About this file
This is a Justification and Approval (J&A) document for other than full and open competition, issued by the Department of the Navy's Military Sealift Command (MSC) Ship Support and Services Division for mooring lines supplies. The J&A (N10225Q2116) authorizes a Brand Name basis purchase order for specific mooring lines supporting the USNS CESAR CHAVEZ, including VETS 276-6- 2-1/4 X 200M rope assembly, VETS 276-6 57MM X 150M rope assembly, CG99 chafe pro, and CG39-3IN X 600 rope assembly.
The sources sought notice N3220525Q2116 was released on November 19, 2024, generating interest from four small businesses, two of which were previous vendors under expired contract N3220519D9001. The solicitation will be posted on SAM.gov, with pricing to be determined fair and reasonable using FAR Part 13 techniques. The J&A cites environmental factors like saltwater exposure and UV radiation as justification for brand name requirement, as these specific mooring lines meet Oil Companies International Marine Forum safety guidelines and IMO mooring equipment requirements. MSC will maintain the brand name requirement but allow competition among vendors who can supply the specified brand.

specifications outlined by the government, ensuring that they are fully capable of performing as required. This statement clearly communicates both the approval by the relevant organization and compliance with government specifications. That unavailability would result from a ship’s regulatory-forced inability to operate, which would render the vessel not functional. That delay in mission readiness in even one vessel could cause mission failure.
The mooring lines listed in this document under Section 3) above are integral parts approved mooring lines that are in use aboard MSC vessels. The above statutory authority permitting other than full and open competition applies to those brand name or Equal mooring lines due to the fact the listed characteristics are the only approved mooring lines for the reasons above. The mooring lines covered by this Justification and Approval (J&A) allow for the provision of essential material through a defined contract.
6. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable:
The sources sought notice N3220525Q2116 was released 19 November 2024. The sources sought notice included the salient characteristics of approved mooring lines for the USNS CHAVEZ. The 19 November noticed yielded four vendors sent emails expressing interest. Four small businesses replied to the sources sought notice that they were capable of providing the supplies. Two of the small businesses that expressed interest were previous vendors under the expired Multiple Award Indefinite Delivery Indefinite Quantity (IDIQ) Mooring Lines Contract N3220519D9001.
The solicitation N3220525Q2116 will be provided through the Government Point of Entry SAM.gov. The products listed in this justification are the only products currently approved for the systems onboard MSC vessels, they may be available through a number of sources, such as resellers or distributors. Vendors may subscribe to the interested parties list on SAM.gov for upcoming requirements.
7. Determination of Fair and Reasonable Cost: Prior to contract award, a fair-and- reasonable determination will be made using the techniques described in FAR part
13. The Contracting Officer will ensure that the anticipated contract will be awarded with pricing which is commensurate with earlier pricing, adjusted for the current market conditions and applicable inflation.
8. Actions to Remove Barriers to Future Competition: For reasons set forth in section 5 of this document, MSC has no action plans at this time to remove or overcome the brand name requirement as it currently exists for mooring lines due to the approval process stated in paragraph 5. However, MSC is limiting this J&A to a brand name while still issuing a competitive solicitation for any vendor that can provide that brand.
