Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

FOR OFFICIAL USE ONLY March 2018 Page 2 of 4

(4) Identification of the exception to fair opportunity and the supporting rationale:

The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(b)(2)(i)(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

The ordering period for the preceding Task Order expired on 7 April 2018, and no further modifications to increase scope of the Task Order are allowable. The normal time for performing a Fair Opportunity Competition ranges from six months to one year, and if a new competition for the requirements of this acquisition were required it would incur an unacceptable delay in the critical services for AFPEO BM.

A delay in these services would severely impact the following programs for AFPEO BM as they currently have known requirements:

The Force Protection Division (AFLCMC/HBU) is in the process of standing up a new branch within the division, which is not clearly defined at this point. The new branch will require Advisory & Assistance Support (A&AS) to meet their mission requirements, which are to develop a Security Forces Global C3 (SFGC3) for communications operations to broadcast IBDSS alarm type signals via hand-held radios. If this TO is not awarded the new Branch within the Division will not be able to meet mission requirements due to the lack of organic support available.

The NORAD Cheyenne Mountain Complex - Integrated Tactical Warning/Attack Assessment(NCMC-ITW/AA) program [Project ID:

81]. NCMC-ITW/AA is the Command and Control (C2) "system of systems" for COCOMS and component echelons of command. It provides the comprehensive C2 capabilities needed to execute NORAD missions and USSTRATCOM space operations and missions including support to other COCOMS. NCMC-ITW/AA supports national strategic objectives and provides space surveillance, warning, cueing and engagement information to the theater COCOMS. Without additional A&AS support, the ability to support national strategic objectives is severely limited.

The Shared Early Warning System (SEWS) program [Project ID: 93]. The SEWS program provides theater missile warning data to select US allies and foreign partners in support of US policy goals. Arrangements are negotiated with individual countries on a bilateral basis to provide selected region-specific missile warning information. The program supports NATO plus eight (8) other partners through FMS cases and other agreements. SEWS also provides COCOMS with situational awareness of missile warning data provided to partners in their Area of Responsibility (AoR). Without additional support the partnerships the SEWS program has with our allies will not be met to its fullest capability.

The Upgraded Early Warning Radar (UEWR) program [Project ID: 122]. The UEWR program, sponsored by the Missile Defense Agency (MDA), upgrades the Fylingdales and Thule BMEWS, and Beale PAVE PAWS with future addition of Clear and Cape Cod radar sites to support the new missile defense missions, while continuing to conduct their BMEWS and PAVE PAWS missions, respectively , maintaining their legacy Missile Warning and Space Surveillance missions. Without the additional support the strong vacancies of organic support will not be filled to meet mission requirements.

The HBQ Infrastructure Program [Project ID: 443]. The HBQ Infrastructure program is the hub for the Strategic Warning & Surveillance Systems (SW&SS) Division. The Staff is responsible for tracking, tasking, and organizing any tasker sent to the programs, any document that requires division management review/signature, and a variety of other administrative functions.

Some of those functions include: supporting weekly division staff meetings, working action items from the directorate weekly meetings, and updating and maintaining various schedules. Additionally, the staff is also responsible for creating, maintaining and/or integrating electronic files, file plans, websites and web-based applications to include; the Division website, e-bidder's

The Period of Performance (PoP) will be Award Date through 17 November 2018 and will have the following CLINs:

1001 - CPFF - for Labor Costs 2001 - CR - for Travel & ODC Costs associated with the above CLIN 4001 - NSP - for Data associated with the above CLINs

The above prices and costs are estimates based on Government estimates and will be finalized after negotiations with the current contractor are complete. CLINs will be incrementally funded via Sub-CLINs according to the individual projects being supported. These costs are for severable services crossing Fiscal Years 2018 and 2019.

FOR OFFICIAL USE ONLY March 2018 Page 3 of 4 library, SharePoint, and other various databases in support of the AFLCMC Enterprise. Without this additional support, Division leadership will not be able to meet mission goals.

The AWACS C2ISR Program [Project ID: 423]. The C2ISR program is responsible for the development of future AWACS C2ISR related capabilities for successful integration with Battle Management C2 (BMC2) operations, providing technology development by analysis, prototyping/demonstrating improved command and control technologies in an increasingly challenging net-centric warfare operations environment. The near term E-3 AWACS C2ISR program will focus on the Internet- Protocol Enabled Communication (IPEC) program that will provide the mission crew with a standalone roll-on-roll-off capability to connect to the SIPRNet to download Air Tasking Order/Airspace Contract Order (ATO/ACO) updates from websites. With the increased focus on IPEC, additional support is required to meet the C2ISR program mission.

The HomeOps Program [Project ID: 424]. The AWACS HomeOps program is the front office group for the AWACS Division providing key support services to AWACS branches located at Hanscom AFB: Commander's Execution Group (CEG), Information Management, Security, Facilities Management, Web Development, Information Technology, Self-Inspection Program, Unit Control Center and Microsoft SharePoint. The HomeOps Program provides day to day support for over three hundred division personnel in the development and sustainment of the AWACS Weapon System; performs execution of all suspenses and taskings, PEG support, and administrative support. Without this additional support, Division leadership will not be able to meet mission goals.

A&AS support enables AFLCMC/HB to accomplish the mission, without the support of this new TO they will be unable to receive to manpower needed to support their requirements. A delay in these services would gravely decrease the capabilities of the United States Air Force to fly and fight in Air, Space, and Cyberspace.

(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:

To ensure the final contract price will be fair and reasonable, the Government will conduct technical evaluations, cost analysis, price analysis, and utilize historical data, market research, and negotiations will be in accordance with FAR Part 15 to ensure that the anticipated cost to the Government will be fair and reasonable. AZS has also purchased a membership to Economic Research Institute (ERI) in order to determine the market pay range for a specific position, location, and industry. This along with other on-line salary data will be used to ensure a fair and reasonable price for the 5 month Period of Performance.

(6) Other facts supporting the justification:

The reason for restricting competition now is to maintain continuity of support for the AFPEO Battle Management (BM) Directorate due to the preceding PASS II IDIQ ordering period having elapsed on 7 April 2018.

A Fair Opportunity Competition process for these requirements is currently on-going and expected to be fully transitioned by 17 November 2018.

(7) Actions the agency may take to remove or overcome any barriers to increasing fair opportunity before any subsequent acquisition for the supplies or services:

AFLCMC/AZS has taken all requisite approaches and maximized industry participation in the EPASS competitive effort. EPASS uses GSA OASIS SB which is a total small business set-aside, multiple award IDIQ contract. Per Policy Memo, Guidance on Mandatory Use of Engineering, Professional and Administrative Support Services (EPASS) for A&AS Contract Vehicles, dated 20 March 2014, issued by AFLCMC/CC, EPASS is a mandatory source for procurement and management of AFLCMC A&AS requirements.

This A&AS effort is slated to move to the follow on EPASS contract, currently in Fair Opportunity Competition, once the Period of Performance has ended on 17 November 2018.
