JUSTIFICATION AND APPROVAL

TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION

JA10-180

Upon the basis of the following justification, I, as the Procuring Activity Competition Advocate (PACA), hereby approve the use of other than full and open competition for the proposed within-scope bridge contract, pursuant to the authority of 10 U.S.C. 2304(c)(1) and 10 USC 2304(d)(1)(B), FAR 6.302-1(a)(2)(iii)(B)- Only one responsible source and no other services will satisfy agency requirements. The service is deemed to be available only from the original source in the case of a bridge contract for the continued provision of highly specialized services when it is likely that award to any other source would result in additional funds and unacceptable delays in fulfilling the agency’s requirements.

JUSTIFICATION

1. Agency and Contracting Activity (FAR 6.303-2(a)(1)). Requiring Activity: Defense Information Systems Agency (DISA)

Contracting Activity: Defense Information Systems Agency (DISA), Defense Information Technology Contracting Organization – National Capital Region (DITCO-NCR).

Code: PL61, P.O. Box 4502, Arlington, VA 22204.

2. Nature/Description of Actions(s) (FAR 6.303-2(a)(2)) This is a bridge contract that will allow the government to complete a recompete without disruption to JSSC’s mission critical services. This bridge contract will add follow-on work for the vendor. The proposed action is a contract action to add follow-on work to Aaron B. Floyd Enterprises, Inc., (1901 N. Beauregard Street, Suite 380, Alexandria, VA 22311-1705) under six task orders (TO 6001 through 6006) of the current Integrated Information Management Systems (IIMS) IDIQ contract, DCA100-03-D- 4007. The follow-on support services are to assure critical and uninterrupted information technology (IT) support to the Joint Staff (JS). This follow-on work or bridge period of performance will be a three-month base period and three-option months and will initiate 15 November 2010 and may end 14 May 2011. JSSC will utilize FY11 Operations & Maintenance (O&M) or FY11 O&M “Subject to Availability of Funds” at an estimated cost of $4,462,040.37.

The contract type will remain Time and Materials (T&M).

3. Description of Supplies/Services (FAR 6.303-2(a)(3)). Under this bridge contract, the contractor Aaron B. Floyd Enterprises, Inc. shall provide various Information Technology services in support of Command, Control, and Communications (C3) and analytical requirements of the President, the Secretary of Defense, the Joint Staff (JS), the Combatant Commanders, the Military Services and the other elements within the Department of Defense. The support provides critical support for this effort and assists JSSC in fulfilling its mission responsibilities.

The contract support includes: operating systems and software support, application support, security and analysis and risk assessment, data communications installation and management, database management/administration, network monitoring/administration, visual information systems support, development and use of training materials for designated computer systems, and management of the training process within JSSC. The two key components related to the JSSC support are the Global Command and Control System (GCCS) and National Military Command Center Command and Control System (NCCS).

4. Identification of Statutory Authorities (FAR 6.303-2(a) (4)). The proposed contractual action is pursuant to the authority of 10 U.S.C. 2304(c)(1). In accordance with Federal Acquisition Regulation (FAR) 6.302-1 -Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Nature of the Acquisition Requires Use of Authority Cited (FAR 6.303-2(a)(5)). Aaron B. Floyd Enterprises, Inc. is the only contractor capable of providing services of a comparable nature to those required under the unique circumstances of this contract action. The existing Task Order 6001 through 6006 will end on 14 November 2010. DISA determined that a re-compete is appropriate upon expiration of the IDIQ contract DCA100-03-D-4007. However, due to the complexity of this requirement, a short-term bridge is required to recompete without disruption to mission critical services. JSSC provides mission-essential IT support to the war effort and a break in IIMS services would seriously hinder JSSC’s ability to provide that support.

This contract action for follow-on work will facilitate the transition as result of upcoming re-compete contract actions in order to avoid a break in the existing specialized services.

