This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation is being issued in conjunction with FAR Part 13 - Simplified Acquisition Procedures. The solicitation number is FDA- RFQ-1238565. This solicitation is issued as a Request for Quote (RFQ).
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-03 effective February 16, 2021.
The associated North American Industry Classification System (NAICS) code for this acquisition is 334516 Analytical Laboratory Instrument Manufacturing; the applicable Small Business Size Standard is 1000 Employees. This requirement is solicited as a Total small business set-aside; only small businesses under the applicable NAICS may submit a quote.
Background and Requirement
The U.S. Food and Drug Administration’s (FDA), Office of Regulatory Affairs (ORA) requires upgrades to its wireless Temperature Monitoring System. The Arkansas Laboratory (ARKL) currently uses the Mesa Laboratory Inc, ViewPoint Temperature Monitoring System Software, which provides automated wireless temperature monitoring of refrigerators, freezers, incubators, water baths, and ovens to meet requirements for monitoring analytical critical control points in accordance with its ISO/IEC 17025:2017 and the Association of Official Analytical Chemists (AOAC) guidelines and Office of Regulatory Science’s (ORS) Quality Management System. The associated Mesa Labs/TempSys CheckPoint hardware currently in use is approaching its life expectancy and will no longer be supported. The Government has a requirement to replace the temperature monitoring system hardware that can be used with all or most of the software currently owned and installed in the ORS laboratories. The FDA’s Office of Regulatory Science, ARKL, requires that the new hardware be compatible with the ViewPoint software which is currently in use. The new hardware, in conjunction with the ViewPoint software will allow for increased point of use temperature monitoring, increased storage of temperature readings, and offers an immediate view of temperatures during any power outage. These upgrades are necessary for the monitoring system to be able to function in today’s technological environment and to meet new and ever-increasing stringent regulatory concerns.
The Offeror shall provide all resources necessary to accomplish the tasks and deliverables described herein. The Offeror shall provide hardware that is compatible to existing ViewPoint software to standardize temperature monitoring across ORS and the Office of Information Management and Technology (OIMT). The Offeror shall provide installation, conduct all Initial Qualification/Operation Qualification (IQ/OQ) and provide training as required on the upgraded equipment. As ARKL currently has the ViewPoint software associated with the temperature monitoring system, no software is required with this procurement. Vendor shall provide all hardware identified in the equipment list, install all hardware necessary for the system to function as intended, and conduct functionality verification check(s) as required. This acquisition also includes the requirement for four (4) years of post-warranty maintenance on the hardware or system, depending on what is quoted.
Schedule of Supplies or Services and Prices/Costs. Pricing shall be inclusive of shipping and installation to the ARKL at 3900 NCTR Rd, Building 26, Jefferson AR 72079.
Upgrade TempSys CheckPoint temperature monitoring system hardware, as set forth herein, which shall include the following parts and services.
While the items below are indicative of the parts and services the government estimates are required to upgrade the system in use at the Arkansas labs, this is only an estimate of what will be required for the system upgrade. Offerors/quoters are afforded the opportunity to inspect the existing equipment and site, at their own expense, prior to the date set for receipt of quotes by contacting the Contract Specialist/Contracting Officer identified herein to schedule an appointment. Failure to inspect the site will not relieve the successful offeror from fully meeting the requirements of the resulting contract at the price offered.
Line Item 1: System Upgrade/Equipment Items: While ViewPoint hardware is specified, offerors/quoters may propose “or equal” hardware as long as it is compatible with and will seamlessly integrate with the laboratory’s existing ViewPoint software.

FAR Full Text Provisions
The provision at FAR 52.212-1 Instructions to Offerors - Commercial Items (June 2020) applies to this solicitation. The following addenda apply:
It is the offeror's responsibility to monitor the Government Point of Entry (GPE) beta.sam.gov for information relevant to this solicitation, e.g., questions and answers, amendments, etc. An official authorized to bind the Offeror must sign the terms and conditions of the offer. Offerors that fail to complete the required representations and certifications or reject the terms and conditions of the solicitation may be excluded from consideration.
