Justification and Approval for Other than Full and Open
Competition Pursuant to FAR 6.302-5
ACQUISTION
SERVICES
DIVISION
1. This document constitutes the justification and approval for other than full and open competition for the acquisition described herein, under the authority of Section 8(a) of the Small Business Act (SBA), 15 U.S.C. § 637(a) and 41 U.S.0 § 3304(a)(5), and in accordance with FAR 19.805-1(2)(b) and FAR 6.302-5(b)(4). In accordance with FAR 6-303-2(d), the agency offers the following information as a justification regarding a sole-source 8(a) acquisition.
2. A description of the needs of the agency concerned for the matters covered by the contract:
This procurement supports the Federal Energy Regulatory Commission's (FERC) headquarters building renovation and modernization project. FERC currently leases and occupies 400,000 rentable sq. feet. In order to comply with General Services
Administration (GSA) mandates to reduce the current footprint, FERC will undergo a phased renovation of the headquarters building at 888 First Street NE, Washington D.C. 20426. To accomplish this goal, new office and workstation area standards are being defined in order to reduce the overall square footage of occupied space, while providing sufficient space to meet the current and planned future FERC FTE head-counts. In support of this effort, the "FERC Headquarters Renovation Project and Field Office Refresh: Initial Outfitting, Transition, & Commodities (10T&C)" procurement provides for the following requirements: manufactured furniture, partitions, shelving, chairs, including wood office furniture; furniture installation services, office move and transition services; and information technology (IT) equipment, audio visual equipment, security programming services, and comprehensive light auditing services.
3. A specification of the statutory provision providing the exception from the requirement to use competitive procedures in entering into the contract (see 19.805-1):
The statutory authority providing the exception to full and open competition is 15 U.S.C. § 637(a) and 41 U.S.0 § 3304(a)(5), in accordance with FAR 19.805-1(2)(b) and FAR 6.302-5(b)(4).
4. A determination that the use of a sole-source contract is in the best interest of the agency concerned:
The use of a sole source contract is in the best interest of FERC because the prospective vendor has a proven track record of providing turn-key solutions for the complete renovation and modernization of federal facilities. The prospective vendor was the only identifiable firm from the market research that provides a total turn-key solution within the Small Business
Administration's 8(a) program. In addition, the sole source contract supports the agency's contribution to helping socially and economically disadvantaged businesses gain access to federal business opportunities that might otherwise be unavailable, and by helping businesses establish a foothold in government contracting. Moreover, the proposed sole source contract to an
Alaskan Native Corporation will have a direct and positive impact on the lives of the Alaskan Natives who own the company.
5. A determination that the anticipated cost of the contract will be fair and reasonable:
The anticipated cost for the procurement will be determined to be fair and reasonable using the price analysis techniques in
FAR 15.404-1(b)(2), including: comparisons of proposed prices to historical prices paid, the use of parametric estimating methods, comparisons with competitive published price lists, and comparisons of proposed prices with the independent government cost estimate.
6. Such other matters as the head of the agency concerned shall specify for purposes of this section:
