This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued.

The solicitation is issued as a Request for Quote (RFQ), using the Simplified Acquisitions Procedures of FAR 13.

The U. S Food & Drug Administration, Office of Acquisitions and Grants Services is requesting quotes for the procurement of a display characterization system: a computer controlled-system that acquires photometric/colorimetric data at different angles from the emissions of a display device with less than 32inch diagonal. The Government intends to award a Firm Fixed-Price Contract for the items described below.

Provisions and clauses are those in effect through Federal Acquisition Circular 2005-89, effective 14 Jul 2016 Part 1: Background/ Description of Requirements

Background

The FDA CDRH has a requirement for a display characterization system to evaluate the performance of different display systems as they are considered for the viewing of medical images. The system must be a computer controlled-system that acquires photometric/colorimetric data at different angles from the emissions of a display device with less than 32inch diagonal.

All interested companies shall provide quotation(s) for the following:

Salient characteristics:

The display characterization system must include the following:

1. Ability to hold in place a display device for measurement up to 32 inch diagonal.

2. Ability to position a meter or a probe that acquires luminance and spectrometric information from the display emissions.

3. Ability to automatically perform measurements over a range of angles and locations per pre-programmed suite of experiments and user-defined experiments.

4. Ability to record and analyze the information for presentation and display using software that is provided by the vendor.

5. Range of luminance and spectral information to be consistent with display measurements according to standards for characterizing displays.

6. The luminance and spectral measurements should be performed with a large number of band-pass filters ideally larger than 14, covering a spectral range from 400 to 700 nm.

7. Equipment must be fully motorized for adjustment and automatic measurements and include angular range of at least 0-60 degrees from the display surface perpendicular. The measurements of angular emissions should be performed at all azimuthal angles.

8. Ability to provide the capability of measuring the display reflection coefficients.

Installation:

· Vendor shall install the device at the place of performance

· Installation will include setting the machine up and performing installation and operational qualification.

Training:

· Vendor shall provide initial training for operators to independently operate the instrument. This is not a request for formal training, but rather the support typically provided to new users of instruments. This informal initial training may occur during installation or through online/telephone support. This training session should include the following training objectives:

1. Provide guidance to operators on the proper use of the instrument;

2. Any routine maintenance required by the users;

3. Any safety and related safeguards as deemed appropriate;

4. Information on what the users should do if the unit is not functioning properly and

5. Other topics deemed necessary by the vendor

Warranty: Entire list of items must be warranted for parts and labor for 12 months from date of acceptance.

Delivery: Entire list of items must be shipped FOB Destination. The vendor is responsible to deliver the instrument to the address provided below.

Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer / System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(I) Name and address of the contractor;

(ii) Invoice date and invoice number;

(iii) Purchase order/award number;

(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:

(a) period of performance for which costs are claimed;

(b) itemized travel costs, including origin and destination;

(c) any other supporting information necessary to clarify questionable expenditures;

(d) The contractor shall include the Contract Line Item/Funding line item number for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed

(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;

(vi) Terms of any discount for prompt payment offered;

(vii) Name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment);

(viii) Name, title, and phone number of person to notify in event of defective invoice;

(ix) Taxpayer identification number (TIN);

(x) Electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment

(xi) Name and telephone number of the FDA Contracting Officer (CO) and the Contracting Officer's Representative (COR) or other program center/office point of contact, as referenced on the order/contract;

(xii) Any other information or documentation required by the purchase order/award.

An electronic invoice shall be in adobe acrobat (PDF) format. All items listed in (i) through (xii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

The following solicitation provisions apply to this acquisition:

A. 52.212-1 (Instructions to Offerors - Commercial Items) (October 2015) applies to this acquisition.

1. The vendor shall provide technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary. The government is not responsible for locating or securing any information which is not identified in the proposal.

2. All deliverables required under this contract shall be packaged, marked and shipped in accordance with Government specifications. At a minimum, all deliverables shall be marked with the contract number and contractor’s name. The Contractor shall guarantee that all required materials shall be delivered in immediate usable and acceptable condition.

3. Price Quotes shall be FOB Destination inclusive of shipping and handling expense

4. Offeror shall include a price breakout for all components for Item 001 through Item 004 extended total, to include detailed description, catalog part/number, quantity, and unit price of each item. All or none.

5. It is the responsibility of all interested offerors to review this site frequently for any updates/ amendments that may occur during the solicitation process. The posting of this requirement does not obligate the Government to award a contract nor does it obligate the Government to pay for any proposal preparation costs. The Government reserves the right to cancel this procurement/ solicitation either before or after the solicitation closing date, with no obligation to the offeror by the Government. The Government will issue a contract to the responsible, responsive offeror, with acceptable past performance, submitting the lowest price. All prospective contractors must be registered in the System for Award Management in order to be eligible for contract award. For registration, go to www.sam.gov and follow the instructions.

B. FAR Provision 52.212-2 Evaluation - Commercial Items (OCT 2014) applies to this acquisition. Award will be made to the Lowest Priced Technically Acceptable Offeror

C. FAR Provision 52.212-3 “Offeror Representations and Certifications - Commercial Items” (July 2016) Offerors must complete annual representations and certifications online at http://orca.bpn.gov in accordance with FAR 52.212-3, “Offerors Representations and Certifications—Commercial Items.” If paragraph (j) of the provision is applicable, a written submission is required.