Offerors are afforded the opportunity to inspect the existing equipment and site, at their own expense, prior to the date set for receipt of quotes by contacting the Contract Specialist/Contracting Officer identified herein to schedule an appointment. Failure to inspect the site will not relieve the successful offeror from fully meeting the requirements of the resulting contract at the price offered.
Paragraph (b)(4). Technical Capability: It is incumbent that offerors unequivocally demonstrate that offered equipment meet the requirements herein through the submission of technical specifications, descriptive material, scientific literature, brochures, scientific publications where the proposed solution has been used for same or similar purposes, and other information which demonstrates the acceptability/technical capability of the offered equipment/services. Contractor quotes shall clearly identify and quantify the components and configuration of what their proposed system shall include if it differs from the FDA’s equipment list identified herein.
Offerors are also permitted to propose a new laboratory monitoring system for both hardware and software equal to that of the current system hardware and software; however, it is believed that proposals lending themselves to this strategy will likely be prohibitively expensive compared with just purchasing the hardware upgrade.
The Quoter shall submit a written Accessibility Conformance Report (ACR) for each item not in compliance with 508 standards identified in clause 352.239-74, describing how the item(s) will fully address the accessibility requirements outlined in the solicitation; and a description of the evaluation methods the offeror will use to validate for conformance to the Revised 508 Standards. The ACR should be based on the Voluntary Product Accessibility Template Version 2.0 (MS Word) provided by the Industry Technology Industry Council (ITIC). For this requirement we anticipate only deliverables/reports and invoices to be applicable to the requirement unless software becomes part of the purchase package.
NOTE: Submission of the ACR is required for documentation purposes. In accordance with agency purchasing procedures, solutions which do not conform fully to the applicable 508 standards may still be purchased by FDA if the FDA Requiring Office obtains the appropriate approval. In order to obtain approval, the FDA must have an ACR from the vendor documenting the level of conformance of the items being purchased.
Offerors shall submit the following information for MAT List approval:
• Version/Model number of the proposed software.
• Description of what your software does (if the software contains a suite of products, please provide the function of each product contained within the suite).
• Website URL for Software
Paragraph (b)(10). Past Performance: Contractor shall provide references to at least two previous projects where a same or similar temperature control system was sold and installed. For each project, include a thorough description of the project and the name, telephone number, email address of someone who has knowledge of the project and would be available to answer any follow-up questions the Government might have.
Past performance information shall clearly demonstrate recent (within the past 3 years) and relevant experience in providing same or similar products and services, to include a brief description of service performed, contract number(s), dollar value, client points of contact names, and client points of contact email addresses and phone numbers. The Government reserves the right to look to other sources of information (e.g., the Contractor Performance Assessment Reporting System (CPARS), etc.) to support past performance evaluations.
Price: Price(s) proposed shall represent the offeror’s response to the schedule of supplies/services above. Price shall be detailed and supported by a breakdown of all items required for system operation.
(Offerors shall fill in the schedule above with the total system price and provide a detailed quote in their own format.) Offeror shall indicate any discounts offered.
Proprietary and/or confidential information shall be clearly marked. Respondent’s DUNS number shall be included with quote.
The Contractor’s quote shall also clearly show that the Contractor has selected the appropriate certification under FAR 52.222-48.
