The RFQ solicits qualified firms or individuals to provide proactive federal advocacy services, with a focus on representing WSAFCA's interests and funding program with Congress and federal agencies. The scope of services includes monitoring congressional funding, advocating for WSAFCA's interests, identifying potential legislative impacts, and facilitating communication with federal representatives and agencies such as the U.S. House of Representatives, U.S. Senate, U.S. Army Corps of Engineers, FEMA, and OMB. The RFQ was released on June 17, 2025, with a deadline for questions on June 26, 2025, and a response deadline of July 9, 2025 at 2:00 pm. The initial contract term may be up to 3 years, with potential extensions for up to 3 additional 1-year terms, totaling a possible 6-year contract period.

The RFQ emphasizes a qualifications-based selection process, with evaluation criteria weighted across four key areas: cover letter (10 points), qualifications and experience (30 points), prior work with public agencies (15 points), and project approach (20 points). There is no guaranteed minimum amount of work, and WSAFCA may assign work at its discretion through methods such as sole source selection, competitive quotes, or qualifications-based selection. The agency is seeking a cost-effective approach to supporting its flood protection program, with the final scope of services subject to negotiation. Proposers are required to provide detailed information about their experience, approach, and potential conflicts of interest, and must be prepared to meet specific insurance requirements and provide proof of necessary business licenses and certifications.

1.2. Background

The West Sacramento Area Flood Control Agency (WSAFCA/Agency) was created as a Joint Powers Agreement (JPA) in 1994, to investigate the system of levees that protect the City of

West Sacramento (City), develop a plan to ensure that the levees that protect the city can provide 200-year flood protection, and seek federal funding to implement the plan.

WSAFCA has been instrumental in advancing flood risk reduction projects in advance of federal funding. WSAFCA successfully completed four early implementation projects (EIP) between 2009 and 2017 using local bond funds secured by a flood property assessment and State funding from Proposition 1E, the Disaster Preparedness and Flood Protection Bond Act of 2006. Beginning in 2007, WSAFCA initiated and invested in a series of levee investigations to position the Agency’s eligibility for State and federal funding. Significant deficiencies related to under seepage, through-seepage, and erosion were found throughout the levee system protecting the levee. The United States Army Corps of Engineers Chief’s Report for the West Sacramento Project was completed in 2015 and the project was authorized in 2016 for $1.2 billion through the Water Infrastructure Improvements for the Nations Act. The West Sacramento Project received its first congressionally authorized funding in 2019, and in 2022 received a New Start designation. Since the New Start, congress has approved over $150M toward the West Sacramento Levee Improvement Project (WSLIP).

The levee system protecting the City is interrupted at two locations by the Deep Water Ship Channel (DWSC) that services the Yolo-West Sacramento Port. The DWSC creates unique opportunities and challenges for the City and WSAFCA respectively. The West Sacramento Project includes the levees that surround the City as well as 16 miles of the port navigation levee south of the City’s southern border.

4.7. Incorrect Statement of Qualifications Information

If WSAFCA determines that a respondent has provided, for consideration in the evaluation process or contract negotiations, incorrect information which the respondent knew or should have known was materially incorrect, the SOQ may be rejected by WSAFCA, at its sole discretion.

The Contractor may not subcontract, transfer, or assign any portion of the Contract without prior written approval from WSAFCA. Any subcontractor, subconsultant, or other contracting parties

(collectively, "Subcontractor") must be specifically approved in writing by the Agency. Inclusion of a subcontractor in a Statement of Qualifications does not guarantee the later approval of a Subcontractor.

A. WSAFCA reserves the right, at its sole discretion, to reject any and all Proposals, no matter their level of responsiveness, or to cancel this RFQ in its entirety.

B. WSAFCA reserves the right, at its sole discretion, to waive variances in a Proposal, provided such action is in the best interest of the Agency. Where the Agency waives variances in a Contract, such waiver does not modify the RFQ requirements or excuse the respondent from full compliance with the

RFQ. Notwithstanding any variance, the Agency may hold any Proposer to strict compliance with the

RFQ.

5.4. Proposal of Alternate Services

A Statement of Qualifications for alternate services (i.e., proposals that offer something different from that requested by the RFQ) will be considered nonresponsive and rejected.

5.5. Severability

If any provision of this RFQ is declared by a court to be illegal or in conflict with any law, the validity of the remaining terms and provisions shall not be affected, and the rights and obligations of the Agency and Proposers shall be construed and enforced as if the RFQ did not contain the particular provision held to be invalid.

Proposers to submit evidence of proper licensure and certifications.

5.7. Disclosure of Proposal Contents

All Statements of Qualifications (SOQ) and other materials submitted to the Agency related to this RFQ shall become the property of WSAFCA. Selection or rejection of a SOQ does not affect this right. All SOQ information, including detailed price and cost information, shall be held in confidence during the evaluation and selection process. Upon the completion of the evaluation and selection process, or by rejection of all SOQs, the responses shall be open for review by the public to the extent required by the

California Public Records Act, Government Code section 6254 et seq.. By submitting a SOQ, a respondent acknowledges and accepts that the contents of the SOQ and associated documents shall become open to public inspection.

Portions of a SOQ exempt from public disclosure by law may be protected from public disclosure by the

Agency. A respondent is required to clearly label such portion of a SOQ "CONFIDENTIAL" and list the grounds for non-disclosure. In doing so, the respondent thereby agrees to indemnify and defend

WSAFCA from any action arising from the non-disclosure of the information. The failure to label any information shall constitute a complete waiver of all claims for damages caused by or related to any release of the information.

5.8. Conflict of Interest and Restrictions

By responding to this RFQ, the respondent certifies that no amount shall be paid directly or indirectly to an employee or official of the Agency as wages, compensation, or gifts in exchange for acting as an officer, agent, employee, subcontractor, or consultant to the Proposer in connection with the procurement under this RFQ.

5.9. Proprietary Information

The electronic/master copy of each SOQ shall be retained for official files and will become public record after the award of a contract unless the proposal or specific parts of the proposal can be shown to be exempt by law. Each responding firm may clearly label any part of a SOQ as "CONFIDENTIAL." In doing so, the responding firm thereby agrees to indemnify and defend the Agency. Failure to label any information that is released by the Agency shall constitute a complete waiver of all claims for damages caused by or related to any release of the information.

If a public records request for appropriately-labeled information is received by the Agency, the Agency will endeavor to notify the responding firm of the request and delay access to the material until seven

(7) working days after the Agency’s receipt of the public records request. Within that time delay, it will be the duty of the responding firm to act in protection of its labeled information. Failure to so act shall constitute a complete waiver.
