"LIMITED-SOURCES JUSTIFICATION" FOR A FEDERAL SUPPLY

SCHEDULE ORDER OR BPA EXCEEDING THE SIMPLIFIED

ACQUISITION THRESHOLD OF $150,000 [See FAR 8.405-6(c)]

1. Identification of the agency and the contracting activity, and specific identification of the document as a "limited-sources justification" (LSJ).

This limited-sources justification was prepared by the Federal Communications Commission, Headquarters; Office of the Managing Director, Administrative Operations, Contracts and Purchasing Center.

2. Nature and/or description of the action being approved.

The Federal Communications Commission (FCC) intends to award a sole source Fixed-Price Blanket Purchase Agreement (BPA) for continued maintenance of the Automated Security Access Control Systems. The BPA will have a period of performance of five years. The estimated total BPA order ceiling for the 5 year period of performance is $500,000.

3. A description of the supplies and/or services required to meet the FCC's needs (including the estimated maximum potential value).

The Contractor shall provide supplies and or non-personal services for the Federal Communications Commission, Washington, DC to support the Commission's Automated Security Access Control Systems. The Contractor shall provide highly qualified and experienced personnel, that are U.S. Citizens, to perform all aspects of systems analysis, software updates and installation, systems maintenance (to include regular preventive maintenance), problem resolution, and as needed repair/replacement of system components with genuine Siemens bran items. The services provided under this contract will be for the systems included in Enclosures and 2, as well as all related subsystems, components, and software.

4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.

This action is being conducted in accordance with FAR 8.405-6, under the authority of FAR 8.405-6(a)(l)(i)(B); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

The FCC currently has in use a range of security equipment for the FCC's Automated Security Access Control Systems required to maintain a secured facility and limit access to only authorized personnel. This equipment is solely manufactured and

Page 1 of4 maintained by Siemens Industry mc, and is located at the following three FCC facilities:

FCC Headquarters, (445 12 Street SW, Washington DC 20554) FCC Gettysburg, (1270 Fairfield Road, Gettysburg, PA 17325) FCC Columbia, (9200 Farmhouse Lane, Columbia, MD 21046

The hardware currently being used for security, access is proprietary and maintained by Siemens Industry Inc. The hardware and propriety software contained within, has already been deployed and in the above three locations, and is critical to facilitating building security.

Presently, only one source exists to supply the services and materials necessary to maintain and ensure a continued working Siemens Security Access Control System.

To ensure seamless, functional and fully compatible operation the FCC requires Siemens' proprietary knowledge, software and hardware.

5. A determination by the Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

This BPA is being issued against Siemens' GSA contract under Federal Supplies Schedule 84. The FCC has incorporated GSA pricing under contract GS-07F-8728D in this BPA. In accordance with FAR part 8.404 (d) Pricing, "GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d)."

Therefore as this BPA shall be awarded under GSA contract GS-07F-8728D, pricing under this BPA is determined to be fair and reasonable.

6. A description of the market research conducted among GSA schedule contract holders and the results or a statement of the reason market research was not conducted.

Siemens is the only vendor capable of providing the required services as stated in the SOW. The FCC is required to maintain the Automated Security Access Control Systems to ensure a secure facility. No further market research has been conducted

7. Any other facts supporting the limited sources justification.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The FCC will continue to monitor the market place to determine if any suitable vendors can provide these services, or any new products come to market that could be easily and effectively integrated into the current system.
