CONSUMER PRODUCT SAFETY COMMISSION

BETHESDA, MD 20814

LIMITED-SOURCES JUSTIFICATION

In accordance with FAR 13.501(a)(i)

(i) This is a Limited-Sources Justification for the Consumer Product Safety Commission (CPSC), Office of Procurement Services.

(ii) CPSC awarded 61320621P0012 to MessageOne, LLC dba Lyris, Inc. on a limited-source basis for LYRIS List Manager Subscription Service.

(iii) LYRIS List Manager Subscription Service is the product CPSC uses for email subscription lists server. CPSC requires the one-year software maintenance and support in order to continually receive the latest versions of the software, security patches, and to have access to their technical support. The total estimated value of the award is $25,854.00.

(iv) The authority and supporting rationale for the limited-sources justification is 13.501(a)(i) Only one source is capable of providing the supplies or services required at the level of quality required, because the supplies or services are unique or highly specialized.

LYRIS List Manager Subscription Service is currently being used by CPSC. Various CPSC offices also maintain their own lists for distributing notifications/news. The proposed contractor developed and owns the software and is the only vendor that can provide service, support and updates of this product.

LYRIS is an application for managing subscription lists and can distribute emails to list subscribers. General public can subscribe public lists they’re interested in via https://cpsc.gov/Newsroom/Subscribe.

(v) The contracting officer has determined that the order represents the best value consistent with 13.106-2. The price is deemed fair and reasonable based on previous history for the same services procured last FY20.

(vi) Market Research was conducted, as the requirement was published on BetaSam.gov for 10 days with no responses received.

(vii) The requirement cannot be modified to enhance competition, because the proposed contractor developed and owns the software and is the only vendor that can provide service, support and updates of this product.

(viii) It is unlikely that additional sources for this support will become available. However, CPSC will work to identify any other potential solutions that could meet the requirement in the future. If additional services, which provides the same support becomes available, CPSC will conduct an open competition for future actions.

(ix) The contracting officer certifies that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.

(x) Technical personnel who provided supporting data, which forms the basis for this justification have certified that the information is complete and accurate.

(xi) The contracting officer has determined that the circumstances at FAR 13.501(a)(i) apply to this acquisition.
