FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION FOR LIMITED COMPETITION/SIMPLIFIED ACQUISITION

JUSTIFICATION AND APPROVAL FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Timesaver 37-inch Widebelt Sander listed on DJF-20-1800-PR-0005430 is available from only one source, and competition is precluded as there are no substitutes available.

1. This acquisition is restricted to the following sole source:

Company: Timesavers LLC Company Address: 11123 89th Ave N, Maple Grove, MN 55369 Company Point of Contact and Phone Number: Click here to enter text.

2. The Timesavers 37-inch Widebelt Sander is estimated to cost _________ and is required to be delivered by 7/31/2020.

The action being issued is to request to purchase a brand new widebelt sander from Timesavers LLC which TODU currently already has the same exact machine in the wood shop. The special speed conveyor, thickness of the motor, quick release, quickness of changing the belt, and centralized control panel makes the sander the most effective for the students to learn on. It also helps the students in the field use the same type of sander that is located in their Field Office.

3. TODU currently has one of the Timesavers 37-inch widebelt sanders in our wood shop. We are interested in obtaining a second sander to speed up the sanding process during classes. The sanding process tends to act as a bottleneck during class and a second machine would alleviate this problem. We ask you to consider the fact that these machines would mean that one company could service both machines. Otherwise, we would need to separate service calls, costing more money, security issues, escorting time, etc. In the long run, we believe purchasing the Timesaver sander would, over time, save the Bureau money.

4. Check and fill in all that are applicable for an Open Market Buy:

|X|The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is a 37-inch Timesavers Widebelt Sander, and the new item/service must coordinate, connect, or interface with the existing system by TTA Training Program Advanced Concealment class.
|_|A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:

<Insert description> |_| These are "direct replacement" parts/components for existing equipment.

|_| Other information to support a Choose an item. buy:

<Insert any additional information that supports this sole-source/brand name acquisition>

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The contracting officer will determine, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order or BPA represents a reasonable total price and will be the best value for the FBI.

6. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
