Part 1 – Description The U.S. Food and Drug Administration’s (FDA) Center for Food and Safety and Applied

Nutrition (CFSAN) is requesting to purchase “Conviron Model GR128 Plant Growth Room” for the produce safety consortium projects. This is a solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Part 12.603. This announcement constitutes the only solicitation; quotes are being requested, and a separate written solicitation will not be issued.

This solicitation is a Request for Quote (RFQ) using FAR Parts 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular (FAC) 2020-07 July 02, 2020. The North American Industry Classification

System (NAICS) code for the proposed acquisition is 334516 Analytical Laboratory Instrument

Manufacturing, Small Size Standard 1,000 Employees. This requirement set-aside for small business only.

This requirement is to supply “Conviron Model GR128 Plant Growth Room”.

Payment is only authorized for the respective firm-fixed-price upon successful completion of the respective CLINs, including delivery and acceptance of all deliverables, as determined by the FDA Contracting Officer’s Representative (COR) according to the Statement of

Work, and upon submission of a proper invoice. Proper invoice submission includes following the invoice instructions below.

Part 3 – Description/Specifications

3.1 Background

Science-based regulations are the core of the Food Safety Modernization Act. The equipment shall be used to generate data that represents real-life growing conditions of covered produce (as defined on the Produce Safety Rule) and their interaction with human pathogens of concern

(bacteria, virus, and parasites) that represent an on-going threat to the health and well-being of the

US consumers that look into improving their nutrition intake by consuming fresh fruits and vegetables. The OARSA research teams will be generating research protocols and providing data to answer questions postured by the CFSAN program offices and aligned with the CFSAN FY

2020-2025 Regulatory Research Strategic Plan of the Office of the Center Director.

3.2 Objective

The objective of this requirement is to acquire a CONVIRON Model GR128 Chamber that simulates real-life growing conditions of covered produce and the survival on the soil, their transfer to the edible portion of the crop, and the interaction of foodborne pathogens with their environment, instead of using surrogate organisms, to provide science-based answers that drive the agency policy on produce safety.

3.3 Requirements

The equipment shall meet the following technical requirements:

• The equipment shall have an interface that is reliable, flexible and user friendly.

• The chamber control system shall be a PLC (programmable logic controller) based control system.

• The equipment shall provide reproducible results among runs.

• The equipment shall be capable of storing up to 16 real-time user-entered programs each containing up to 48 lines with one-minute resolution. Each program defines a single 24-hour period. Programs are then entered into a “Schedule” (a sequence of up to 8 program entries) to create a single day, multi day, or seasonal schedule.

• Chamber data shall be available both locally and remotely. The data available at the local display screen includes up to seven chamber variables such as temperature, humidity, lighting and CO2. Parameters are logged every 30 seconds and can be viewed in the form of trend graphs at the chamber display. Remote data is logged automatically and can be set in multiples of 6 seconds regardless of the number of parameters. Remote data is accessed by either a network connected PC, an internet enabled PC or a Conviron central management system. Up to fifteen days of trend data can be downloaded through the USB port of the chamber touch screen..

• The control system shall include audible and color coded visual alarms. User-settable absolute alarms for all controlled processes and user-settable process tracking alarms for temperature shall be available.

• The equipment shall be password-protected reserved for users, administrators and service personnel.

• The equipment shall be programmed with varying restart times to reduce start-up loads after a power failure.

• Chamber shall include alarm contacts for connection to a building management system.

• Equipment exterior dimensions: 11'7"W x 17'4"D x 8'6¼"H (3530mmW x 5285mmD x

2600mmH.

• Equipment Interior Dimensions: 10'8½"W x 16'8"D x 6'2½"H (3265mmW x 5080mmD x

1895mm).

• Growth Area: 128ft² (11.9m²).

• Growth height of 80” (2030mm) from floor to Lightright in the UP position.

• Wall panels of bonded paneling construction with 4” (100mm) of foamed-in-place CFC-free polyurethane insulation.

• Exterior finish: White enamel baked on stucco 26ga. Galvanized steel.

• Interior finish: White enamel baked on smooth 24ga. Galvanized steel.

• All panels assembled from interior with camlock fasteners.

• Chamber shall include insulated galvanized steel floor. (note that the galvanized floor decreases interior height by 4”).

• Chamber shall include a 2A wall mounted convenience electrical receptacle within growth area.

• Observation window: Dual pane with light tight cover 14”x 14” (355mm x 335mm).

• The equipment shall include 3 level programming of lamps with a 600 micromoles/m²/s using four (4) nominal 47" x 96" (1195mm x 2440mm) lamp canopies. Each canopy shall be independently counterbalanced and adjustable, from 18” to 80” from the floor. .

• LED light fixtures shall be Fluence Physiospec Indoor broad spectrum and Fluence PFr spec far red fixtures.

• Broad spectrum fixtures are controlled by closed loop dimming. Far red fixtures are independently controlled by open loop dimming.

• Chamber shall include a Quantum light meter for display and recording of light output.

• The equipment shall be able to control temperature with a range of -5°C to +25°C lights

OFF; -5°C to +35°C lights ON (No fresh air below 8°C.) A defrost cycle will occur resulting in a temperature increase (spike) for temperatures set below +8°C lights ON/OFF.

• Chamber shall include variable fan speed control on conditioning unit from 50% to maximum.

