United States Department of Agriculture Single Source/Brand Name Justification

Less Than the Simplified Acquisition Threshold (SAT) FAR 13.106-1(b)(1)

Control No. (if applicable) N/A

1. Identification of the agency and the contracting activity.

Requesting Agency:

USDA, APHIS, PPQ

73-300 Kupipi Street Kailua-Kona, HI 96740

Contracting Activity:

Animal and Plant Inspection Service 250 Marquette Ave., Suite 410 Minneapolis, Minnesota 55401

2. Description of supply or service required to meet the agency’s needs.

Purchase of two (2) Heiman 100100V Scan (X-Ray) Machines and monitors for the Hawaii Ports of entry.

3. Rationale or circumstances for limiting competition.

USDA has 26 100100V machines in Hawaii and is looking to add two (2) new 100100V machines at the Kailua-Kona, Hawaii, Airport. All USDA PPQ Inspectors are trained on these machines and can work at any station as all stations have the same machines.

The Port of Kona has at least 35 inspectors ranging in pay grade from GS-3 to GS-12 that are trained to use these Smiths Detection Heimann machines. Any re-training on new scan ray equipment would not be feasible for both budgeting and staffing reasons.

USDA PPQ ships scan ray machines between islands in the State of Hawaii for use in other port environments. It is critical that the inspectors on all islands are able to operate and effectively identify agriculture contraband items on machines that they are trained on.

Furthermore, USDA has a multi-year service contract for the maintenance of these machines. The vendor that provides that service can perform work that is both covered under the standard 1 year warranty and after the warranty expires. When the one (1) year standard warranty does expire, the machines are worked on under this multi-year service/maintenance contract. This contract does not include other brand units and would require additional administrative labor to set up a new multi-year service contract or a modification to add the new machines.

In addition to this contract, USDA has a number of spare parts/components specific to this brand name that can be used to extend the working life of the machines.

4. Description of the market research conducted and the results or a statement of the reason market research was not conducted.

Market research was performed on GSA to look at the differences in price and models. Market research was performed in open market. A review of historic purchases within USDA shows various purchases of same machines with past market research similar.

There is no other company of providing replacement parts for Smiths Detection commercial units or first-hand technical support.

A Sole Source was advertised on FedBizOps from April 22, 2019 and closed on May 22, 2019. One Large Business vendor replied and was not capable of meeting the repair response time as well as the replacement parts per the Statement of Work.

After the Sole Source was issued, we obtained additional infonnation from Smiths Detection that they are the sole manufacturer of their equipment and also the only service provider.

Smiths Detection is the original manufacturer and service providers of these commercial units. USDA will have access to the top support and technical staff at Smiths Detection who developed, manufactured and support the actual products. Due to these elements, no other company is suitable or able to provide service or parts given, that Smiths Detection is a proprietary company with no third party suppliers.

5. Estimated price, including all options, if applicable.

$132,597.38

6. Recommended source(s).
