FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: MICC Center – Fort Bragg
2. Description of Action: United States Army Forces Command (FORSCOM) G –3/5/7 requests a firm fixed price 12 month Standalone bridge contract in order to maintain the status quo for services until a follow-on contract or task order can be competitively awarded. The current Task Order’s ordering period for provided under the Operations, Planning, Training and Resource Support Services II (OPTARSS II) Multiple Award Task Order Contract (MATOC) expired 15 March 2016. The current Task Order W911SE-11- D-1006-0002 was competitively awarded UP FAR 16.505 to DST, Inc., 9901 Business Parkway, Suite R, Lanham, MD 20706-1887. The 12 month bridge is requested to allow time not just for competition, but to allow the awardee to complete the process to obtain a Facility Clearance.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The Mission and Installation Contracting Command - Fort Bragg (MICC-FB) has a requirement for the United States Army Forces Command (FORSCOM), to provide Joint National Training Capability (JNTC) Support Services. The Joint National Training (JNT) Cell is in support of FORSCOM G3 Training Division’s coordination, and is required by the JNTC Joint Management Office (JMO) and its subgroups. The goal of establishing a JNT Cell is to improve the ability of the United States forces to fight effectively as a combined team by extending joint training to a much broader audience. The contractor shall assist the FORSCOM G3 Training Division with coordinating among various Office of Primary Responsibilities (OPR) in both the FORSCOM and the United States Army Training and Doctrine Command (TRADOC), to assist in the development of concepts, training strategies, and identify resources essential in translating this concept into reality.

4. Authority Cited: 10 U.S.C. 2304(c)(2) as implemented by FAR Part 6.302-2 -- Unusual and Compelling Urgency.
5. Reason for Authority Cited: The JNTC Support Services provides contractual functional and technical support to meet the demands of the diverse and critical G-3/5/7 mission tasks. The Assistant G3s provides direct support to the FORSCOM Command Group, FORSCOM Coordinating Staff and the FORSCOM Special Staff. Delay in award of a contract would result in serious injury, financial or other, to the Government.
Without the contract support, Forces Command will have mission failure for some of the following reasons:
(1) Providing recommendations to the G-3, Training Directorate, in providing the FORSCOM integrating office for all matters pertaining to JNTC and JNTC events, which include Mission Rehearsal Exercises (MRX) and Joint Task Force training exercises, for Corps/Division. Additionally, providing recommendations with planning, development and coordinate FORSCOM support requirements Active Component and Reserve Component (AC and RC) units, augmentation, and other resources, for JNTC events.
(2) Capturing data, perform analysis and document results of JNTC events for utilization in development of training programs, policies and regulations. Provide recommendations in the development of and execution of Army portion of Event Accreditation, Venue Certification, and Unit Validation.
(3) Supporting the development of Corps, Division and Brigade level JNTC event planning operations to include scenario design and development. Coordinate to provide:
Tactical Units, Live/Virtual/Constructive training formats, Opposing Forces, Observer Controllers, Augmentation for Joint assessment teams, Echelon Above Brigade Higher Headquarters elements, augmentation for Exercise Control Groups, Augmentation for Echelon Above Corps and Joint Task Force (JTF) Headquarters’ (blue and white cell), provide exercise planners and staff and control.
(4) Interests of economy and efficiency. Bringing a new contractor on board, without a Top Secret Facility Clearance, would cause mission failure and turmoil. A new contractor would have to be escorted around in the FORSCOM building. The new contractor could not work on classified material, which is a requirement of the Performance Work Statement (PWS). A minimum period of 30 days would be required in order for any incoming contractor to gain the baseline institutional knowledge and expertise required for adequate performance. This is evidenced by the 30 day phase-in period for the current Task Order and the contemplated 30 day phase-in for the follow-on competition at the end of the performance period. The risk of mission failure would be over-arching to the United States (US) Army, not simply support to G –3/5/7 mission. This support of command and control functions, is mission critical for HQ FORSCOM Directorates, Corps, Division and Brigade level JNTC, Tactical Units, Opposing Forces, Observer Controllers, Augmentation for Joint assessment teams, Echelon Above Brigade Higher Headquarters elements, augmentation for Exercise Control Groups, Augmentation for Echelon Above Corps and Joint Task Force (JTF) Headquarters’ (blue and white cell).
Additionally, the FORSCOM Commanding General’s directive is to not have any contracts start or stop in the fourth quarter of a fiscal year.
(5) The Government issued the Request Task Order Proposal (RTOP) and was on track to issue a Task Order award for the acquisition. Due to unforeseen complications with the Top Secret Facility Clearance requirement prior to award, vendors did not submit proposals. Because of the approaching end date of the current Task Order, this unusual and compelling urgency precludes full and open competition due to the need of a Top Secret Facility Clearance requirement prior to award.
Accordingly, this Task Order Bridge, which allows for a minimally sufficient length of time to move forward with the re-compete of the new contract, is necessary.
6. Efforts to Obtain Competition: Because this is a sole source action, effective competition is not applicable.
7. Actions to Increase Competition: Competition was obtained on the current Task Order. This is maintaining the status quo until a competitive follow-on contract can be solicited, evaluated, and awarded. It is in the best interest of the Government to issue a follow-on contract and provide uninterrupted service until the follow-on contract can be awarded. FORSCOM’s impending review of Top Secret Clearance Facility requirement could result in a more efficient services requirement which is believed will result in greater competition amongst the small businesses, if it is determined the requirement can be lowered to a Secret. If the requirement review does not lower the needed clearance, according to the DoD’s Defense Security Services website, currently the average number of days for a new contract to obtain a new Facility Clearance is 151 days. Additionally, it is necessary that sufficient time be available to properly answer industry questions, and to conduct a meaningful technical evaluation and subsequent award. MICC Fort Bragg will procure the follow-on requirement. Once FORSCOM completes their research, an Acquisition Strategy will determine the best approach to achieve effective competition in soliciting to as many potential sources as practicable.
8. Market Research: In November 2017, market research was conducted by MICC-Fort Bragg. The market research included the review of mandatory Federal Supply Schedules, Federal Prison Industries, and MICC Enterprise Solutions. None of the mandatory schedules offer services that support this requirement. The General Services Administration (GSA) was searched to determine if there was a schedule that could provide the services required. It was determined that (GSA) One Acquisition Solution for Integrated Services (OASIS) could provide two or more small businesses and would be the best solution. The past acquisition history supports that the requirement can be satisfied by woman owned small business concerns. Using OASIS will still allow for competition and has a total of potential fourteen Women Owned Small Businesses that can provide proposals. However, it was not realized at the time, that the clearance issue prohibited the immediate provision of services from this pool. Even though using this contract vehicle comes with a fee, the fee is relatively low for an existing contract vehicle and will streamline the acquisition process.

9. Interested Sources: A Request for Task Order Proposal (RTOP) was emailed to all fourteen Women-Owned Small Businesses on 31 January 2018. OASIS Women Owned Small Businesses expressed written interest in this acquisition. However, due to the timeline to obtain a Top Secret Facility Clearance prior to award, no proposals were received.