• The chamber shall include a water-cooled condensing unit with hot gas bypass system for continuous compressor operation and close temperature control. The condensing unit shall be floor mounted next to the chamber. The refrigeration system uses an electronic 3-way modulating valve to regulate the temperature function of the chamber.

• Refrigerant shall be CFC-free R448-A with low GWP.

• Refrigeration system operation shall be monitored by the chamber control system including visual and audible alarm. Pressure transducers on refrigeration system allow for real-time diagnosis for preventative maintenance and repair.

• The chamber shall include a water cooled condensing unit with hot gas bypass system for continuous compressor operation and close temperature control. The condensing unit shall be floor mounted next to the chamber. The refrigeration system uses an electronic 3-way modulating valve to regulate the temperature function of the chamber.

• Refrigerant shall be CFC-free R448-A with low GWP.

• Refrigeration system operation shall be monitored by the chamber control system including visual and audible alarm. Pressure transducers on refrigeration system allow for real-time diagnosis for preventative maintenance and repair.

The equipment shall be able to control humidity resultant to a range of up to 90% RH lights OFF and 85% RH lights ON limited by a 25C maximum dew point in an empty chamber. Based on

21C and 50% RH ambient condition. No humidity control below 4C.

The company shall be capable of providing training on the equipment and the authorized warranty service provider must be located within 50 miles of Laurel, MD. The entire chamber shall be

CSA-certified with a CSA certification mark indicated on the chamber.

Part 4 –Performance and Deliverables

4.1 Delivery

The vendor is responsible for delivery of the Conviron Model GR128 and all components specified above. The project officer will perform inspection and acceptance of the Conviron

Model GR128.

The vendor shall cover all costs associated with the following:

• Crating and shipping shall be included in this proposal to the delivery address.

“IMPORTANT NOTE: Due to the ongoing COVID-19 pandemic and related measures to combat the spread of novel coronavirus which include alternative work arrangements (i.e., remote telework) and/or worksite closures, the Contractor is advised that the delivery date stated in this contract is subject to availability of Government personnel to receive and/or accept the goods or services at the Place of Performance described herein. The Contractor shall coordinate, in advance, any deliveries required under this contract, including any services deliverables, with the

Contracting Officer's Representative (COR) or Contracting Officer to ensure that Government personnel are available at the Place of Performance to receive and/or accept the goods or services.

Any delays as a result of non-availability of Government personnel at the Place of Performance shall be governed by FAR 52.212-4(f) “Excusable Delays” (for Commercial Items/Services) or

FAR 52.249-14 “Excusable Delays” (for Non-Commercial Items/Services). The Government shall not be responsible for any costs incurred for contract deliverables for goods or services that have not been coordinated in advance with the COR or Contracting Officer pursuant to this paragraph.”

Place of Performance and Work Hours

Delivery should be coordinated through the Contracting Officer Representative. Delivery shall be conducted Monday through Friday, excluding federal holidays during the times of 9.00 AM to

4.00 PM EST, and no weekend delivery. Contractor shall provide at least 72 hours’ notice for delivery of the items to the laboratory facility. All delivery crew must have a valid U.S. Driver’s license for entry through security.

Inspection and Acceptance Criteria

The Contracting Officer Representative (COR) will perform inspection and acceptance of all items specified and services to be provided. The COR – to be determined upon contract award - is the authorized representative of the Contracting Officer.

After the delivery of the assay kits, the Government shall have 30 working days to inspect and verify that the items are operational and functional.

Security

Government shall provide escort of the service engineer to install the CONVIRON Model GR128

Chamber. The engineer shall not be provided access to any material that involves Non-Public positions and involves the lowest degree of adverse impact on the efficiency of the Agency. This position does not require a badge or access to FDA’s network.

Period of Performance

The vendor is responsible for delivery of all components specified above to FDA/CFSAN laboratory facility.

Warranty/Preventative Maintenance Service Agreement

Warranty: Vendor must offer a minimum two (2) year warranty for Conviron Model GR128 from defects. Following initial warranty/service/technical support coverage, the FDA shall have a unilateral right to exercise optional periods to extend the warranty/service agreement to include preventative maintenance.

Optional Periods

Deliverable Period of Performance

Option Period 1 Begins at the expiration of the base period (24 months warranty period) and will end after one year.

Option Period 2 Begins at the expiration of the 1st option period and will end after one year.

Option Period 3 Begins at the expiration of the 2nd option period and will end after one year.

Entire system must be warranted for parts and labor for two (2) years from date of acceptance, including one PM visit to occur approximately 1-3 months before the original warranty expires. Warranty service should be equivalent to the maintenance agreement requested in the next section.

Option Year Maintenance Agreement: As part of this purchase, CFSAN seeks an option year maintenance agreement for four option years, beginning on the date of installation and acceptance. This shall not obligate CFSAN to purchase the extended warranty.

Part 5 –Contract Administration

5.1 Administrative Points of Contact

Contracting Officer’s Representative

For this PART, (COR TBD) is the authorized representative of the Contracting Officer.

The Contracting Officer’s Representative (COR) will perform inspection and acceptance of assay kits and services to be provided.

The COR is responsible for the following as required by this order: (1) monitoring the

Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations;

(4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as an agent of the Government under this order. Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses

Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(i) Name and address of the contractor;

(ii) Invoice date and invoice number;

(iii) Contract/Order number (including a reference to any base award for Indefinite-

Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);

(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:

(a) period of performance for which costs are claimed;

(b) itemized travel costs, including origin and destination;

(c) any other supporting information necessary to clarify questionable expenditures;

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
