I. Contracting Activity.
The contracting activity responsible for this contracting action is the Air Force Materiel Command, Air Force Life Cycle Management Center, AFLCMC/HNAK, MITRE D, 202 Burlington Road, Bedford, MA 01730. This is a justification for Other than Full and Open Competition. The Approval Authority is the HNAK Chief of Contracting. The Contracting Officer is . The Contract Specialist is .
II. Nature and/or description of the action being processed.
This action will be awarded as a modification to contract FA8726-09-C-0006 (cost-plus-fixed-fee) with Lockheed Martin Corporation (LM), Information Systems & Global Solutions (IS&GS). The action is being processed to provide uninterrupted support
III. Description of supplies/services required to meet agency needs.
The purpose of this modification is to implement an estimated . Estimates are based on historical data, current contractor burn rate, Rough Order of Magnitudes (ROMs) and estimates of future requirements/work from the Global Broadcast Service (GBS) Defense Enterprise Computing Center (DECC) Joint Program Office. This action will procure services, but these services are integral to the purchase of the supply, the overall DECC system. The services specifically include Tier II Reachback support for OO-ALC for the Satellite Broadcast Manager (SBM) and Receive Broadcast Manager (RBM) software.
The GBS provides
GBS supports
GBS currently consists of two programs; an Acquisition Category (ACAT) 1C program for the fielded (legacy) Satellite Broadcast Manager (SBM) and Receive Suites (RS), and the future Receive Broadcast Manager (RBM), and an ACAT III program for the DECC SBM transition.
GBS is Post-Milestone C in the operations and support phase and is being modernized to meet the evolving needs of the warfighter, to capitalize on evolving technologies, and to improve system security and sustainment. The initial development program has been completed and Initial Operational Capability increments one through three, of three, have been transitioned to sustainment.
The GBS DECC program is
SMC/MCL and OO-ALC are dually responsible for all activities required for maintaining the operational DECC SBM and RBM software and hardware baseline configuration and maintaining the security accreditation of the DECC broadcast, to include maintaining the Conditional Access System (CAS) and the Sigonella equipment.
The original end date of this contract was supposed to be December 2010. However, there have been numerous program delays including slips incurred due to Defense Information Systems Agency (DISA)-directed changes as well as late or defective Government Furnished Equipment/Information (GFE/GFI).
These delays have made it difficult for SMC/MCL, and OO-ALC to plan and execute a contract award for sustainment of GBS.
SMC/MCL's and OO-ALC's ability to award follow-on contracts was also complicated by the fact that they were in the process of working two contract extensions for the legacy GBS program. These delays forced SMC/MCL to maintain dual baselines, the legacy baseline and the new GBS DECC baseline, until the final cutover methodology and date was determined.
A Period of Performance (PoP) extension for the following
These four engineering CLINs provide Tier II Reachback support for OO-ALC for the SBM and RBM software. The SBM and RBM software has been Operationally Accepted by Air Force Space Command.
OO-ALC planned to have in place a contract vehicle to assume this work on 1 February 2016. However, due to extensive dialogue with Industry, a significant change in requirements as well as the acquisition strategy changing to move forward as a Small Business award rather than a Large award, altered the schedule significantly. These perturbations drastically altered the original schedule which has led to the delay in contract award.
These are required to ensure they have the ability to access LM and fix any potential discrepancies which may arise out of testing. To address these discrepancies, an increase
For the reasons noted above, a modification to increase the ceiling
IV. Statutory authority permitting Other than Full and Open Competition.
The statutory authority applicable to permitting other than full and open competition is 10 U.S.C. 3304 (c)
(1) as implemented by FAR 6.302-1(a)(2), which states that when the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
FAR 6.302-1(a)(2)(iii)(B) further goes on to state that for DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Program Decision Memorandum (PDM) IV, dated 13 December, 2006 directed the following: 1) transfer the Satellite Broadcast Manager (SBM) functions to Defense Enterprise Computing Centers with new hardware and software architecture by FY 2010; 2) implement system transmission security via the Joint IP Modem; and 3) provide operations, maintenance, and sustainment for the GBS program throughout the life of GBS. Though there have been programmatic delays with meeting the 2010 mandate, the current development contractor, Lockheed Martin Corp IS&GS is fully staffed and prepared to execute these activities to not further delay compliance with PDM IV. No other source is capable of meeting the requirements immediately since Lockheed Martin has the requisite resources already in place.
