1) Provide industry questions and FERC answers in response to the solicitation which was issued on 6/03/14.

2) Revise the solicitation to (a) clarify the representations and certifications requirement and (b) clarify that the representations and certifications shall be provided as part of the offeror's price proposal.

Note: Certifications and representations were included in the original solicitation in (a) the combined synopsis/ solicitation and (b) solicitation provision E.7. This amendment provides further clarification.

Accordingly, see pages 2 and 3. The proposal due date remains unchanged at 10:00 AM (EST) July 08, 2014.

1) The FERC received 3 questions in response to the solicitation. The questions and FERC’s responses are provided herein.

Q1. Is this a follow-on requirement? If so, could you please provide the incumbent contract number for this opportunity? If not, is this a new requirement?

A1. This is a follow-on requirement. The incumbent procurement vehicle is a Blanket Purchase Agreement (BPA) with I.M. Idriss; the BPA number is FERC-09-BPA-90384.

Q2. I am not absolutely clear how to structure a “proposal” in response to this solicitation. Is the proposal as required is more a Request for Qualification (RFQ) rather than an RFP?

A2. The solicitation vehicle is a Request for Proposal (RFP). Instructions on how to structure the proposal are provided in (1) FAR 52.212-1 Instructions to Offerors – Commercial Items and (2) an addenda to FAR 52.212-1 which is provided in the solicitation at section E.5 Addendum to FAR 52.212-1 Instructions to Offerors – Commercial Items.

Q3. Is an individual, self-employed consultant considered a “Small Business”, although not officially registered as such?

A3. A company may be comprised of a single individual. The company does not have to “officially register” to be considered a small business. Whereas the NAICS code for this procurement is 541330 (Engineering Services), the small business size standard (as defined in the U.S. Small Business Administration, Table of Small Business Size Standards, dated January 1, 2012) is $14M. Offerors shall indicate their small business status consistent with the solicitations provision E.7 52.212-3, Offeror Representations and Certifications–Commercial Items, with its offer.

The solicitation is amended accordingly in sections 2 through 4 below to clarify that Representations and Certifications shall be either submitted with the proposal or made available through the U.S. Government System for Award Management (SAM).

2) The Combined Synopsis/Solicitation, Page 1 is amended as follows:

Delete the sentence:

Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications–Commercial Items, with its offer.

Replace the above deleted sentence with the following two sentences:

Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications–Commercial Items, with its offer. If the offeror’s annual representations and certifications are current in SAM, the offeror may merely state that the offeror’s representations and certifications are available through SAM in lieu of submitting the annual representations and certifications as part of the offeror’s proposal.

3) Amend the table at Section E.5.1 Section (b) to add Volume 2: Price Proposal, Section III – Representations and Certifications as follows:
