II. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESSED
This action is for a sole source, firm fixed price purchase order with the Tampa Police Department (TPD) for Law Enforcement assistance during the 2012 ISOF Week Convention to cover the period 21 May 2012 thru 25 May 2012. The estimate for this effort is approximately $over the course of a five day period.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
For this effort, USSOCOM requires a recurring Law Enforcement presence during the week long Conference. ISOF Week is a major Conference scheduled every three years in the Tampa Bay area. This year has particular significance because of a large Capability Exercise (CAPEX) scheduled during the week. This event will have a large international audience as well as many leaders in Government and National Industries from the United States. This Conference promotes needed community relationships and enhances the image of the Special Forces with their professional skills, military bearing, and leadership. Law Enforcement is paramount because of the number of VIP’s in attendance and the assistance needed to control/block traffic during the CAPEX.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
FAR 13.106(b)(i), Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE(APPLICABILITY OF AUTHORITY) USSOCOM requires a professional Law Enforcement entity for traffic and crowd control. During past ISOF Conferences TPD have demonstrated they are a capable and professional force, as well as the only force able to perform in accordance with local law. TPD has jurisdiction in the downtown Tampa vicinity of the Tampa Convention Center and is responsible for traffic and crowd control issues.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE.
Law Enforcement requires a unique skill set that goes beyond carrying a badge and gun. TPD as the sole police force designated in the Tampa Bay downtown area has fulfilled this requirement in the past with flawless execution.
The posting requirement at FAR 5.102(a) will be complied with once this J&A is executed.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE Law Enforcement support in the Tampa bay area has set prices for each Police Department in the area. TPD has shown in the past that their prices are on par with other local departments. Therefore, pricing provided by TPD can be determined fair and reasonable through market research and comparison with similar items in a related industry (FAR 13.106-3(a)(2)(i) and (iv)).
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research indicated that TPD has the jurisdiction for the Tampa Convention Center area. Hilsborough County Sheriff’s Office can only provide support if given jurisdiction by the TPD
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION
None.
X. A LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
No sources were identified or solicited.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED It is USSOCOM’s policy to seek full and open competition whenever possible; however we are required to utilize the Police Department that holds jurisdiction rights in the area .
XII. CONTRACTING OFFICER’S CERTIFICATION.
The contracting officer’s signature on the Coordination and Approval Document is evidence that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12).
