About this file

This document is a Federal Certification Form that outlines the requirements for federal contractors, grant recipients, and loan recipients regarding lobbying activities and the use of federal funds. The certification requires the signatory to attest that no federal funds have been or will be used to influence federal government officials, and that the signatory will disclose any lobbying activities using non-federal funds. The certification also covers requirements related to environmental tobacco smoke and its impact on children's services. The signatory must agree to include this certification language in any subcontracts or subawards. Failure to comply may result in civil penalties.

The document outlines the legal and financial implications for not complying with the certification requirements, including civil penalties of up to $100,000 per violation. The certification must be signed and submitted as a prerequisite for receiving federal funds through contracts, grants, loans, or cooperative agreements.

CERTIFICATION REGARDING ENVIRONMENTAL TOBACCO SMOKE

Public Law 103227, Part C Environmental Tobacco Smoke, also known as the Pro Children Act of 1994, requires that smoking not be permitted in any portion of any indoor routinely owned or leased or contracted for by an entity and used routinely or regularly for provision of health, day care, education, or library services to children under the age of 18, if the services are funded by Federal programs either directly or through State or local governments, by Federal grant, contract, loan, or loan guarantee. The law does not apply to children's services provided in private residences, facilities funded solely by Medicare or Medicaid funds, and portions of facilities used for inpatient drug or alcohol treatment.