In May of 2009, the Government awarded a full and open competition contract; FA8726-09-C-0006 to Lockheed Martin Corporation (LM), Information Systems & Global Solutions. This contract was to seamlessly transition the legacy GBS SBM functionality to the DECC facilities and provide system maintenance and Help Desk Operations for the DECC-based GBS, without disrupting the operational broadcast. SMC/MCL, as part of the acquisition strategy, was to assume responsibilities for GBS DECC sustainment after Operational Acceptance with a follow-on contract.
Operationally GBS
If this bridge contract modification is not in place to support the 3 month PoP, operational users who are conducting will continue to receive their broadcast up until such a time there is a disruption to the broadcast. For example, if there is an issue with a source or a user is experiencing challenges with a previously received broadcast, then without overt actions by the GBSOC those users experiencing a disruption in service will cease to receive their GBS broadcast. These broadcasts range from
Any interruption of service would have detrimental impacts to the war fighter in meeting their mission objectives. The GBS Program provides services to joint branches of the military in addition to the Air Force.
Lockheed Martin Corp IS&GS has developed and sustained the newly developed Receive Broadcast Manager (RBM), Satellite Broadcast Manager (SBM) software, all the Technical Orders associated with these new systems as well as more than created Standard Operating Procedures (SOPs) for the day-to-day operations of the GBSOC. No other contractor has the equipment, the Authority to Operate (ATO) or Authority to Connect (ATC) to live operational feeds to verify and validate the mission critical changes. For a new vendor to come up to speed with the software architecture, and understand the GBSOC SOPs and how they are utilized, would take a minimum of 6-9 months but more than likely a full year. In addition a new vendor would be required to be capable of providing reachback or `Tier II” level support to provide in depth knowledge of the software architecture to be able to assist the GBSOC in troubleshooting any in depth system issues. Even assessing the minimum time frame of 6 months for a new vendor to come up to speed, this would render the GBS system “static” and incapable of implementing any real world operational required changes to the system. GBS can require monthly, weekly, and even daily changes to the system for a myriad of reasons. Even at a minimum of 6 months, this is much too long of a time frame for the operational community to be unable to make critical changes to the system.
This bridge contract action will cover all of the required GBS reachback or Tier II level support and allow for the eventual orderly transition to the next GBS contractor. If the Government is unable to extend the current contract, the Government will suffer a significant loss of continuity and crippling inefficiencies.
Due to the lack of a new contract in place for TIER II support, the Government will not have a contractor or organic personnel in place to continue the sustainment of the operationally accepted software. The GBS system is a very dynamic system and can require monthly, weekly, and in some cases even daily changes.
Not having this bridge contract in place will severely hinder the ability of the operational community to make dynamic changes which could result in the delay of critical and time sensitive operational missions.
Competing this effort would result in unacceptable delays to fulfilling the Air Force's requirement to provide critical software support for the warfighter.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer has determined the anticipated cost of this acquisition will be fair and reasonable based upon evaluation of actual cost history, application of Defense Contract Management Agency recommended rates, and a fair and reasonable profit based on use of weighted guidelines as well as profit rates previously negotiated for similar efforts on this program.
In addition, the Contracting Officer will also make a separate determination of a fair and reasonable price. Any determination made solely on historical data does not relieve the contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual awards using the proposal analysis techniques at 15.404-1. The complexity and circumstances of each acquisition will determine the level of detail of the analysis required. Since adequate price competition is not contemplated under this sole source action, the Government will utilize other price analysis techniques found at FAR 15.404(b) as appropriate to determine a fair and reasonable price. The complexity and circumstances of each acquisition will determine the level of detail of the analysis required.
Since adequate price competition is not contemplated under this sole source action, the Government will utilize other price analysis techniques found at FAR 15.404(b) as appropriate to determine a fair and reasonable price.
