PART 1 – Intro
The Food and Drug Administration (FDA) has a requirement to procure one (1), National Instruments brand name or equal, wireless test bed for LTE-U/LAA technologies.
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, (STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS) as supplemented with additional information included in this notice. This announcement constitutes the only solicitation.
The solicitation is issued as a Request for Quote (RFQ), using the Simplified Acquisitions Procedures of FAR 13. The solicitation documents incorporated provisions and clauses are those in effect through the current Federal Acquisition Circular: FAC 2005-95.
The associated North American Industry Classification System (NAICS) Code is 334118 Computer Terminal and Other Computer Peripheral Equipment Manufacturing. Small Business Size Standard is 1,000 employees. This acquisition is set aside for small business.
Background Information: Research is currently being done to investigate the wireless coexistence of technologies used in medical devices. LTE-U is one emerging technology that uses existing LTE (cellular) technology in the unlicensed bands to alleviate data congestion on cellular networks. The item needed will allow generated LTE-U signals to be used in wireless coexistence testing of medical devices.

PART 3 –SCIENTIFIC INSTRUMENT’S MINIMM SALIENT CHARACTERISTICS
3.1 General:
The Instrument (combination of hardware and software) should perform wireless transmission of user supplied data using the following technologies: Long Term Evolution in the Unlicensed bands (aka LTE-U) and Long Term Evolution Licenses Assisted Access (aka LTE-LAA). The instrument (combination of hardware and software) should allow capturing and reporting of the wireless transmission statistics
3.2 Detail:
The system must accept arbitrary IP traffic input and generate the appropriate waveforms following LTE-U forum and 3GPP specifications. The system shall provide Key Performance Indicators (KPI) to track the performance of the ongoing wireless communication session and allow measurements for over-the –air power spectral density. The system should provide access to RF front end to facilitate radiated and conducted coexistence testing.
3.3: Warranty:
Hardware: One year
Software: One year warranty which shall include software updates, unlimited telephone and email support and on-line training.
OPTION YEAR SERVICE MAINTENANCE AGREEMENT: FDA requires a base plus option year maintenance agreement to cover the following (Line Item 0007)):
One (1) preventative maintenance inspection shall be performed during the 12 month period with all travel, labor, and parts included. This inspection shall include routine preventative maintenance of the instrument, calibration, electrical safety testing and any other preventative maintenance measures deemed necessary by the vendor
All software updates to the scientific instrument and/or system software and related installation of such instrument updates and/or system software during the Agreement Term
Unlimited telephone support and email support during regular business hours for instrument and applications at no additional charge
Trouble shooting capabilities based on complete knowledge of the entire system, immediate access to certified replacement parts, and immediate access to improvements and new procedures provided by the original equipment manufacturer
A maximum of 2 service repair calls per year which shall include all travel, labor and parts. (service repair calls shall include on-site calls and repairs made at the OEM’s
Respond to requests for emergency on-site service and/or non-emergency requests
(Monday-Friday, excluding vendor and Federal holidays) within 24 hours.
Upon the on-site visit, the contractor shall assess the scientific equipment and determine if the repairs needed to the scientific equipment are covered under the current service maintenance agreement. If the repairs are not covered under the service maintenance agreement, the contractor shall submit a quote to the Government for review and approval or negotiation, which shall include travel costs, parts costs and labor costs. Turnaround time from the emergency on-site visit to completion of repairs shall not exceed 72 hours. Turnaround time from a non-emergency on-site visit to completion of repairs shall not exceed 148 hours.
Repair work that is not covered by the Maintenance/Support Agreement is not to be initiated by the vendor unless the Contracting Officer has given the vendor proper authorization
All maintenance and repair work activities shall be accomplished with reliable formally trained and certified technicians/engineers following Original Equipment Manufacturer (OEM) specifications, manuals, and service bulletins, using OEM replacement parts, components, subassemblies, etc.
One year warranty on all parts and labor
Service Records and Reports: The Contractor shall commensurate with the completion of each service call (inclusive of service/maintenance calls) provide the end user of the equipment with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the names (s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced. In addition, the vendor shall provide monthly reports to the FDA COR and Contract Specialist, not later than the 5th workday following the end of each month, summarizing the maintenance and repair activities for the previous month; negative reports are required.
PART 4 – INSPECTION AND ACCEPTANCE
The Contracting Officer’s Representative (COR) will perform inspection and acceptance of the service maintenance services and if necessary, the repair services to be provided.
4.1. For the purpose of this PART, (COR – TBD) is the authorized representative of the Contracting Officer.
4.2. Inspection and acceptance will be performed at the location identified in 5.2.
Acceptance is communicated in writing unless otherwise indicated in writing by the Contracting Officer or COR within 30 days of receipt.
4.3. This contract incorporates the following clause, 52.246-2 Inspection of Supplies-Fixed Price (Aug 1996) by reference, with the same force and effect as if it was given in full text. Upon request, the Contracting Officer will make its full text available.
PART 5 – PLACE OF PERFORMACE
• Hours of Operation: Monday-Friday, 8:00 AM -5:00 PM Eastern Time
5.1. PERFORMANCE LOCATION:
The system shall be delivered and installed at the following FDA location:

The Contractor shall provide the FDA with a minimum of 3 day scheduling notice prior to the delivery of the system.
The Contractor shall provide the FDA with a minimum of 7 day scheduling notice prior to the preventative maintenance site visit.
Repair to the system can be accomplished onsite or at the OEM’s location.
.PART 6 – CONTRACT ADMINISTRATION DATA
6.1 CONTRACTING OFFICERS REPRESENTATIVE (COR)
The following COR will represent the Government for the purpose of this contract: TBD The COR is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluation as required;
(4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance.
6.1.1 The Contracting Officer is the only person with authority to act as agent of the
Government under this contract. Only the Contracting Officer has authority to:
(1) direct or negotiate any changes in the RFQ; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or
(5) otherwise change any terms and conditions of this contract.

(vi) Terms of any discount for prompt payment offered;

(ix) Taxpayer identification number (TIN);
(x) Electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment and the number of the account into which funds are to be deposited;

(xiii) Contractor is required to attach an invoice log addendum to each invoice which shall include, at a minimum, the following information for contract administration and reconciliation purposes:

(2) corresponding payment amount & date received
(b) total amount of all payments received to date under the subject contract or order
(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance

52.217-9 Option to Extend the term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice anytime prior to contract expiration. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months.
The Contracting Officer may exercise the option by written notice to the Contractor within 60 days.

(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by—

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
