About this file
This Justification and Approval (J&A) document supports a sole-source contract with Honeywell International Incorporated for a new manufacture of Aircraft Air Conditioning System Water Separators (NSN: 1660-01-209-1557) to support F-16 aircraft. The contract is for 15 units at a redacted unit price, with a total estimated value under $750K, and an anticipated award date of 14 September 2024. The acquisition is being conducted by DLA Aviation/AOA at Tinker AFB, Oklahoma, under Purchase Request FD2030-23-01238.
Market research and sources sought synopses conducted in March 2023 revealed no alternative commercial or non-developmental substitutes available. Honeywell is deemed the only responsible source due to their exclusive possession of the technical data, tooling, and manufacturing capabilities required to meet the government's specifications. The government attempted multiple times to obtain manufacturing data rights from Honeywell but received no response, further justifying the sole-source approach. The 423 SCMS/GUEA engineering group will continue monitoring the marketplace for potential future competitive sources.

Due to their continued refusal in times past to supply manufacturing data for competitive procurement, letters were sent to Honeywell International Inc. (Cage: 70210) on 10/31/14, 9/6/16, and 2/14/18 requesting a Corporate Policy for release of data to the Air Force. There was no response to these requests.
Continued refusal to answer requests for data/data rights release has been construed as a negative response to the government's requests. The data needed to procure this part competitively is not physically available.
V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
This requirement was synopsized in https://sam.gov as a notice of proposed contract action IAW 5.201. This posting was created on the https://sam.gov website on 15 Mar 23 under solicitation FD2030-23-01238 with a response date of 24 Mar 23. No interested sources requested consideration.
VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. If the proposal exceeds the Truth In Negotiations Act threshold IAW FAR 15.403-4(a), the contractor will be required to provide certified cost or pricing data. A detailed cost analysis and price analysis will be accomplished, as necessary. The Defense Contracting Management Agency may be contacted to assist with the analysis.
VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research, in accordance with FAR Part 10, was conducted on 15 Nov 23 by inquiry of Parts Manufacturer Approvals (PMA), HAYSTACK and a web search conducted on ILS. This research revealed that there is not a commercial item available to meet this requirement. The item described in Section III is used in military applications and no commercial or non-developmental substitutes are available. Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable technical data/tooling/etc. required to meet the Government's specifications.
A Sources Sought Synopsis was also conducted to notify Honeywell's licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the https:// sam.gov website on 15 Mar 23 under the solicitation number FD2030-23-01238 with a response date of 24 Mar 23. No interested sources requested consideration.
Based on the above, a high level of confidence exists that Honeywell is currently the only responsible source able to fulfill the requirements.
VIII. Any other facts supporting the use of Other Than Full and Open Competition.
Due to the lack of manufacturing data and qualification requirements, the Government does not expect that another source could become qualified to avoid unacceptable delays in meeting the Governments requirement. Also, the Government does not consider this item a candidate for reverse engineering in accordance with DFARs PGI 217 Part 3-303.
