About this file

The Questions and Answers file addresses a specific inquiry about personnel requirements for Solicitation FHF-25-Q-0068, an Independent Legal Opinion contract opportunity issued by the Federal Housing Finance Agency. The key clarification is that the required Partner and Associate must be two distinct individuals, not the same person billed at different rates. For law firms or entities without traditional partners, compliance can be achieved by identifying individuals who function in equivalent roles and meet the Performance Work Statement requirements. The personnel must demonstrate distinct responsibilities, experience, and qualifications for their respective labor categories, with firms required to submit information for at least one Partner and one Associate, and optionally up to five attorneys total.

For the subject solicitation, I understand the following: "Firms must submit information for at least one Partner and one Associate, and may provide information on up to five attorneys in total, including Counsel." May the required Partner and Associate be the same individual billed out at two different hourly billing rates? In the case of a law firm professional corporation, sole proprietorship, LLC, or other entity without partners per se, how would this information be best presented to comply with the posted requirements?
The Partner and Associate need to be two distinct individuals. The Partner is defined as having an oversight role, which implies a hierarchy that would not be satisfied by a single person serving in both roles.

The labor categories of Partner and Associate have distinct responsibilities, experience, and qualifications. The individual proposed for each role would need to demonstrate compliance with those requirements. It’s more than simply billing the same individual at two different rates.

For entities without traditional “Partners,” compliance is still achievable by clearly identifying individuals who function in equivalent roles, provided they meet the requirements of the PWS.
