Part 3 – Description/Specifications
3.1 Background
On June 22, 2009, President Barack Obama signed into law the Family Smoking Prevention and
Tobacco Control Act. This historic legislation granted the U.S. Food and Drug Administration
(FDA) the authority to regulate tobacco products. The FDA then established the Center for
Tobacco Products (CTP) to regulate the manufacture, marketing, and distribution of tobacco products to protect public health and to reduce tobacco use by youth. CTP oversees the implementation of the Family Smoking Prevention and Tobacco Control Act. On August 8, 2016, the U.S. Food and Drug Administration finalized a rule that extends its regulatory authority to all tobacco products, including e-cigarettes, cigars, and hookah and pipe tobacco, as part of its goal to improve public health.
The mission of the Office of Science is to develop, evaluate, and apply the science that informs and supports the regulatory and other public health goals and objectives of the Center for Tobacco
Products (CTP). The staff includes scientists in the fields of toxicology, chemistry, engineering, microbiology, environmental science, behavioral and clinical pharmacology, epidemiology, social science, evaluation, medicine, and policy evaluation.
3.2 Objective
For CTP to effectively regulate the swiftly changing marketplace for Electronic Nicotine Delivery
Systems (ENDS), the Center must have full knowledge and understanding of the US and international markets, including market characteristics, and the overall regulatory environment.
Such knowledge and understanding requires the Center to be able to measure and compare incidence and usage rates, market size, product form adoption, online and offline pricing, distribution channels, domestic and foreign product marketing regulation, taxes, and points of contact. Effective regulation necessitates a full knowledge of the history and status of these factors and how they affect the market domestically and internationally.
CTP has a contract with ECigIntelligence, a comprehensive source known for Electronic Nicotine
Delivery Systems (ENDS) market data, international and domestic regulatory status, business information, tobacco relevant news, product data, and knowledge. ECigIntelligence provides information it collects, collates, and summarizes on a continuous basis with regular updates to its website and through regular emailed reporting.
The objective of this contract is to obtain additional data and information on tobacco product sales from vape shops and tobacco product use among vapers to complement what CTP currently obtains through E-Cig Intelligence, including deidentified raw data and information from 1) “US
Vape Store Survey;” and 2) “US Vape product Consumer Survey.”
