About this file

This notice of intent to award a sole source contract announces that the 377th Air Wing Mission Support Group Contracting Division at Kirtland Air Force Base in New Mexico intends to award a delivery order to Ortho Clinical Diagnostics for a Vitros XT7600 Chemistry Analyzer System. The specialized machine uses proprietary dry slide technology and does not require sterilized water, unlike other chemistry analyzers. Installing an analyzer that requires sterilized water would necessitate significant construction and renovation of the medical lab to accommodate a waterline, causing unacceptable delays. Only Ortho Clinical Diagnostics manufactures this type of analyzer and has patented the required technology. Interested parties may submit information by August 23rd but the government retains sole discretion to determine if competition is warranted. The anticipated award date is September 30th.

NOTICE OF INTENT TO AWARD SOLE SOURCE

FA9401-23-Q-0050

This is a notice of intent to solicit and award a sole source contract under statutory authority 10 U.S.C. 3204(a)(1), set forth in Federal Acquisition Regulation (FAR) 8.405-6(b) Items peculiar to One Manufacturer. The 377th Air Wing Mission Support Group Contracting Division, Kirtland AFB, New Mexico intends to award a sole source delivery order to Ortho Clinical Diagnostics (cage code 1C0L5), 1001 US Highway 202, Raritan, NJ 08869.

Ortho Clinical has been identified as the only entity able to provide the required technology for the 377th Medical Group Medical Lab. Ortho Clinical manufacturers the Vitros XT7600 Chemistry Analyzer System, which uses proprietary, dry slide technology. This specialized machine does not require the use of sterilized water. This is unlike other chemistry analyzers, which require the use of sterilized water to process samples, as well as the removal of the wastewater post analysis. Installing an analyzer that requires sterilized water would require significant construction and physical renovation of the lab so that a waterline may be installed.

This would cause unacceptable delays in the vital services the MDG provides Airmen and thus hinder the Air Force’s readiness. Only one manufacturer, Ortho Clinical Diagnostics, has been identified as capable of providing the type of analyzer required by the Medical Group, and this manufacturer has patented the technology for said analyzer.

This purchase will be made under Federal Supply Schedules as authorized by FAR subpart 8.4.

The anticipated award date is 30 September 2023. Please note that this is not a request for competitive quotes. However, all interested parties who believe they can meet the requirements are invited to submit, in writing, complete information describing their ability to provide the product/services listed above.

A determination by the government not to compete this requirement based on responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.

A Sole Source Justification Letter will be posted with the Notice of Intent to Award Sole Source IAW FAR 8.405-6(a)(2).

The closing date for this notice is 23 August 2023, 12:00pm Mountain Time. For information regarding this purchase, please contact Margaret Peterson (Contract Specialist) at margaret.peterson.4@us.af.mil, or Rachel Copeland (Contracting Officer) at rachel.copeland.1@us.af.mil mailto:margaret.peterson.4@us.af.mil mailto:rachel.copeland.1@us.af.mil

As prescribed in 32.706-1(a), insert the following clause:

Availability of Funds (Apr 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
