Control No: 182AW2002 Program/Equipment: Alteration of Building 321 ASOS Gym

Version – September 2018 FOR OFFICIAL USE ONLY

FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: 182 MSG/MSC, 2416 S. Falcon Blvd, Peoria, IL.

2. Description of Action: Approval is being requested for the Automated Logic HVAC Controls system for the alteration of Building 321 ASOS Gym.

3. Description of Supplies/Services:

These controls monitor and exercise different functions of HVAC and metering equipment throughout the installation. Each control is wired to a central panel located in the facility, which transfers system diagnostics and statuses to a Direct Digital Control (DDC) system located in the Civil Engineering Facility. Each HVAC system can be monitored and controlled from the DDC. Currently, the 182d Airlift Wing utilizes two separate DDC systems: Automated Logic & Siemens. While the majority of the HVAC on the installation uses Siemens, the Siemens system is obsolete and no longer produced.

The newer version of Siemens systems would require a 3rd DDC monitor to be installed.

Furthermore, Siemens has a sub-par service contract. When maintenance and programming is required, workers are frequently sent without the right equipment, and do not properly solve programming issues. In order to avoid installation of an entirely new and separate monitoring system, Automated Logic must be installed. We have the infrastructure already in place to monitor Automated Logic controls as well as a local 24-hour service center.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

6. Efforts to Obtain Competition: The Automated Logic controls and panels have been found available from ECSI.

a. Effective Competition: Effective competition will not be achieved. There is currently no other contractors that have been found to sell the program other than ECSI.

Automated Logic has certified dealers that handle specific regions of the United States. There is currently no other known dealer of Automated Logic for the base’s region.

Version – September 2018 FOR OFFICIAL USE ONLY

b. Subcontracting Competition: Subcontracting competition will be achieved by the prime contractor soliciting small businesses for all of the aforementioned requirements listed within section 3.

7. Actions to Increase Competition: Market research was conducted with multiple local vendors. All vendors require a separate DDC system which reads only that specific product and requires a 3rd monitoring system. There is not currently any plans to further increase this competition.

8. Market Research: Market research was conducted through searches on GSA Advantage and previous construction contracts conducted at the 182nd Airlift Wing. All vendors require a separate Direct Digital Control (DDC) system which reads only that specific product and requires a 3rd monitoring system.

Siemens offers a Direct Digital Control system. However, Siemens controls are not compatible with third-party controllers. The user would have to manage each individual non-Automated Logic controller as a standalone device. This would require a 3rd maintenance contract for the system as well as a new monitoring station.

9. Interested Sources: Automated Logic Corporation, Environmental Control Solutions, Inc., 201 Spring Street, Suite B, Peoria, IL 61603

10. Other Facts: It was confirmed that non-Automated Logic controls would not work with the existing Siemens DDC, which is inherent to the design of the system. Since the Government currently owns the Automated Logic DDC, it is more cost effective to purchase controls that are compatible with the existing, Government owned controller versus purchasing an entirely new system. Utilizing the existing controller saves the Government approximately $5,000 for a new monitoring station, in addition to the cost of a maintenance contract.