Note: The solicitation is being issued under the premise that the Offeror certifies that the service it will propose to fulfill this requirement are exempt from the Service Contract Act per the conditions set forth in FAR 52.222-48 & FAR 22.1003-4(c). Based on this premise that the Offeror certifies that its proposed services are exempt under the terms and conditions of 52.222-48, FAR clause 52.222-51-Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment—Requirements will be applicable to the resulting order. In the event that an Offeror determines its proposed services do not meet the exemption, they are to expressly notify the Contracting Officer in their quotation and the traditional Service Contract Act clauses 52.222-41, and 52.222-43 shall be included in the resulting order award as well as Wage Determination WD 2015-5121 (Rev. 13) Revision date: 12/21/2020. The applicable wage determination can be located here: https://beta.sam.gov/wage-determination/2015- 5121/13?index=wd&keywords=&is_active=tru
The provision at FAR 52.222-48 Exemption from Application of the Service Contract to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-Certification (May 2014) applies as follows:
(a) The offeror shall check the following certification:
CERTIFICATION
The offeror [ ] does [ ] does not certify that-
(1) The items of equipment to be serviced under this contract are used regularly for other than Government purposes, and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontractor) in substantial quantities to the general public in the course of normal business operations;
(2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment.
(i) An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available https://beta.sam.gov/wage-determination/2015-5121/13?index=wd&keywords=&is_active=tru https://beta.sam.gov/wage-determination/2015-5121/13?index=wd&keywords=&is_active=tru for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public.
(ii) An "established market price" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and
(3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers.
(b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Act-
(1) Will not apply to this offeror, then the Service Contract Act of 1965 clause in this solicitation will not be included in any resultant contract to this offeror; or
(2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-- Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis.
(c) If the offeror does not certify to the conditions in paragraph (a) of this provision-
(1) The clause in this solicitation at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment--Requirements, will not be included in any resultant contract awarded to this offeror; and
(2) The offeror shall notify the Contracting Officer as soon as possible, if the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation.
(d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision.
Microsoft Suite Documents Containing Macros The offeror or applicant shall submit all electronic documents created by Microsoft Office suite products without the use of “macros”. If the offeror or applicant submits documents that contain macros the Government will not be able to view or open such documents and the submission will be considered non-responsive to the solicitation. No additional time will be given to an offeror or applicant to correct the document submission and the Government will not inform the offeror or applicant that their submission is non-responsive prior to award. It is the offeror’s or applicant’s responsibility to ensure that all electronic documents submitted do not contain or otherwise use macros.
The provision at 52.212-2 Evaluation-Commercial Items (OCT 2014) is applicable to this solicitation.
The following subparagraph (a) factors apply:
(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer/quote conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) Technical Capability (see FAR Provision 52.212-1 (b)(4) and addenda thereto)
(2) Past Performance (see FAR Provision 52.212-1 (b)(10) and addenda thereto)
(3) Price
Technical Capability (i.e., how well the proposed products/services will meet or exceed the Government’s requirements) and past performance (i.e., when, what, and how well), when combined, are relatively equal in value and collectively more important than price in determining the best value to the government, although price remains a significant consideration. If the Government determines non-price factors to be essentially equal among competing offerors, price becomes more important as a discriminating factor. The Government is more concerned with obtaining superior performance capability rather than lowest overall price. However, the Government will not make an award at a significantly higher overall price to achieve only slightly superior performance.
Technical Capability will be determined by review of information submitted by the offeror which must provide sufficient technical information necessary for the Government to conclusively determine that the offered equipment and/or services meet or exceed the technical requirements identified herein. Contractor quotes shall clearly identify and quantify the components and configuration of what their proposed system shall include if it differs from the FDA’s equipment list identified herein.
The Government's determination of technical acceptability in no way relinquishes the Awardee's contractual obligation to ensure the equipment and services meet the FDA’s stated need.
Past Performance: Contractor’s Past Performance will be evaluated to determine the likelihood of success a contractor will have in satisfactorily performing this requirement to upgrade the temperature monitoring system hardware at the Arkansas Labs.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
The government is not responsible for locating or securing any information which is not identified in the proposal/quote; the Government reserves the right to obtain information for use in the evaluation from any and all sources including sources outside of the Government.
The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (February 2021)(DEVIATION 2020-05), applies to this acquisition.
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.