JSSC relies on contract support to provide direct customer support that is increasingly vital, especially while in wartime. Current tasks require personnel trained in highly technical fields, DoD specific Command and Control applications and TS/SCI clearances. Aaron B. Floyd Enterprises, Inc. is currently providing these critical IT support JSSC. It includes System Administrative support, GCCS Enterprise Management (EM) Service Support, Database Administration Support, GSORTS Application User Support, JOPES Technical Support, Configuration Management (CM) Support, AIS Security Support, Data Communications Installation and Management, JOSC Help Desk Support, Visual Information Systems Support, and GCCS/NCCS Training. Aaron B. Floyd Enterprises, Inc. has provided this support for 10 months (final Option Year #6) and thus has the overall knowledge and hands-on experience of all of the critical requirements of JSSC. Such knowledge and experience is essential to JSSC’s mission critical requirements.

An award to sources other than Aaron B. Floyd Enterprises, Inc. will require additional time and funds to obtain the necessary specialized training, or certifications, and familiarity with JSSC systems and product support, and will result in unacceptable delays in fulfilling the JSSC’s requirements. The bridge period of performance will consist of a three-month base period with three-option months. The six-month estimated cost, if awarded to any other source, is $5,531,361.94 and will require additional funds in the amount of $1,069,321.57 over and above our total estimated bridge cost of $4,462,040.37. In addition, an award to any other source will require manpower and time not currently available to prepare the required new procurement documentation and will also require a minimum of six (6) months procurement lead time in order to award a new contract. JSSC requires highly skilled Top Secret (TS)/SCI eligible cleared Subject Matter Experts (SMEs) who use industry-wide Information Technology (IT) best practices and mature business methodologies to provide stellar Command and Control systems support with focuses on client, server, network, application and data management, multimedia, security and training to the Secretary of Defense, the Joint Staff (JS), the Combatant Commanders, the Military Services and other elements within the Department of Defense. JSSC cannot tolerate any interruption of IIMS service.

The re-compete will be in accordance with the JSSC Acquisition Plan. Aaron B. Floyd Enterprises, Inc is uniquely qualified to provide the support necessary without disruption until the re-compete contract actions are taken. Under these circumstances, Aaron B. Floyd Enterprises, Inc. is the only responsible source that can meet this short-term requirement.

6. FedBizOpps (FBO) Announcement/Potential Sources (FAR 6.303-2(a)(6)

a. A synopsis of this action will be published on the FedBizOpps website as required by the Federal Acquisition Regulation (FAR) IAW Subpart 5.2. The synopsis will completely identify the Government’s minimum mandatory requirements.

b. DISA does not anticipate any other qualified sources; however, should any responses be received, they will be evaluated to determine if they are fully responsive to the Government's stated minimum requirements and will be considered by DISA prior to proceeding with an award.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(a)(7). Based on the estimated bridge costs, utilizing GSA Alliant Small Business GWAC FY11 published on-site labor rates, the Contracting Officer has adequate information to ensure that the follow-on costs to the government will be fair and reasonable. The contracting officer will make a determination that the anticipated cost/price is fair and reasonable.

8. Description of Market Research (FAR 6.303-2(a)(8)). Market research was not conducted because of the unique nature of this contract action, namely, short term of follow-on work that does not allow any disruption of services to JSSC mission critical requirement supporting the war fighters. However, market research was conducted for the re-compete. See Paragraph 11, Action Taken to Remove Barriers to Competition.

9. Any Other Supporting Facts (FAR 6.303-2(a)(9)). The existing IIMS level of effort, for the short term follow-on work will remain the same. Therefore, the current Statements of Work (SOWs), for the Task Orders, will not change with the exception of the period of performance only.

11. Actions Taken to Remove Barriers to Competition (FAR 6.303(a)(11)). This follow-on work will be followed by a competitive procurement action, a base year plus six option years, with an anticipated period of performance and start date between 15 February 2011 and 15 May 2011.
