FOR OFFICIAL USE ONLY
Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction
FOR OFFICIAL USE ONLY March 2018 Page 2 of 4
(4) Identification of the exception to fair opportunity and the supporting rationale:
The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(b)(2)(i)(A). The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
The current EPASS competition began in November 2016 and was scheduled to award in December 2017 -- slightly more than a year. This would be the minimum time for a similar fair opportunity competition. The current competition experienced two protests which could make the total duration of the current competition exceed 24 months. A new competition for the requirements of the acquisition herein would therefore take 12-24 months, resulting in an unacceptable delay for these services.
A delay in these services would severely impact the following programs/projects in the AFPEO Business Enterprise Systems
(BES):
1. Program ID 2098 AFPEO BES Portfolio Management -
Disruption of data management and administrative tasks for the BES Program Executive Officer (PEO) directly, as well as the entire Command Staff. This includes delays in providing
(a) acquisition expertise to 120 acquisition programs,
(b) schedule management for the PEO, Director and Deputy Director,
(c) overall BES portfolio management;
(d) daily operational and office automation support;
(e) key mission essential DTS Travel support to the entire PEO
(f) management of critical acquisition documents mandated by law
(g) file plan records management,
(h) Government Travel Card (GTC) processing, and
(i) DTS Travel Support liaison with AFLCMC, AFMC and HQ/AU Financial Management.
2. Program ID 2099 Air Force Enterprise Services (AFES) -
Delays in program management, financial management and administrative tasks for IT Services for the Air Force, including overall enterprise services, acquisition, infrastructure, secure combat information systems and networks.
This would severely decrease the capabilities of the United States Air Force to fly and fight in Air, Space, and Cyberspace.
3. Program ID 2100 Non AFES -
Interruption of program management and administrative tasks in four major programs:
1002 - FFP - for Labor Costs 1003 - NSP - for Data associated with the above CLINs 1004 - COST - for Travel & ODC Costs associated with the above CLINs specified by the Government) 1005 - CAF - Contract Access Fee
The above prices have been finalized with Oasis Systems LLC.. CLINs will be incrementally funded via Sub-CLINs according to the individual projects being supported. The type of appropriations will depend on those individual projects and are typically 3400 and 3600 funds. These costs are for severable services crossing fiscal years 2018 and 2019.
The proposed action is within scope of the basic multiple award contract (MAC). The scope of GSA OASIS SB spans many areas of expertise and includes any and all components required to formulate a total solution to a professional services based requirement. These areas of expertise include but are not limited to program management, management consulting, engineering, logistics and financial. Specifically, the HIC Division requires disciplined program management, financial management, administrative, and other related support utilizing established Government, Contractor, and Industry processes. This requirement falls under the scope of the basic MAC because the areas of expertise fall in line with the scope GSA OASIS SB Pool 6 offers.

Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

(a) Air Force Enterprise Configuration Management Office (AFECMO) which secures the Air Force Network, servers, and client PCs from penetration and sabotage affecting the Air Force mission and users operating on the AF Network (AFNet)
(b) ASACoE (Application Software Assurance Center of Excellence), which provides Software policy and guidance support to the Office of the Under Secretary of Defense for Acquisition, Technology, and Logistics (OUSD(AT&L)) and Department of Defense Chief Information Office (DoD CIO) and serves as the lead field subject matter experts for the DoD Software Assurance Community of Practice.
(c) Product Distribution, which provides support to the Air Force, DoD and NSA for worldwide fielding of software, over 69 Automated Information Systems (AIS), version control and configuration management, and
(d) Field Assistance Services (FAS), which provides 24/7/365 Tier-1 help desk support to the warfighter for 90+ systems at 350 locations.
(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:
To ensure the final contract price will be fair and reasonable, the Government will obtain “other than certified” Cost or Pricing Data from the incumbent contractor, Oasis Systems LLC., for the six month bridge contract. Technical evaluations, cost analysis, price analysis, historical data, market research, and negotiations will be conducted in accordance with FAR Part 15 to ensure that the anticipated cost to the Government will be fair and reasonable. AZS has also purchased a membership to Economic Research Institute (ERI) in order to find the market pay range for a specific position, location, and industry. This along with other on-line salary data will be used to ensure a fair and reasonable price for the 6 month period of performance.
(6) Other facts supporting the justification:
The reason for restricting competition now is to maintain continuity of services for the AFPEO Business Enterprise Systems (BES) Directorate, specifically the Services Division (AFLCMC/HIC) due to the GAO protest of the new EPASS AFLCMC/HI Task Order.
(7) Actions the agency may take to remove or overcome any barriers to increasing fair opportunity before any subsequent acquisition for the supplies or services:
A fair opportunity competition was conducted for the succeeding TO under the EPASS Program through the GSA OASIS-SB IDIQ contract, but the award was protested. Sources other than the incumbent contractor, Oasis Systems LLC., have not and will not be solicited for this bridge effort. The fair opportunity activities associated with the final TO (to which the contract proposed herein is a bridge) have demonstrated that there are numerous contractors competing for these requirements and no further action is necessary.
(8) Program Manager's certification that supporting data is accurate and complete:
