Background and Requirement

The mission of the Division of Cell and Gene Therapy (DCGT), Office of Cellular, Tissue and Gene Therapy (OCTG), located within the Food and Drug Administration’s (FDA) Center for Biologics Evaluation and Research (CBER), is to develop and promote technology for safer cell and gene therapy products to improve public health. Researchers need to identify and characterize gene and cell therapy products to perform critical path research for its mission to develop and promote technology to regulate cellular and genetic therapeutics. Genetically modified Hematopoietic Stem Cells (HSCs) and T-cell are at the forefront of advanced and complex cellular therapeutics. However, the current methods used to generate cellular therapeutic products for proof-of-concept or early phase clinical studies may not directly translate to commercial-scale manufacturing, yields, and cost-effectiveness.

In cell therapy, the final product is the cells themselves and our knowledge on their mechanism of action, potency, efficacy, and safety is currently limited. Most importantly, how ex vivo cultivation, manipulation, and manufacturing steps affect the cellular properties, functions, and behavior are currently unknown. Therefore, it is becoming increasingly necessary to extensively characterize these products, and to understand the impact of ex vivo cultivation on the behavior and functions of HSCs and other cell types. This requirement is for a stand-alone, fully-automated multiplex gene expression profiler instrument capable of analyzing multiple rNA, DNA, and protein targets. 4 option years of preventive maintenance-repair service for the instrument are also required.

Minimum Technical Requirements are as follows for a stand-alone, fully-automated multiplex gene expression profiler instrument capable of analyzing multiple rNA, DNA, and protein targets:

1. Shall be a stand-alone, fully-automated DNA-RNA-protein analyzer; shall be an integrated system to include cartridge, reagents, probe sets, and availability of pre-designed probe sets and reagents;

2. Shall be capable of gene and protein analysis expression in a multiplex assay where up to 800 genes and proteins are analyzed in a single run, and capable of handling a minimum of 12 samples per run;

3. Shall be capable of analyzing more than one biomolecule at a time;

4. Shall function on enzyme-free chemistry with no amplification steps required;

5. Shall be capable of analyzing crude cell lysate sample input without further processing;

6. Shall be capable of working with very small input samples, i.e., 25 ng of material;

7. Shall include a minimum 1-year full manufacturer’s warranty;

8. Shall include shipping, installation and training.

Installation, Training and Additional System Requirements:

1. System shall be warranted for not less than one (1) year from FDA acceptance, to include on-site training. Warranty service shall include troubleshooting capabilities based on complete knowledge of the entire system, immediate access to replacement parts, and immediate access to system improvements and updates. Phone and email technical support shall be included for the duration of the warranty period;

2. The components and equipment may be newly manufactured or refurbished; if refurbished, offeror shall specify date of refurbishment and year of manufacture; certification of functionality and/or OQ/CQ shall be furnished at time of award.

3. The system shall be delivered with all necessary supplies and accessories required for installation and start-up;

4. The system and associated accessories shall include operations and maintenance manuals covering proper operation, routine maintenance, and troubleshooting for the system and controlling software. All manuals and documentation shall be provided in hard copy and/or electronic format;

5. The contractor shall provide guidance on pre-installation site requirements;

6. The contractor shall provide installation and setup;

7. Contractor shall provide onsite training on the system.

Minimum Technical Requirements are as follows for preventive maintenance-repair service for a stand-alone, fully-automated multiplex gene expression profiler instrument capable of analyzing multiple rNA, DNA, and protein targets:

*Shall include at least one (1) planned on-site preventive maintenance visit for routine preventive maintenance, certification and/or calibration per contract year;

*Access by the FDA Technical Representative (TR) and system operator personnel to the manufacturer’s call center for technical assistance, which is staffed by senior engineers to provide a high level of expertise for troubleshooting the instrument;

*Corrective/remedial repair visits within 3-5 business days of call for service (for issues that can’t be resolved remotely via phone or Internet); troubleshooting activities shall include spare parts replacement where required and allowed;

*Priority access to technical support (e-mail and telephone) Mondays - Fridays (excluding Federal Holidays) between the hours of 7:00 AM - 5:00 PM Eastern (Prevailing) Time;

*All preventive maintenance service pricing shall be inclusive of labor, travel, replacement parts, components, subassemblies, etc.

Service Records and Reports *The Contractor shall, commensurate with the completion of each preventive maintenance or repair service visit (inclusive of warranty service), provide the end-user of the equipment with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced, a detailed description of the work performed, the test instruments or other equipment used to perform the service, the name(s) and contact information of the technician who performed the service, and for information purposes, the on-site hours expended, and parts/components replaced. In addition, the Contractor shall provide a written report to the FDA Technical Point of Contact (TPOC) and Contract Specialist, summarizing all maintenance activities (including warranty work) each time service is performed.

The provision at 52.212-2 Evaluation-Commercial Items (Nov 2021) is applicable to this solicitation.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. For the purposes of this solicitation, “Most advantageous to the Government” is defined as lowest price technically acceptable (LPTA). Offers will be evaluated on their ability to meet the requirements provided herein. The lowest priced offer will be evaluated first.

If the lowest priced offeror is not technically acceptable, the next lowest priced offer will be evaluated and so on until a technically acceptable offer is determined.

Technically acceptability will be determined by review of information submitted by the Offeror which shall provide all descriptive material necessary for the government to conclusively determine that the instrument and services offered will satisfy the Government’s requirements and demonstrate successful performance of the products described herein.

Quotes shall include technical specifications, descriptive material, literature, brochures and other information corresponding to each minimum required item, which demonstrates the capabilities of the offeror. For services, quotes shall also include a brief description of service performed, contract number(s), client points of contact names, and client points of contact, email addresses, and phone numbers. The government is not responsible for locating or securing any information, which is not identified in the proposal.

The Government's determination of technical acceptability in no way relinquishes the Awardee's contractual obligation to ensure the supplies meet the FDA’s stated need.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services (Nov 2021)(DEVIATION 2020-05), applies to this acquisition.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
