About this file

This is a Justification Review Document for a sole-source procurement under FAR Part 13 Simplified Procedures for Certain Commercial Items.

The U.S. Army Corps of Engineers (USACE), Walla Walla District, seeks approval for a new Firm-Fixed-Price (FFP) supply contract to be awarded to Emerson Process Management Power & Water Solutions, Inc. (CAGE: 1P9B3, Pittsburgh, Pennsylvania) for Governor Oil Pump Unloader Valve Assemblies for Lower Monumental Lock and Dam. The contract requires delivery of all items within 20 weeks of award. Required supplies include: one Dual Unloader Assembly Kit compatible with Pelton C310 Main Pumps (First Unit, Includes Design); two Dual Unloader Assembly Kits compatible with Pelton C310 Main Pumps (Follow-on Units); one Single Unloader Assembly Kit compatible with Pelton C90 Jockey Pumps (First Unit, Includes Design); two Single Unloader Assembly Kits compatible with Pelton C90 Jockey Pumps (Follow-on Units); and one Unloader Spare Parts Kit. All deliveries are due within 20 weeks After Contract Award (ADC).

The justification for sole sourcing centers on technical compatibility requirements and system integration complexity. Emerson is the only company capable of providing retrofit kits compatible with existing Pelton governor pumps and the existing American Governor Company (AGC) digital control system. The original unloader valves are 55 years old and beyond their expected service life. Emerson acquired both AGC and Pelton proprietary designs and is the sole vendor capable of providing compatible unloader valves without requiring extensive system redesign. The document notes that redesigning the system would cost over $2 million and require over 4 years of effort. A prior competitive contract (W912EF-17-P-0066) awarded to American Governor Company for $59,300 from August 2017 through February 2018 is referenced, after which it was determined that governor software is proprietary to Emerson. The contracting officer is Tracy Gluck (Tracy.Gluck@usace.army.mil, 509-527-7421), and the document is dated June 2025.
