About this file
This document is a Justification for Other than Full and Open Competition (JOFOC) under the Simplified Acquisition Procedures, which authorizes the National Oceanic and Atmospheric Administration (NOAA) to negotiate a sole source contract with the New England Aquarium (NEAQ) for sea turtle rehabilitation services.
The service required is a rehabilitation facility capable of admitting, triaging, and stabilizing multiple hundreds of cold-stunned sea turtles in Massachusetts each fall, with the ultimate goal of returning them to health and releasing them back into the wild. NEAQ is the only facility in Massachusetts with the capacity, expertise, and federal permitting to perform this task, as cold-stunned strandings have sharply increased in the region. The contract will be for one year from September 11, 2024 to September 10, 2025 with four one-year option periods, at a total estimated value of $135,000. The justification cites NEAQ's prior experience providing these services under previous contracts since 2009.

SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
FD-2024-177
1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office
(AGO), Fisheries OMB Field Delegates and GARFO
2. Description of supplies or services required to meet agency needs (including the estimated value). The service required for this acquisition is a sea turtle rehabilitation facility that is capable of admitting, triaging, and stabilizing multiple hundreds of cold-stunned sea turtles in Massachusetts.
This facility must be able to accommodate over 400 sea turtles each fall and provide high quality care to these animals. In some cases, once stabilized, cold-stunned sea turtles will be transported to other long-term care facilities and in some cases they will stay at the triage facility for their entire rehabilitation. In either case, the ultimate goal of returning them to health and releasing them back into the wild. The work will be accomplished between September 11, 2024 and September 10, 2025. The entire estimated value of the contract will be $27,000 with four option years, each for $27,000, for a total of $135,000.
3. Identification of the single source or the brand name to be solicited. New England Aquarium, Rescue Program, 551 South Street, Quincy, MA, POC: Adam Kennedy, 617-226-2251.
4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:
□ Other - Only one source is capable - The New England Aquarium (NEAQ) is a federally-permitted member of the Greater Atlantic Region Sea Turtle Stranding and Salvage Network, and is the only rehabilitation facility in Massachusetts with the capacity and expertise to triage cold-stunned turtles in the quantity and frequency in which they strand.
Performing this task requires extensive and first-hand knowledge of sea turtle biology and sea turtle rehabilitation techniques, particularly for the unique effects of severe cold-stunning in this region. In addition, as cold-stunned strandings have increased in the last decade, NEAQ is the only rehabilitation facility in Massachusetts with the capacity, i.e. having the tank space, medication and supplies, and staff resources, to admit multiple hundreds of sea turtles each fall.
5. Market Research.
The New England Aquarium has had previous cold stun rehabilitation contracts since 2009. With these contracts, they hired seasonal staff to assist them in providing high quality care to live, cold-stunned sea turtles. They accomplished their stated goals and provided exemplary care to cold-stunned sea turtles during that period of time.
6. Technical/Requirements Representative Certification
I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.
