About this file

This is a Single Source Justification (Simplified Acquisition) document for AFRL/RIKO's requirement for Mechanical/Electrical/Plumbing (MEP) architect-engineer services to complete the design of the H8 laboratory in Building 3 at the Rome Research Site, NY. The document justifies sole-sourcing to Towne Engineering, P.C., who previously completed 65% of the design development under task order FA875121F0043 before mission requirements halted further progress.

The justification explains that awarding to a different contractor would result in approximately 12 months of delays and potentially double the design fees, as a new contractor would need to review and reconfirm all previous work. The requirement involves completing a highly technical design package for a Class 1000/Class 100 clean room lab, Equipment support space, Micro-Electronics lab room, and a roof-mounted mechanical equipment penthouse. A pre-solicitation notice was posted on SAM.gov from October 23-November 7, 2024, receiving only one response, but the government maintained its position to sole-source due to substantial cost duplication concerns and timeline impacts. The anticipated performance period is six months, and the contract number is FA875125QTWNE.

Single Source Justification (Simplified Acquisition)

April 2021 Page 1 of 2April 2021 Page 1 of 2

Section A: General Contract Information

Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No

Contracting Activity: AFRL/RIKO 26 Electronic Pkwy Rome, NY 13441-4514

Project/Program Name: Complete Design of H8 Laboratory, B3 Renovation

Purchase Request / Local ID Number: TBD / FA875125QTWNE

Estimated Contract Cost (including Options):

Section B: Description of the Supplies/Services Required

The Air Force Research Lab/Information Directorate (AFRL/RI) requires Mechanical/Electrical/Plumbing (MEP) architect-engineer (AE) services to provide 100% final construction documents for the renovation of the H8 laboratory in Building 3 at the Rome Research Site, Rome, NY.

This contract will provide AE services to complete a highly technical design package, which is currently at 65% design development. This design requires specialized Architectural, Structural, and Mechanical design services - for a Class 1000 / Class 100 clean room lab, Equipment support space, Micro-Electronics lab room, and a large mechanical equipment support roof mounted penthouse.

The estimated cost of this requirement is with an anticipated performance period of six (6) months.

Section C: Justification for Soliciting from a Single Source or Brand Name

Towne Engineering, P.C. previously completed and submitted a 65% design development package under their A&E services indefinite delivery indefinite quantity (IDIQ) contract with AFRL/RI via task order FA875121F0043. Mission requirements terminated further design efforts beyond 65%. Current mission requirements have created a need for the resumption of the H8 design however continued development under the IDIQ contract is not possible as it has expired.

The Government has determined that no other source can meet this requirement as awarding to a contractor other than Towne Engineering at the current stage of 65% design development would result in a longer period of performance and a duplication of services already acquired by AFRL. A new designer, in the course of performing their professional duties, would need to review and reconfirm all that has already been developed thereby increasing the likelihood of both technical problems and increases in project cost. Introduction of a new designer would also introduce risk to scope certainty as the current design team has spent years assisting the user in scope definition through interactive RI site visits, visits to other specialized laboratory facilities, and frequent communication with the team at AFRL/RI. In addition, the existing design firm possesses the knowledge and familiarity of construction projects that are adjacent to the proposed project area which brings value in reducing the risk of conflicts to the design documents.

It is estimated that award to a new design team would result in a delay of approximately 12 months for the Government to obtain 100% completed construction documents, and could potentially double the design fees incurred by the Government.

Therefore, award to any other source would result in a substantial duplication of cost that is not expected to be recovered though competition and unacceptable delays in fulfilling the Government's requirements.

Section D: Efforts to Obtain Competition

A notice of contract action was synopsized as a pre-solicitation notice to the SAM website (www.SAM.gov) from 23 October 2024 to 7 November 2024. Only one response was received. submitted a capability statement and expressed their interest in the requirement. The Government considered the response however maintained its

Single Source Justification (Simplified Acquisition)

April 2021 Page 2 of 2April 2021 Page 2 of 2 position that competing the remaining 35% of the design requirement would result in substantial duplication of cost not expected to be recovered through competition and negatively impact the Air Force mission with a much longer lead time.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

For the reasons described in Section C, no further steps will be made to preclude future single source awards for this effort. This J&A supports a discrete requirement that will end when the project is complete. However, the Contracting Officer will continue to review other future opportunities to ensure all eligible AE firms are afforded a fair opportunity to provide offers for these efforts.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
