making a bid for the same purpose, and is in all respects fair and without collusion or fraud.

Unless otherwise stipulated, the Contractor shall provide and pay for all materials, labor, water, tools, equipment, light, power, transportation, and other facilities necessary or used for the execution and completion of the work. Unless otherwise specified, all materials incorporated in the permanent work shall be new, and both workmanship and materials shall be of the highest quality. The Contractor shall, if required, furnish satisfactory evidence as to the kind and quality of materials.

14) The Contractor shall at all times enforce strict discipline and good order among its employees, and shall seek to avoid employing on the work any unfit person or anyone not skilled in the work assigned.

15) If permits are required, such permits will be reimbursed to the contractor by the School District. All applicable permits will be the responsibility of the contractor.

16) The Contractor shall give all notices and comply with all laws, ordinances, rules and regulations bearing on the conduct of the work as drawn and specified. If the Contractor observes that the contract documents are at variance with those requirements, it shall promptly notify the Supervising Professional in writing, and any necessary changes shall be adjusted as provided in the Contract for changes in the work.

17) All work shown on the plan set and within the specifications including all restoration must be completed no later than August 1, 2025. Failure to comply with the deadline for completion may result in a back-charge for any damages incurred by LINCOLN PARK PUBLIC SCHOOLS as a result of non-compliance with this requirement.

18) The successful contractor shall receive a purchase order for each location listed in this request.

19) Upon entering into a contract with LINCOLN PARK PUBLIC SCHOOLS, the successful supplier(s) shall not assign or delegate any obligation to another supplier(s) without written consent of LINCOLN PARK PUBLIC SCHOOLS. All subcontractors supplying products or services must be identified within the bid response including name, address, phone number and products or services to be supplied.

If the supplier(s) fails to deliver within the time specified, or within reasonable time as interpreted by LINCOLN PARK PUBLIC SCHOOLS, or fails to make replacement of rejected articles, when so requested, immediately or as directed, LINCOLN PARK PUBLIC SCHOOLS may purchase from other sources to take the place of the item or service rejected or not delivered. LINCOLN PARK PUBLIC SCHOOLS reserves the right to authorize immediate purchase from other sources against rejections on any contract when necessary. On all such purchases, the supplier(s) agrees to reimburse LINCOLN PARK PUBLIC SCHOOLS promptly for excess costs occasioned by such purchases. Should the cost be less, the supplier(s) shall have no claim to the difference. Such purchases will be deducted from the contract quantity.

In the event that the supplier(s) shall fail, neglect or refuse to perform any or all of the duties, obligations or agreements by it to be performed under these contract documents, LINCOLN PARK PUBLIC SCHOOLS may perform such duties, obligations or agreements or have such duties, obligations or agreements performed and charge all costs thereof or incurred in connection therewith, to the supplier(s) and the supplier(s) shall pay all of said costs to LINCOLN PARK PUBLIC SCHOOLS and, not in limitation of the generality of the foregoing, LINCOLN PARK PUBLIC SCHOOLS may collect the same in any manner authorized by law or may deduct such costs from any monies due or to become due to the supplier(s) or collect the same from the oblige under the performance bond filed in connection with this contract.

In the case that the supplier(s) cannot meet deadlines, LINCOLN PARK PUBLIC SCHOOLS may contract out or perform these duties itself and receive from the vendor the cost incurred.
