About this file
This document is a FAR Part 16 Exception to Fair Opportunity Justification for a brand name memory upgrade requirement. The U.S. Army Mission and Installation Contracting Command (MICC) at Fort Eisenhower is procuring 240 units of Dell 64GB 2RX4 DDR4 RDIMM 3200MHz memory upgrades to support the Cyber Center of Excellence's (CCoE) Cyber Virtual Training Environment (CVTE) platform. The requirement is being procured under the ITES-3H contract vehicle, with an anticipated award in September 2024 using FY24 Operations and Maintenance, Army funds. The justification cites the need for the Dell brand memory to maintain compatibility with the existing CVTE hardware, and that alternatives such as purchasing a different brand or building a new system would result in significant delays or increased costs. Market research confirmed the requirement can be fulfilled through the mandatory Army CHESS program.

FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts
For Actions Exceeding the Simplified Acquisition Threshold (SAT)
1. Contracting Activity: U.S. Army Mission and Installation Contracting Command (MICC)-Fort Eisenhower, 35200 3rd Ave, Fort Eisenhower, GA 30905
2. Description of Action: Cyber Center of Excellence requests a firm-fixed-price with Any ITES-3H contract holder capable of providing the items in section 3 below. The Government projects award for September 2024 and fiscal year 2024, Operations and Maintenance, Army funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The following items and quantities are required to be procured:
Dell Memory Upgrade - 64GB - 2RX4 DDR4 RDIMM 3200MHz (AA783423) – QTY 240 Delivery: 15 September 2024 Total Value:
4. Authority Cited: FAR 16.505(a)(4) – Restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).
5. Reason for Authority Cited:
a. The Cyber Center of Excellence (CCoE), Cyber School requires the Brand Name purchase Dell Memory Upgrades. The Cyber Center of Excellence (CCoE) commercial environment that is the Cyber Virtual Training Environment (CVTE) platform is rapidly incorporating disparate networks and providing an innovative new platform for schoolhouses to build virtual training. This system currently supports over 1200 students and 1500 deployments weekly and continues to expand. This upgrade will allow for an additional 1000 users to continue the consolidation effort. The platform is utilized to provide training across multiple MOS and schoolhouses for the CCoE.
The Army’s Computer Hardware, Enterprise Software and Solutions (Chess) is a mandatory source for Commercial Off the Shelf (COTS) hardware and software, commercial IT hardware, software, services, and tactical/operational hardware requirements in accordance with AFARS, Part 5139, Acquisition of Information Technology and AR 25-1, Army Information Technology. CHESS contracts provide IT products and services that comply with U.S. Army Network Enterprise Technology Command, Army and DOD policy and standards.
Any ITES-3H contract holder should be able to provide these items.
Deviations from the approved solution would result in significant delays to bring the CVTE up to date, The current and anticipated configurations are supported by Dell equipment and only Dell memory cards are compatible with the established hardware.
b. Alternatives.
1) Purchase a different brand of memory upgrades. This would result in the CVTE being nonfunctional and pose a severe risk to training mission.
2) Purchase new hardware and build a whole new system. The upfront cost for this course of action is duplicative and the CCoE will not be able to recover any benefit.
3) Not purchase the upgrade. This will limit the expansion and development of the virtual training that can be provided by the CCoE to the students and deployed soldiers, resulting in a less robust force.
6. Actions to Increase Competition: This effort utilizes the Army’s mandatory source of supply and will be open to all eligible providers on the ITES-3H vehicle.
7. Market Research: Market research was conducted, and the market revealed that the requirement could be fulfilled through mandatory sources via CHESS. The Army CHESS program is a mandatory source program for the purchase of commercial off the shelf (COTS) software, IT equipment (e.g. routers & servers), services, etc, regardless of dollar value. This requirement will be competed under Army CHESS ITES-3H on an unrestricted basis through Army CHESS.
8. Other Facts: Acquisition will use the Mandatory source of supply.
