JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

41 U.S.C. 3304 (a) (1)

Pursuant to the requirements of the Competition in Contracting Act (CICA), as implemented by FAR Subpart 6.3, and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

1. AGENCY AND CONTRACTING ACTIVITY

The Federal Housing Finance Agency (FHFA), Office of Budget and Financial Management (OBFM), on behalf of the Office of Technology and Information Management (OTIM), propose to enter into a contract on the basis other than full and open competition for a brand name purchase.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

FHFA’s Office of Technology and Information Management (OTIM) has a requirement to procure brand name network equipment specifically manufactured by Cisco Systems, Inc.

(Cisco) and Oracle/Sun; and additional enterprise back-up software license manufactured by Symantec. The network equipment and backup software are required to enhance the Agency’s Back-up and Recovery System (BARS). The total estimated cost is [REDACTED].

3. DESCRIPTION OF SUPPLIES AND SERVICES

FHFA will purchase Cisco and Oracle/Sun equipment, and Symantec software license that will include:

DEVICE/FUNCTION QUANTITY

CISCO 16-PORT 10GBE FIBER MODULE 1

CISCO 10GBE TRANSCEIVER MODULES 16

SYMANTEC : SYMC NETBACKUP ENTERPRISE DISK 7.5 XPLAT 1 FRONT

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED

The network equipment is needed to increase bandwidth to the Agency’s Back-up and Recovery System. A brand name justification is required because of the network gear and server platform that is currently deployed at the FHFA. In order to ensure proper interoperability and operations, FHFA must acquire Cisco branded network components to insert into existing CISCO switches.

Likewise, Oracle/Sun network cards are required for interoperability with existing Oracle/Sun servers that comprise the Backup and Recovery System. Brand name components are also required to ensure proper support from the manufacturer for support and maintenance.

Additional software license is required for our existing Backup and Recovery System (i.e.

Symantec Netbackup Enterprise infrastructure). Specifically, an Enterprise Disk Option license is required. In order to ensure proper interoperability and operations FHFA must acquire a Symantec Netbackup Enterprise Disk license.

The National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) Government-Wide Acquisition Contract (GWAC) provides a broad base of vendors that can compete for award of the required Cisco, Oracle/Sun and Symantec products.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICAL

A solicitation will be sent to thirty-eight (38) vendors under the NASA SEWP Indefinite Delivery Indefinite Quantity (IDIQ) contract. This contract vehicle has already been synopsized in accordance with FAR 5.201.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer determines that the anticipated price will be fair and reasonable by obtaining competition among the NASA SEWP vendors.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED

Market research was done on the NASA SEWP web site as well as other open market vendors.

FHFA believes that award to any other brand would result in substantial duplication of cost that is not expected to be recovered through competition and would result in unacceptable delays in fulfilling agency objectives. As a result, while comparable products may exist, FHFA market research focused on available sources to fulfill our requirements. The market research concluded that the requirements could be fulfilled by soliciting from the NASA SEWP IDIQ contract.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

No other fact is available.

10. A LISTING OF SOURCES, IF ANY, THAT HAVE EXPRESSED AN INTEREST IN

THIS ACQUISITION

The following vendors under the NASA SEWP IDIQ contract will be given the opportunity to submit a quote. The vendors are as follows:

Affigent, LLC Blue Tech, Inc. Emtec Federal Alliance Technology CDW*G FCN Technology Alvarez & Associates CounterTrade Products FedStore Corporation Best Buy, Gov LLC Detaline LLC Force 3, Inc.

Dell Federal Systems Four Points Tech GC Micro IBM Merlin International GovConnection, Inc.

Intelligent Decisions MicroTech, LLC GTSI Corp.

iGov.com Presidio Hewlett Packard (HP) ImmixGroup PC Mall Gov i3 Federal Iron Bow Technologies Red River Ricoh Americas Corp Silicon Graphics Fed. Softchoice Corp. Sword & Shield Technica Corporation Three Wire Systems ThunderCat Technology Unisys WWT

11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO EITHER

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION

A review of current technology and it’s compatibility to the FHFA enterprise architecture is on-going. Whenever a compatible non-brand name can be identified, it will be considered for purchase.
