FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: MICC Benning
2. Description of Action: Department of Public Works (DPW) requests a ID/IQ, firm-fixed price contract with the Gordian Group. The Government projects award for May 2020 and fiscal year 2020, Operations and Maintenance, Army funds will be used. The software, eGordian, is required to execute Job Order Contract (JOC) at Fort Benning. Two option periods will be required for updating the Unit Price Book (UPB), as needed.

5. Reason for Authority Cited:
RS Means produces and retails an estimating package; however, it has recently been purchased by the Gordian Group and would require development of supplemental materials to tailor it to the Fort Benning JOC program requirements. The time and effort to develop these supplemental materials would be both detrimental and costly to the government.
Due to time constraints, it will be more advantageous to purchase the Gordian Group area specific unit price book and software updated pricing. Over the past 20 years, the Gordian Group has developed a customized a unique Unit Price Book and technical specifications specifically for estimating JOC task orders. The software package that comes with the Gordian UPB enhances comparison of Government estimates and contractors’ proposals. This product has been determined to be essential to the Government’s requirements, and market research indicates that other companies’ similar products do not meet, or cannot be modified to meet the government’s need.
(b) Alternatives: None.
6. Efforts to Obtain Competition: Evaluated Market Research from other similar contracts utilized by the Government and no viable competition was identified. Recent market research did not indicate a software product that developed site specific UPB data that is required for the JOC. The Contracting Officer shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: If synopsis reveals competition for requirements posted, the strategy for obtaining site specific UPB and software will be altered from Sole Source, to Full and Open Competition. Continuous market research will be conducted throughout the life of the contract to determine if Options can be exercised.
8. Market Research: Market Research was conducted by IMRE-PWF in February 2019 evaluating a similar contract awarded at Redstone Arsenal in procuring supplies/services of this type. Market Research supports that there are limited sources of unit price books and estimating software. Research yielded few sources for estimating software, but only the Gordian Group was found to have a customizable Construction Task Catalog to provide a thorough and specific list of line items to serve as the fixed price tool for the JOC contract at Fort Benning. The other estimating platforms found, 4Clicks, RS Means Online, and WinEst, use RS Means data, which is a nationally averaged data source, does not have location specific nor incorporates local Davis-Bacon wage rates. 4Clicks and RS Means is also owned by the Gordian Group.
