JUSTIFICATION FOR OTHER THAN FULL AND OPEN
COMPETITION
41 U.S.C. 3304
In accordance with Federal Acquisition Regulation 13.106-1(b) (1), I hereby determine that the Federal Facilities Council (FFC) listed on EQPCB-23-0006 is required through a sole source procurement and competition is precluded for the reasons indicated below.
Please select the appropriate statutory authorities in accordance with FAR Part 6.302, Circumstance Permitting Other Than Full and Open Competition:
X FAR 6.302-1 Only one responsible sources and no other supplies or services will satisfy agency requirements;
� FAR 6.302-2 Unusual and Compelling Urgency;
� FAR6.302-3 Industrial Mobilization; Engineering, Development, or Research
Capability; or Expert Services;
� FAR 6.302-4 International Agreement;
� FAR 6.302-5 Authorized or Required by Statute;
� FAR 6.302-6 National Security; or � FAR 6.302-7 Public Interest.
1. Identification of the Agency and the Contracting Activity
This requirement is in support of the General Services Administration (GSA), Public Buildings Services (PBS), Office of Design and Construction, 1800 F Street, NW Washington, D.C.
20005.
2. Nature and/or description of the action being approved
Approval is being sought to award a sole source contract to the Federal Facilities Council (FFC).
The (FFC) was established in 1953 and operates under the auspices of the Board on Infrastructure and the Constructed Environment (BICE) of the National Research Council, the principal operating agency of the National Academy of Sciences (NAS) and the National Academy of Engineering. The FFC's mission is to identify and advance technologies, processes, and management practices that improve the performance of federal facilities over their entire life-cycle, from planning to disposal.
The GSA PBS Office of Design and Construction proposes to enter into a sole source contract with the FFC. In cooperation with over 20 other federal agencies, GSA PBS Office of Design and Construction proposes to enter into a sole source contract with the FFC, to provide research and advice on scientific and technological matters of concern to the Public Buildings Service.
The specific services are described in paragraph 2. The cost of the required services is: Base year (10/1/2023 – 9/30/2024) is $ option year#1 (10/1/2024 – 9/30/2025) is $ option year#2 (10/1/2025 – 9/30/2026) is $ and option year#3 (10/1/2026 – 9/30/2027) is $ which totals $
3. A description of the supplies or services required to meet the agency’s needs (including the estimate value),
(1) Development of technical studies focused on federal facilities, and development of implementation strategies and business cases concerning federal facilities.
(2) Planning, organizing, and convening of one or multi-day workshops on federal facilities on topics such as design and construction, operations, and costs.
(3) Convening of roundtables on federal facilities on topics such as real property mandates and data requirements.
(4) The FFC promotes continuing cooperation and regular interchanges of information among the participating federal agencies and between the agencies and other elements of the facilities engineering and management community. This is fulfilled through meetings, technical information activities, and networking organized and conducted by the FFC’s standing committees that are composed of government professionals and managers appointed by the sponsoring agencies plus liaison members from professional and trade organizations.
4. An identification of the statutory authority permitting other than full and open competition In accordance with 41 U.S.C. 253(c) and/or 10 U.S.C. 2304(c), GSA has determined that the procurement requires a sole source in order to satisfy the Agency’s need. Specifically, the basis for other than full and open competition is that GSA has only one responsible source and no other supplies or services will satisfy agency requirements in accordance with FAR 6.302-1.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited The NAS/FFC has the unique ability to assemble the Nation's most eminent scholars, who serve as volunteers without compensation on committees and boards, which are then able to render advice and guidance of the highest quality and unparalleled objectivity to address national problems of high priority. Accordingly, only NAS/FFC can provide the measure of expertise, independence, objectivity and audience acceptance necessary to meet program requirements across all federal agencies related to common needs for facilities research.
This ability is the result of a Congressional Charter created by the United States Congress in 1863, and signed by President Abraham Lincoln. Additionally, the Academies' service to government has become so essential that Congress and the White House have issued legislation and executive orders over the years that reaffirm its unique role. Also affirmed in the legislation and executive orders is the research and reports of the NAS/FFC are funded through financial agreements between the executive departments and agencies.
