The following are the submitted questions and the Government’s responses to those questions in regards to FDA-RFP-1168334:
Question 1 Can companies from Outside the USA apply for this contract?
Response 1 A company/entity from outside the United States may propose in response to the solicitation if the company/entity is established in a Trade Agreements Act-designated country and complies with the Trade Agreements Act, FAR Part 25, and other applicable law.
Question 2 Do vendors need to come over there for meetings?
Response 2 As established in the RFP at Section 2.4.3.1, the kick-off meeting shall be at the contractor’s office/facility. Further, as stated at Section 8.6, “No travel costs are expected to be incurred under this solicitation. Nonetheless, in the event that reimbursable travel costs are incurred, costs for lodging, meals, and incidental expenses incurred by Contractor personnel shall be considered to be reasonable and allowable only to the extent that such costs are in accordance with FAR 31.205-46 and the Federal Travel Regulation, and do not exceed the per diem rates set forth in the Federal Travel Regulation.” (RFP at 27.) Accordingly, vendor travel is highly unlikely under the contemplated contract.
Question 3 Can we perform the tasks (related to RFP) outside USA?
Response 3 Again, any performance of the contract involving services provided from outside the United States must comply with the Trade Agreements Act, FAR Part 25, and other applicable law.
Question 4 In the past performance section of the RFP it asks the offer to submit for evaluation its best performance example of a contract that is similar to the work that will be performed under this solicitation. In what format should we provide the example? We could provide a summary, an outline, a statement of work or a report.
Response 4 Section 12 of the RFP states the following regarding the proposal-provided performance example.
Include the following information for the performance example provided:
1. Name of Purchasing/Contracting Organization
2. Contract Number
3. Contract Type
4. Total Contract Value
5. Description of Requirement (The burden is on the offeror to make representations which clearly show that the past requirement is similar to the what is sought under this solicitation.)
6. Contracting/Purchasing Official’s Name and Telephone Number
7. Program Manager’s Name and Telephone Number
The offeror may include information as to how well the contractor performed, including information as to problems encountered and the offeror’s corrective actions and results.
(RFP at 40.) Keep in mind, although your customer-completed past performance questionnaire does not count toward the 10-page proposal limitation, your proposal-provided description of the past performance example does. As to format for the proposal-provided past performance description, that is up to the individual offeror. However, recall that past performance is being assessed on a pass/fail basis.
